It is the case of the<br \/>\npetitioners that though they were promoted to the post of<br \/>\nDriver-cum-pump operator w.e.f. 04.11.1999,  they were treated as<br \/>\nacting on the said post and therefore, they were not granted the<br \/>\nbenefits of being permanent employee.  As the petitioners services<br \/>\nwere not regularized by the respondents, the petitioners sent a legal<br \/>\nNotice dated 14.12.2009 to the respondents. However, till date the<br \/>\npetitioners services had not be regularized by the respondents.<br \/>\nHence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is not in dispute that the petitioners were appointed<br \/>\non daily wages by the respondents as   there is no original order of<br \/>\nappointment of the petitioners on the record of the case. The issue<br \/>\nwhether a person working on a daily wage basis can claim<br \/>\nregularization in service has already been settled.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe case of <a href=\"\/doc\/1591733\/\">Secretary, State of Karnataka &amp; Ors. v. Umadevi<br \/>\n&amp; Ors.,<\/a> (2006) 4 S.C.C. 1, the Apex Court has held that<br \/>\nCourts should not issue directions with regard to adsorption,<br \/>\nregularization, or permanent continuance of temporary, contractual,<br \/>\ncasual, daily-wage or ad-hod employees appointed\/recruited and<br \/>\ncontinued for long in public employment dehors the constitutional<br \/>\nscheme of public employment, unless the recruitment itself was made<br \/>\nregularly and in terms of the constitutional scheme.\n<\/p>\n<p>5.\t\tLooking<br \/>\nto the facts of the case and the principle laid down by the Apex<br \/>\nCourt in the above decision, these petition does not deserve to be<br \/>\nentertained.\n<\/p>\n<p>6.\t\tConsequently,<br \/>\nthe petition is dismissed.\n<\/p>\n<p>[K.S.JHAVERI,<br \/>\nJ.]<\/p>\n<p>\/phalguni\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rameshbhai vs Municipal on 22 June, 2010 Author: Ks Jhaveri,&amp;Nbsp;
