The\u00a0Applicant\u00a0filed\u00a0an\u00a0RTI\u00a0application\u00a0dt.22.11.10\u00a0with\u00a0the\u00a0CPIO,\u00a0MoEF\u00a0seeking\u00a0certified\u00a0copies\u00a0of\u00a0<\/p>\n<p>      documents\u00a0and\u00a0records\u00a0along\u00a0with\u00a0notings\u00a0and\u00a0all\u00a0enclosures\u00a0thereof\u00a0from\u00a01992\u00a0onwards\u00a0with\u00a0regard\u00a0<\/p>\n<p>      to \u00a0 the \u00a0 proposal \u00a0 seeking \u00a0 environmental \u00a0 clearance \u00a0 for \u00a0 Bandra \u00a0 Worli \u00a0 sea \u00a0 link \u00a0 project \u00a0 and \u00a0 mainly\u00a0<\/p>\n<p>      consisting\u00a0\u00a0of\u00a0a\u00a0bridge\u00a0of\u00a04km\u00a0length.\u00a0\u00a0Shri\u00a0E.\u00a0Thirunavukkarasu,\u00a0CPIO\u00a0replied\u00a0on\u00a025.1.11\u00a0stating\u00a0that\u00a0<\/p>\n<p>      all\u00a0the\u00a0documents\u00a0including\u00a0the\u00a0note\u00a0sheets,\u00a0EIA\u00a0reports\u00a0etc.\u00a0regarding\u00a0the\u00a0Bandra\u00a0Worli\u00a0Sea\u00a0Link\u00a0<\/p>\n<p>      project, \u00a0 available \u00a0 on \u00a0 record \u00a0 were\u00a0 already\u00a0 provided\u00a0 vide\u00a0 letters\u00a0 dt.25.8.09,\u00a0 7.10.09,\u00a0 16.9.09,\u00a0 and\u00a0<\/p>\n<p>      6.12.10.\u00a0\u00a0He\u00a0added\u00a0that\u00a0there\u00a0are\u00a0no\u00a0other\u00a0documents\u00a0available\u00a0with\u00a0the\u00a0Public\u00a0Authority\u00a0and\u00a0that\u00a0if\u00a0<\/p>\n<p>      the\u00a0Applicant\u00a0wishes\u00a0to\u00a0inspect\u00a0the\u00a0records,\u00a0he\u00a0may\u00a0specify\u00a0the\u00a0date\u00a0for\u00a0inspection.\u00a0\u00a0Not\u00a0satisfied\u00a0with\u00a0<\/p>\n<p>      the\u00a0reply,\u00a0the\u00a0Applicant\u00a0filed\u00a0an\u00a0appeal\u00a0dt.5.2.11\u00a0with\u00a0the\u00a0Appellate\u00a0Authority.\u00a0\u00a0He\u00a0stated\u00a0that\u00a0MoEF\u00a0in\u00a0<\/p>\n<p>      its\u00a0affidavit\u00a0in\u00a0reply\u00a0dt.24.10.10\u00a0in\u00a0Bombay\u00a0High\u00a0Court\u00a0in\u00a0Writ\u00a0Petition\u00a0No.992\u00a0of\u00a02010\u00a0has\u00a0made\u00a0the\u00a0<\/p>\n<p>      following\u00a0statements:\n<\/p>\n<p>      Para\u00a04\u00a0&#8211;\u00a0I\u00a0say\u00a0that\u00a0the\u00a0Respondent\u00a0No.9\u00a0had\u00a0submitted\u00a0a\u00a0proposal\u00a0on\u00a010.6.93\u00a0to\u00a0this\u00a0Respondent \u00a0<\/p>\n<p>      seeking\u00a0Environmental\u00a0clearance\u00a0for\u00a0bandra\u00a0Worli\u00a0Sea\u00a0Link\u00a0project.