C followed\t the  sealed\ncover  procedure.On the basis of a F.I.R. registered by\t the\nC.B.1.\ton 30.9.1988, the decision to initiate\tdisciplinary\nproceeding   was  taken\t by  the  competent   authority\t  on\n20.11.1989   though  the  F.I.R.  was  received\t by  it\t  on\n31.5.1989.The  charge sheet was issued to the respondent  on\n1.8.1990.\nThe respondent challenged before the Central  Administrative\nTribunal.  the-action  of the D.P.C. to\t follow\t the  sealed\ncover procedure in his case.\nThe  Tribunal allowed respondent's application holding\tthat\nthe sealed cover procedure could not be followed in view  of\nthe  decision  in  Union  of India  and\t Others;  v.  K.  V.\nJankiraman and Others. [1991] 4 SCC 109.\nIn  this  appeal  by  special  leave  the  Union  of   India\nquestioned the decision of the Tribunal..\nAllowing the appeal, this Court,\nHELD: 1.1. The sealed cover procedure is attracted even when\na   'decision  has  been  taken\t to  initiate\tdisciplinary\nproceedings' or\n46\n'decision  to accord sanction for prosecution is  taken'  or\n'criminal  prosecution is launched or.......... decision  to\naccord sanction for prosecution is taken'. (48-G)\n1.2. When  the\tcompetent authority takes  the\tdecision  to\ninitiate  a disciplinary, proceeding or steps are taken\t for\nlaunching  a  criminal prosecution  against  the  government\nservant,   he\tcannot\tbe  given  the\t promotion,   unless\nexonerated,  even it' the government servant is\t recommended\nfor   promotion\t hi,  the  D.P.C..  being   found   suitable\notherwise. (48-H, 49-A)\n1.3. In a case like the present. where the First Information\nReport\t was   registered   by\t the   Central\t Bureau\t  of\nInvestigation,\tand  (on that basis the\t decision  had\tbeen\ntaken  by the competent authority to  initiate\tdisciplinary\nproceedings   for  imposition  of  major  penalty   on\t the\nrespondent   prior  to\tthe  meeting  of  the  D.P.C.,\t the\napplicability  of  the\tsealed\tcover  procedure  cannot  he\ndoubted. (49-B)\n1.4  The   formulation\t of   the   charges   required\t for\nimplementing  the  decision of the  competent  authority  to\ninitiate the disciplinary proceedings. is satisfied in\tsuch\na  case by the recording of the First Information Report  by\nthe  Central  Bureau  of  Investigation\t which\trecords\t the\nallegations  against the respondent, and provides the  basis\nfor disciplinary proceedings.  The requisite formulation  of\nthe  charges, in such a case. is no longer  nebulous.  being\ncrystalised in the F.I.R. itself and, therefore. even if the\nchargesheet  was  issued by its despatch to  the  respondent\nsubsequent  to\tthe meeting (if the D.P.C. this\t fact  alone\ncannot benefit the respondent. (49-C-1))\n1.5. The question to examine in each case, is: whether,\t the\ndecision  to initiate the disciplinary proceedings had\tbeen\ntaken or steps for criminal prosecution initiated before the\ndate  on which the D.P.C. made the selection?  The  decision\nwould  depend on the facts of the case. keeping in view\t the\nobject\tsought to be achieved by adopting the  sealed  cover\nprocedure. (49-E)\n1.6. It\t would be incongruous to hold that, in a  case\tlike\nthe  present,where the C.B.I. had recorded the F.I.R.;\tsent\nthe  same to the superior authorities of the respondent\t for\ntaking necessary action\n47\nand  the competent authority had taken the decision, on\t the\nbasis  of the F.I.R., to initiate  disciplinary\t proceedings\nagainst\t the  respondent for imposition\t of  major  penalty,\nthere  can be any doubt that the sealed cover  procedure  is\nattracted   to\tavoid  promoting  the\trespondent,   unless\nexonerated of those charges. (49-<a href=\"\/doc\/1010619\/\">F)\nUnion of India and Other v. K. V. Jankiraman and Ors.