Gohil for the applicant submitted that the<br \/>\napplicant is an innocent person and false case is foisted on him.<br \/>\nConsidering the role played by the applicant as reflected in<br \/>\nAnnexure:A to the application and the manner in which alleged offence<br \/>\nis committed by him, the applicant be also enlarged on bail.\n<\/p>\n<p>\tLearned<br \/>\nAPP Ms. M.L. Shah, representing the opponent State, while opposing<br \/>\nthe bail application, submitted that the applicant is involved in the<br \/>\noffence punishable under Sections 379, 411, 447 and 114 of IPC.<br \/>\nConsidering the role attributed to the applicant which is reflected<br \/>\nin the FIR at Annexure:A to the application, the manner in which the<br \/>\noffence is committed by him, no discretionary relief be granted to<br \/>\nthe applicant and the application deserves to be rejected.\n<\/p>\n<p>\tI<br \/>\nhave considered the rival submissions. On perusal of the averments<br \/>\nmade in the application, role attributed to the applicant which is<br \/>\nreflected in the FIR at Annexure:A to the application, provisions of<br \/>\nSections 379, 411, 447 and 114 of IPC, quantum of punishment etc.  I<br \/>\nam of the view that the applicant deserves to be enlarged on bail.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No.I-245\/2009 registered at Sarkhej Police Station on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>pirzada\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Sudhirsinh vs State on 8 February, 2010 Author: H.B.Antani,&amp;Nbsp;
