No.11759.11\n\n\n            Writ Petition No. 11759 of 2011\n22\/07\/2011<\/pre>\n<p>     Shri    S.     K.   Patel,   learned       counsel     for     the<br \/>\npetitioners.\n<\/p>\n<p>     This      petition     under     Article      226      of      the<br \/>\nConstitution of India is directed against the order<br \/>\ndated   27-05-2011         whereby,       the    petitioners        are<br \/>\nrepatriated to the parent department i.e. School<br \/>\nEducation Department.\n<\/p>\n<p>     The petitioners are the employees of School<br \/>\nEducation Department and were sent on deputation<br \/>\nas Block Academic Coordinator, Janpad Shiksha<br \/>\nKendra, Nagod, district Satna, in the year 2003<br \/>\nwhile holding the post of Upper Division Teacher.<br \/>\nSubsequent          thereafter,     the     petitioners           were<br \/>\npromoted       as        Head-Master       by      order         dated<br \/>\n08- 02-2008; however, it appears that, they were<br \/>\ncontinued      to     discharge     the     duties     as        Block<br \/>\nAcademic     Coordinator,         Janpad        Shiksha     Kendra,<br \/>\nNagod. Subsequent thereafter, the impugned order<br \/>\ncame to be passed on the ground that since Head-<br \/>\nMasters are not eligible to be posted as Block<br \/>\nAcademic       Coordinator,         the     petitioners           were<br \/>\nrepatriated to the parent department.\n<\/p>\n<p>     Trite it is that to be on deputation is not a<br \/>\nright. Equally true it is that the term of deputation<br \/>\ncan be curtailed. It has been held so by Division<br \/>\n                                                  W.P. No.11759.11<\/p>\n<p>Bench of this Court in the case of <a href=\"\/doc\/38739\/\">Anil Kumar<br \/>\nNanda v. State of Madhya Pradesh and others (W.A.<br \/>\nNo.<\/a>    802\/2007      and    other    connected   matters)<br \/>\ndecided on 02-07-2007; that a deputation can be<br \/>\ncurtailed at any time as it does not create any<br \/>\nvested right in the deputationist.\n<\/p>\n<p>      The ratio laid down in Anil Kumar Nanda (supra) as<br \/>\nculled out in paragraph 39 thereof is that curtailing the<br \/>\ntenure of deputation and repatriation before completion of<br \/>\ntenure is not bad in law. It was held :\n<\/p>\n<blockquote><p>        &#8220;39. From the aforesaid analysis, it is<br \/>\n        clear as noon day that some of the<br \/>\n        officers have been working in the<br \/>\n        deputed    posts    from   considerable<br \/>\n        length of time. True it is, some of<br \/>\n        them have been sent recently and<br \/>\n        their tenure has been curtailed. The<br \/>\n        colossal complaint that is urged is<br \/>\n        that the tenure has been curtailed.<\/p><\/blockquote>\n<p>        The supporting stand of the Municipal<br \/>\n        Corporations and the Municipalities<br \/>\n        is that if the deputationists are<br \/>\n        allowed to be repatriated, there will<br \/>\n        be difficulty in the functioning of the<br \/>\n        Municipal     Corporations    and   the<br \/>\n        Municipalities.    The other stand of<br \/>\n        the interveners and the Associations<br \/>\n        is that by such deputations, their<br \/>\n        promotions are affected. We are not<br \/>\n        inclined to dwell upon the conception<br \/>\n                                     W.P. No.11759.11<\/p>\n<p>of    abridgment   of   prospects    of<br \/>\npromotion because the present spate<br \/>\nof litigations do not involve such a<br \/>\nlis.   We are also not inclined to<br \/>\naddress ourselves to the stand and<br \/>\nstance put forth by the Municipal<br \/>\nCorporations and the Municipalities<br \/>\nas we are disposed to think, they can<br \/>\nalways enter into communication with<br \/>\nthe Government about the need<br \/>\nkeeping in view the rules in vogue<br \/>\nand solve the problem. There is per<br \/>\nse no justification on their part to<br \/>\nsupport a particular set of deputed<br \/>\nincumbents     on    the    guise    of<br \/>\nconception    of   necessity.      The<br \/>\nnecessity can be looked after from<br \/>\nother spectrums by the Municipal<br \/>\nCorporations\/Municipalities as well<br \/>\nas by the State Government. We only<br \/>\nobserve that the State Government<br \/>\nand the Municipal Corporations and<br \/>\nMunicipalities    should    work     in<br \/>\nharmony so that the work of the<br \/>\nMunicipal    Corporations     and  the<br \/>\nMunicipalities does not suffer. What<br \/>\nwe are disposed to think is that the<br \/>\noriginal employer has a right to pass<br \/>\nan order of repatriation and such<br \/>\norders have been passed keeping<br \/>\ncertain parameters in view. Be that<br \/>\nas it may, no mala fide is perceptible.\n<\/p>\n<p>                                            W.P. No.11759.11<\/p>\n<p>       The employee has no right to be<br \/>\n       continued in the said post. What is<br \/>\n       canvassed before us is that the need<br \/>\n       has to be taken into consideration.<br \/>\n       The State Government has urged that<br \/>\n       the said aspect has been looked into.<br \/>\n       Be it placed on record and there is no<br \/>\n       case where absorption has been<br \/>\n       made\/taken place.&#8221;\n<\/p>\n<p>     In view whereof no interference is warranted<br \/>\nwith the impugned order of repatriation.\n<\/p>\n<p>     In the result the petition fails and is hereby<br \/>\ndismissed.\n<\/p>\n<p>                             (SANJAY YADAV)<br \/>\n                                 JUDGE<br \/>\nSC\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Sunil Kumar Sharma vs The State Of Madhya Pradesh on 22 July, 2011 W.P.