<\/a> [1991]\n4  SCC\t109; <a href=\"\/doc\/1548130\/\">Delhi Development Authority v.  H.\t C  Khurana.\nC.A. No.<\/a> 1240 of 1993-D\/-7.4.1993, referred to. (51-B)\n1.7. Clause (iv) of the office Memorandum No.22011\/2\/86-Esst\n(A)  dated 12.1.1988 relates to Government servants  against\nwhom an investigation on serious allegations of\t corruption,\nbribery or similar grave misconduct is in progress either by\nthe CBI or any other agency' departmental or otherwise.\t The\nfact  that the F.I.R. was registered by the C.B.I.,  and  on\ncommunication  of the same to the departmental\tsuperiors  a\ndecision had been taken to initiate disciplinary proceedings\nfor imposition of a major penalty, against the respondent in\nthe  present  case, bring--. this case squarely\t within\t the\nambit  of  clause  (iv) of the guidelines,  in\taddition  to\nclause (II), there of. (50C-D)\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL APPELLATE JURISDICTION Civil Appeal No. 1584 of 1993.<br \/>\nFrom  the Judgment and Order dated 14.8.1992 of the  Central<br \/>\nAdministrative Tribunal, Principal Bench, New Delhi in\tO.A.<br \/>\nNo. 2737 of 1991.\n<\/p>\n<p>V.R. Reddy, Addl.  Solicitor General, R. Sasiprabhu and V.K.<br \/>\nVerma (NP) for the Appellant.\n<\/p>\n<p>S.K. Gupta.  R.K. Kamal and B.S. Gupta for the Respondent.<br \/>\nThe judgment of the Court was delivered by<br \/>\nVERMA,\tJ. : The respondent, kewal Kumar, was  Deputy  Chief<br \/>\nElectrical Engineer, Northern Railway at New Delhi when\t the<br \/>\nDepartmental  Promotion Committee(D.P.C.)met  on  23.11.1989<br \/>\nfor consid-\n<\/p>\n<p><span class=\"hidden_text\">48<\/span><\/p>\n<p>ering  the respondent and some others for promotion to\ttile<br \/>\nSenior Administrative Grade.  The D.P.C. followed the scaled<br \/>\ncover  procedure in the case of the respondent, in  view  of<br \/>\nthe   fact  that  the  decision\t to  initiate\tdisciplinary<br \/>\nproceedings against him for imposition of major penalty\t had<br \/>\nbeen taken by the competent authority earlier on  20.11.1989<br \/>\nThe decision to initiate disciplinary proceedings was  taken<br \/>\non   the  basis\t of&#8217;  a\t First\t Information   Report(F.I.R)<br \/>\nregistered   on\t  30.9.1988  by\t tile  Central\t Bureau\t  of<br \/>\nInvestigation (C.B.I.) which was received by tile  concerned<br \/>\ndepartmental  authorities  oil 31.5.1989. Even\tthough\ttile<br \/>\ndecision was so taken oil 20.1 1.1989 on tile basis of\t&#8216;the<br \/>\nF.I.R.\tmade  much earlier, the\t charge-sheet  was  actually<br \/>\nissued\tto  the\t respondent  on\t 1.8.1990.   The  respondent<br \/>\nchallenged  before  the\t Central  Administrative   Tribunal.<br \/>\nPrincipal  Bench.   New Delhi the action of  the  D.P.C.  to<br \/>\nfollow the sealed cover procedure in his case.\tThe Tribunal<br \/>\nhas    accepted\t the  respondent&#8217;s  claim  and\t allowed his<br \/>\napplication  holding that the sealed cover  procedure  could<br \/>\nnot  he followed in view of the decision in <a href=\"\/doc\/1010619\/\">Union  of  India<br \/>\nand  Others v. K.V. Janakiraman and others<\/a> [1991] 4 SCC\t 109<br \/>\nThe  Union of India has challenged that decision by  special<br \/>\nleave, in this appeal.