\u00a0\u00a0The\u00a0proposal\u00a0mainly\u00a0consists\u00a0of \u00a0<\/p>\n<p>      a\u00a0bridge\u00a0of\u00a04\u00a0km\u00a0length\u00a0at\u00a0Mahim\u00a0Bay\u00a0between\u00a0Bandra\u00a0and\u00a0Worli\u00a0side\u00a0approach\u00a0road&#8230;&#8217;<\/p>\n<p>      Para\u00a014\u00a0\u00ad\u00a0&#8230;I\u00a0say\u00a0Environmental\u00a0Impact\u00a0Assessment\u00a0of\u00a0BWSL\u00a0project\u00a0covers\u00a0the\u00a0data\u00a0for\u00a0the\u00a0radius \u00a0<\/p>\n<p>      up\u00a0to\u00a010\u00a0km\u00a0which\u00a0includes\u00a0Khan\u00a0Abdul\u00a0Gafar\u00a0Khan\u00a0Road<\/p>\n<p>      Para \u00a0 21 \u00a0 &#8211; \u00a0 I \u00a0 deny \u00a0 the \u00a0 contention\u00a0 of \u00a0 para\u00a0 60\u00a0 that\u00a0 the\u00a0 connector\u00a0 at\u00a0 Pratiksha\u00a0 Building\u00a0 has\u00a0 been \u00a0<\/p>\n<p>      constructed \u00a0 without \u00a0 environmental \u00a0 clearance \u00a0 by \u00a0 Respondent \u00a0 No.1. \u00a0 \u00a0 I \u00a0 say \u00a0 that \u00a0 the \u00a0 proposal \u00a0 of \u00a0<\/p>\n<p>      Respondent \u00a0 No.9 \u00a0 at \u00a0 the \u00a0 time \u00a0 of \u00a0 submitting \u00a0 the \u00a0 proposal \u00a0 for \u00a0 BWSL, \u00a0 had \u00a0 made \u00a0 it \u00a0 clear \u00a0 to \u00a0 this \u00a0<\/p>\n<p>      Respondent\u00a0that\u00a0the\u00a0Bandra\u00a0end\u00a0will\u00a0be\u00a0on\u00a0KAGK\u00a0Road\u00a0and\u00a0the\u00a0approach\u00a0on\u00a0the\u00a0Bandra\u00a0end\u00a0of \u00a0<\/p>\n<p>      BWSL\u00a0 shall\u00a0be\u00a0 in \u00a0the\u00a0form\u00a0 of\u00a0 road\u00a0and\u00a0the\u00a0approach\u00a0part\u00a0of\u00a0Worli\u00a0side\u00a0will\u00a0have\u00a0to\u00a0be\u00a0located \u00a0<\/p>\n<p>      between\u00a0High\u00a0Tide\u00a0Line\u00a0and\u00a0Low\u00a0Tide\u00a0Line\u00a0and\u00a0will\u00a0fall\u00a0in\u00a0CRZ\u00a01\u00a0area.\n<\/p>\n<p>               He\u00a0added\u00a0that\u00a0instead\u00a0of\u00a0making\u00a0available\u00a0the\u00a0specific\u00a0documents\u00a0and\u00a0records\u00a0which\u00a0have\u00a0been\u00a0<\/p>\n<p>              relied\u00a0upon\u00a0by\u00a0MoEF\u00a0in\u00a0the\u00a0 \u00a0above\u00a0points\u00a0as\u00a0mentioned\u00a0in\u00a0the\u00a0said\u00a0affidavit,\u00a0the\u00a0CPIO\u00a0has\u00a0entirely\u00a0<\/p>\n<p>              skirted\u00a0and\u00a0dovetailed\u00a0the\u00a0issue\u00a0by\u00a0stating\u00a0that\u00a0all\u00a0the\u00a0documents\u00a0have\u00a0been\u00a0provided\u00a0and\u00a0that\u00a0there\u00a0<\/p>\n<p>              are\u00a0no\u00a0other\u00a0documents\u00a0available\u00a0with\u00a0the\u00a0Public\u00a0Authority.\u00a0\u00a0On\u00a0not\u00a0receiving\u00a0any\u00a0\u00a0further\u00a0response,\u00a0<\/p>\n<p>              the\u00a0Applicant\u00a0filed\u00a0a\u00a0second\u00a0appeal\u00a0dt.25.3.11\u00a0before\u00a0CIC.<\/p>\n<p>     Decision<\/p>\n<p>2.            During\u00a0the\u00a0hearing,\u00a0the\u00a0Commission\u00a0reviewed\u00a0the\u00a0information\u00a0sought\u00a0against\u00a0each\u00a0point\u00a0in\u00a0the\u00a0RTI\u00a0<\/p>\n<p>     application.