2. Sri.Madanmohan M.Khannur, learned counsel for the<\/p>\n
appellants submits that the Commissioner has  a<\/p>\n
finding that the deceased was not an employee  <\/p>\n
respondent and based on the _said__ \ufb01ndi’hg,–f;r.1~i’e V’<\/p>\n
application came to be rejected. Thegfurther subm.issiont’*mVad:e<\/p>\n
is that the deceased Karabasappa__Huller ‘\\~’hile”\u00a7i?orking in the!’<\/p>\n
land of the respondent came in c_olr’;tac–t _vwith’t\u00abheve1ectrical wire<\/p>\n
and died. Therefore, the irnpugneci ‘ordeir-betset aside.<\/p>\n
3. On the   learned counsel
\nfor the respofi  the Commissioner has
\nconsidered**th,e.A:  before him carefully and
\nhas arrived’ at V  the deceased was not an<\/p>\n
employee under the relspondent herein and the very respondent<\/p>\n
~,Was also iexamine’d,as_pRW–1 before the Commissioner apart<\/p>\n
exa.minin:g’vtwo witnesses RW\u00bb2 and RW–3 and therefore<\/p>\n
the finding o’f–th’e”Commissioner cannot be termed as erroneous<\/p>\n
— or perverse. . if<\/p>\n
   a ‘pi’-‘piaving thus heard both sides and on going through the<\/p>\n
 –\ufb02ordfer of the Commissioner and the record of this case, I find<\/p>\n
}<\/p>\n

that the Commissioner has considered the evidence of RW–1
\nwho happen to be the respondent herein and as also RWg2 and<\/p>\n
RW–3 and has observed that the respondent has cleajr’l_v’jsta–ted<\/p>\n
that the deceased was not an employee under <\/p>\n
moreover when large number of co_,ol.i.e,s are””avail’able’ in the’<\/p>\n
village of the respondent, there was no njeedivfoi\u00bb.the:’reslpo’ndent<\/p>\n
to go in search of Coolie to some other vi~l.1ag.=: namely\u00ab-Chalageri. V L’<\/p>\n
village. Therefore, the Commis_sioner.._pafter’ \u00abappreciating the
\nentire evidence has   that the claimants
\nhad failed to establish  the employee
\nunder the  _:’l’he being a \ufb01nding on
\nfact, I seeuno of law for consideration and
\ntherefore Atheapppeal  be dismissed. However, the<\/p>\n
claimants area at liberty to proceed against the Karnataka<\/p>\n
 .Electr’icitj?’iBoV}ard if thevso desire in accordance with law.<\/p>\n