\n<\/p>\n<p>The question in the present case is whether the decision  in<br \/>\nJankiraman  was correctly applied in the present  situation&#8221;<br \/>\nfit  Jankiraman\t  itself, it his been pointed out  halt\t the<br \/>\nsealed cover procedure is to he followed where a  government<br \/>\nservant\t is  recommended for promotion by the\t D.P.C.\t but<br \/>\nbefore lie is actually promoted if he is either placed under<br \/>\nsuspension or disciplinary proceedings are taken against him<br \/>\nor  a  decision has been taken to   initiate  proceedings or<br \/>\ncriminal  prosecution  is  launched  or\t sanction  for\tSuch<br \/>\nprosecution  has  been\tissued or decision  to\taccord\tsuch<br \/>\nsanction  is  taken&#8217;.  Thus the sealed\tcover  procedure  is<br \/>\nattracted  even when a decision has been taken\tto  initiate<br \/>\ndisciplinary proceedings, or decision to accord sanction for<br \/>\nprosecution  is taken  or criminal  prosecution\t is launched<br \/>\nor&#8230;&#8230;&#8230;  decision to accord sanction for prosecution  is<br \/>\ntaken.\t The object of following the sealed cover  procedure<br \/>\nhas been indicated recently in the decision in Civil  Appeal<br \/>\nNo.  1240  of  1993Delhi  Development  Authority,  v..\tH.C.<br \/>\nKhurana-pronounced on April 7.\t   1993.  and  need  not  be<br \/>\nreiterated<br \/>\nIt  is obvious that when the competent authority  takes\t the<br \/>\ndecision<br \/>\n<span class=\"hidden_text\">49<\/span><br \/>\nto initiate a disciplinary proceeding or steps are taken for<br \/>\nlaunching  a  criminal prosecution  against  the  government<br \/>\nservant,   he\tcannot\tbe  given  the\t promotion,   unless<br \/>\nexonerated,  even if the government servant  is\t recommended<br \/>\nfor promotion by the D.P.C., being found suitable  otherwise<br \/>\nIn  a  case like the present, where  the  First\t information<br \/>\nReport\t was   registered   by\t the   Central\t Bureau\t  of<br \/>\nInvestigation,and on that basis the decision had been  taken<br \/>\nby   the   competent  authority\t to   initiate\t deciplinary<br \/>\nproceedings   for  imposition  of  major  penalty   on\t the<br \/>\nrespondent   prior  to\tthe  meeting  of  the  D.P.C.,\t the<br \/>\napplicability  of  the\tsealed\tcover  procedure  cannot  be<br \/>\ndoubted.   The\tformulation  of\t the  charges  required\t for<br \/>\nimplementing  the  decision of the  competent  authority  to<br \/>\ninitiate the disciplinary proceedings. is satisfied in\tsuch<br \/>\na  case by the recording of the First Information Report  by<br \/>\nthe  Central  Bureau  of  Investigation\t which\trecords\t the<br \/>\nallegations  against the respondent, and provides the  basis<br \/>\nfor disciplinary proceedings.  The requisite formulation  of<br \/>\nthe  charges, in such a case, is no longer  nebulous,  being<br \/>\ncrystallised  in the F.I.R. itself and , therefore, even  if<br \/>\nthe   charge-sheet  was\t issued\t by  its  despatch  to\t the<br \/>\nrespondent  subsequent\tto the meeting of the  D.P.C.,\tthis<br \/>\nfact alone cannot benefit tile respondent.<br \/>\nThe  question  to examine in each case, is  :  Whether,\t the<br \/>\ndecision  to initiate the disciplinary proceedings had\tbeen<br \/>\ntaken or steps for criminal prosecution initiated before the<br \/>\ndate  on which the D.P.C. made the selection?  