\u00a0In\u00a0this\u00a0connection,\u00a0the\u00a0Respondents\u00a0submitted\u00a0\u00a0against\u00a0each\u00a0point\u00a0that\u00a0there\u00a0is\u00a0only\u00a0one\u00a0proposal\u00a0<\/p>\n<p>     with\u00a0regard\u00a0to\u00a0the\u00a0Bandra\u00a0Worli\u00a0Sea\u00a0Link\u00a0Project\u00a0and\u00a0this\u00a0has\u00a0been\u00a0shared\u00a0with\u00a0the\u00a0Appellant\u00a0along\u00a0with\u00a0all\u00a0<\/p>\n<p>     other\u00a0related\u00a0documents\u00a0and\u00a0file\u00a0notings\u00a0and\u00a0that\u00a0there\u00a0are\u00a0no\u00a0other\u00a0proposals.\u00a0 \u00a0He\u00a0added\u00a0that\u00a0information\u00a0<\/p>\n<p>     sought\u00a0by\u00a0the\u00a0Appellant\u00a0\u00a0against\u00a0each\u00a0poi9nt\u00a0is\u00a0\u00a0already\u00a0available\u00a0in\u00a0the\u00a0proposal\u00a0provided\u00a0to\u00a0him.\u00a0<\/p>\n<p>3.            The\u00a0Appellant\u00a0who\u00a0arrived\u00a0late\u00a0for\u00a0the\u00a0hearing\u00a0due\u00a0to\u00a0late\u00a0arrival\u00a0of\u00a0his\u00a0flight\u00a0from\u00a0Mumbai\u00a0refuted\u00a0the\u00a0<\/p>\n<p>     contention\u00a0of\u00a0the\u00a0Respondent\u00a0that\u00a0the\u00a0proposal\u00a0mentions\u00a0a\u00a0bridge\u00a0of\u00a04\u00a0kms\u00a0length.\u00a0\u00a0He\u00a0produced\u00a0before\u00a0the\u00a0<\/p>\n<p>     Commission\u00a0a\u00a0letter\u00a0dt.10.6.1993\u00a0written\u00a0by\u00a0Shri\u00a0Prabhakar\u00a0Dixit,\u00a0Deputy\u00a0Secretary\u00a0to\u00a0Govt.\u00a0of\u00a0Maharashtra\u00a0to\u00a0<\/p>\n<p>     the\u00a0Secretary,\u00a0MoEF\u00a0stating\u00a0that\u00a0IL&amp;FS\u00a0have\u00a0proposed\u00a0to\u00a0take\u00a0up\u00a0the\u00a0construction\u00a0of\u00a0Worli\u00adBandra\u00a0link\u00a0as\u00a0a\u00a0<\/p>\n<p>     BOT\u00a0project\u00a0and\u00a0that\u00a0an\u00a0MOU\u00a0has\u00a0been\u00a0signed\u00a0by\u00a0the\u00a0BMRDA\u00a0with\u00a0IL&amp;FS\u00a0with\u00a0approval\u00a0of\u00a0State\u00a0Govt.\u00a0\u00a0The\u00a0<\/p>\n<p>     letter\u00a0further\u00a0states\u00a0that\u00a0the\u00a0Worli\u00adBandra\u00a0link\u00a0crosses\u00a0Mahim\u00a0Bay\u00a0at\u00a0Worli\u00a0point\u00a0and\u00a0connects\u00a0Bandra\u00a0near\u00a0<\/p>\n<p>     Sea\u00a0Rock\u00a0Hotel\u00a0(by\u00a0a\u00a0bridge\u00a01.2\u00a0km\u00a0long).\u00a0\u00a0According\u00a0to\u00a0the\u00a0Appellant\u00a0this\u00a0is\u00a0the\u00a0proposal\u00a0which\u00a0has\u00a0agreed\u00a0<\/p>\n<p>     to\u00a0and\u00a0that\u00a0the\u00a0bridge\u00a0length\u00a0is\u00a0shown\u00a0to\u00a0be\u00a0only\u00a01.2\u00a0km\u00a0.\u00a0He\u00a0\u00a0averred\u00a0that\u00a0that\u00a0the\u00a0\u00a0contents\u00a0of\u00a0the\u00a0affidavit\u00a0<\/p>\n<p>     filed\u00a0by\u00a0Shri\u00a0Bharat\u00a0Bhushan\u00a0before\u00a0the\u00a0Bombay\u00a0High\u00a0Court\u00a0\u00a0(para\u00a04)\u00a0are\u00a0totally\u00a0incorrect\u00a0\u00a0and\u00a0that\u00a0the\u00a0Shri\u00a0<\/p>\n<p>     Bharat\u00a0Bhushan\u00a0has\u00a0thereby\u00a0mislead\u00a0the\u00a0Hon&#8217;ble\u00a0Court\u00a0on\u00a0this\u00a0matter.\u00a0The\u00a0Appellant\u00a0also\u00a0pointed\u00a0out\u00a0that\u00a0\u00a0the\u00a0<\/p>\n<p>     Appellate\u00a0Authority\u00a0(Shri\u00a0Bharat\u00a0Bhushan)\u00a0has\u00a0made\u00a0it\u00a0clear\u00a0\u00a0in\u00a0his\u00a0response\u00a0\u00a0dated\u00a026.4.11\u00a0to\u00a0the\u00a0first\u00a0appeal\u00a0<\/p>\n<p>     with\u00a0respect\u00a0to\u00a0another\u00a0RTI\u00a0application\u00a0,\u00a0that\u00a0only\u00a0one\u00a0application\u00a0was\u00a0submitted\u00a0by\u00a0BMRDA\u00a0\u00a0and\u00a0according\u00a0to\u00a0<\/p>\n<p>     him\u00a0(Appellant\u00a0)\u00a0that\u00a0\u00a0one\u00a0application\u00a0as\u00a0already\u00a0\u00a0is\u00a0the\u00a0one\u00a0mentioning\u00a0a\u00a0bridge\u00a0of\u00a0length\u00a01.2km\u00a0only\u00a0which\u00a0<\/p>\n<p>     has\u00a0been\u00a0issued\u00a0 \u00a0clearance\u00a0by\u00a0the\u00a0 Ministry\u00a0on\u00a07.1.1999.\u00a0 \u00a0The\u00a0Appellant\u00a0wanted\u00a0to\u00a0know\u00a0what\u00a0the\u00a0exact\u00a0<\/p>\n<p>     proposal\u00a0which\u00a0has\u00a0been\u00a0cleared\u00a0indicates.\u00a0A\u00a0bridge\u00a0of\u00a01.2km\u00a0or\u00a0of\u00a04\u00a0kms\u00a0length\u00a0<\/p>\n<p>     4.       The\u00a0Commission\u00a0after\u00a0hearing\u00a0the\u00a0submissions\u00a0of\u00a0both\u00a0sides\u00a0and\u00a0having\u00a0noted\u00a0that\u00a0the\u00a0Respondents\u00a0<\/p>\n<p>              have\u00a0not\u00a0placed\u00a0complete\u00a0facts\u00a0before\u00a0the\u00a0undersigned,\u00a0directs\u00a0the\u00a0PIO,\u00a0Ministry\u00a0of\u00a0Environment\u00a0&amp;\u00a0<\/p>\n<p>              Forests\u00a0to\u00a0bring\u00a0the\u00a0complete\u00a0\u00a0\u00a0file\u00a0containing\u00a0the\u00a0\u00a0original\u00a0\u00a0proposal\u00a0on\u00a0the\u00a0subject\u00a0matter,\u00a0\u00a0that\u00a0has\u00a0<br \/>\n          been\u00a0cleared\u00a0by\u00a0the\u00a0Ministry\u00a0as\u00a0also\u00a0the\u00a0\u00a0documents\u00a0issuing\u00a0the\u00a0clearance\u00a0along\u00a0with\u00a0other\u00a0related\u00a0<\/p>\n<p>         communication\u00a0 \u00a0to\u00a0the\u00a0Commission\u00a0for\u00a0their\u00a0inspection\u00a0by\u00a0Shri\u00a0G.\u00a0Subramanian,\u00a0Deputy\u00a0Registrar,\u00a0<\/p>\n<p>         CIC\u00a0on\u00a0\u00a011\u00a0August,\u00a011,\u00a04.30p.m\u00a0so\u00a0that\u00a0the\u00a0Commission\u00a0can\u00a0\u00a0verify\u00a0the\u00a0facts\u00a0for\u00a0itself\u00a0\u00a0before\u00a0giving\u00a0<\/p>\n<p>         any\u00a0decision.\u00a0\n<\/p>\n<\/p>\n<p>5.