The  decision<br \/>\nwould  depend on the facts of the case, keeping in view\t the<br \/>\nobject\tsought to be achieved by adopting the  sealed  cover<br \/>\nprocedure.  It would be incongruous to hold that, in a\tcase<br \/>\nlike  the present, where the B.I. had recorded\tthe  F.I.R.;<br \/>\nsent the same to the superior authorities of the  respondent<br \/>\nfor taking necessary action; and the competent authority had<br \/>\ntaken the decision, on the basis of the F.I.R., to  initiate<br \/>\ndisciplinary   proceedings   against  the   respondent\t for<br \/>\nimposition of major penalty, there can be any doubt that the<br \/>\nsealed\tcover procedure is attracted to avoid promoting\t the<br \/>\nrespondent,  unless  exonerated\t of  those  charges.   These<br \/>\nfacts,\twhich  led  to\tthe adoption  of  the  sealed  cover<br \/>\nprocedure,  are\t undoubtedly very material  to\tadjudge\t the<br \/>\nsuitability  of a person for promotion to a higher post.   A<br \/>\ndecision  to  follow  the sealed cover\tprocedure  in  these<br \/>\ncircumstances cannot, therefore, be faulted.\n<\/p>\n<p><span class=\"hidden_text\">50<\/span><\/p>\n<p>It  is unnecessary in the present case to discuss at  length<br \/>\nthe decision in Jankiraman to indicate its in  applicability<br \/>\nto  the\t respondent, since it has been done  in\t the  recent<br \/>\ndecision in Civil Appeal No. 1240 of 1993-Delhi\t Development<br \/>\nAuthority v.. H. C. Khurana-pronounced on April 7, 1993.<br \/>\nWe may also advert to another aspect of this case.  In\tPara<br \/>\n2  of the office Memorandum No. 22011\/2\/86-Estt.  (A)  dated<br \/>\n12.1.1988 issued by the Department of Personnel &amp;  training,<br \/>\nMinistry  of  Personnel,  Public  Grievances  and  Pensions,<br \/>\nGovernment  of\tIndia,\ton  the\t subject  of  procedure\t and<br \/>\nguidelines  to\tbe followed in such  cases,  indicating\t the<br \/>\nsituations  in\twhich the scaled cover procedure  is  to  be<br \/>\nfollowed,  clause (iv) specifies another  category.   Clause\n<\/p>\n<p>(iv)  relates  to  &#8216;Government\tservants  against  whom\t  an<br \/>\ninvestigation on serious allegations of corruption,  bribery<br \/>\nor similar grave misconduct is in progress either by the CBI<br \/>\nor  any\t other agency, departmental or\totherwise.&#8217;The\tfact<br \/>\nthat  the  F.I.R.  was\tregistered by  the  C.B.I.,  and  on<br \/>\ncommunication  of the same to the departmental\tsuperiors  a<br \/>\ndecision had been taken to initiate disciplinary proceedings<br \/>\nfor imposition of a major penalty, against the respondent in<br \/>\nthe present case, brings this case squarely within the ambit<br \/>\nof  clause  (iv) of the guidelines, in\taddition  to  clause\n<\/p>\n<p>(ii), thereof.\n<\/p>\n<p>Following of the sealed cover procedure in the present\tcase<br \/>\nwas,  therefore, fully justified and the Tribunal  committed<br \/>\nan error in interfering with that action of the Government.<br \/>\nConsequently,  the appeal is allowed, the impugned order  of<br \/>\nthe  Tribunal  is set aside, resulting in dismissal  of\t the<br \/>\nrespondent&#8217;s application made to the Tribunal.\tNo costs.<br \/>\nV.P.R.\n<\/p>\n<p>Appeal allowed.\n<\/p>\n<p><span class=\"hidden_text\">51<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India vs Kewai, Kumar on 12 April, 1993 Equivalent citations: 1993 AIR 1585, 1993 SCR (3) 45 Author: J S Verma Bench: Verma, Jagdish Saran (J) PETITIONER: UNION OF INDIA Vs.
