Balachandran, J.\n            --------------------------\n             W.P.(C)No.1870 of 2009 V\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Heard    the   learned    Government    Pleader<\/p>\n<p>Sri.Mohammed Fazil.\n<\/p>\n<p>    2.   This writ petition is filed assailing<\/p>\n<p>Exhibit  P7   judgment  of   the  District   Judge,<\/p>\n<p>Thodupuzha in O.P.(Local Fund) No.16\/07. By Exhibit<\/p>\n<p>P7  judgment,   the   court   below   allowed   the<\/p>\n<p>application filed by the first respondent under<\/p>\n<p>Section 20(13) of the Kerala Local Fund Audit Act<\/p>\n<p>to  set  aside  the  Surcharge  Certificate  Nos.LF<\/p>\n<p>11295\/Spl.cell (Sc 2) 2005 dated 7.11.2006 and LF<\/p>\n<p>11295\/Spl.cell (Sc 2) 2005 dated 7.11.2006 for the<\/p>\n<p>reason that the claims made therein are hopelessly<\/p>\n<p>barred by limitation in view of the proviso to sub<\/p>\n<p>section (9) to Section 215 of the Kerala Panchayat<\/p>\n<p>Raj Act, which mandates that no surcharge shall be<\/p>\n<p>made after a period of four years from the date on<\/p>\n<p>which the expenditure in question was incurred.<\/p>\n<p><span class=\"hidden_text\">WPC 1870\/09                2<\/span><\/p>\n<p>     3.    Learned Government Pleader has no dispute<\/p>\n<p>that the claim has been made after a period of four<\/p>\n<p>years from the date the expenditure in question was<\/p>\n<p>incurred.    But, his contention is that by reason of<\/p>\n<p>Section 22 of the Kerala Local Fund Audit Act,<\/p>\n<p>1994, any provision contained in any other law for<\/p>\n<p>the time being in force relating to the audit of<\/p>\n<p>accounts of a local authority or a local fund<\/p>\n<p>included    in  the  schedule  is  repugnant to   the<\/p>\n<p>provisions of the Kerala Local Fund Audit Act, the<\/p>\n<p>latter shall prevail and the former to be avoided<\/p>\n<p>to the extent of such repugnancy.      All the same,<\/p>\n<p>Government Pleader submits that under the Kerala<\/p>\n<p>Local Fund Audit Act no period is prescribed for<\/p>\n<p>advancing a claim for surcharge and therefore, the<\/p>\n<p>provisions of the proviso to sub section (9) to<\/p>\n<p>Section 215 of the Kerala Panchayat Raj Act is<\/p>\n<p>inconsistent with the provisions of the Kerala<\/p>\n<p>Local Fund Audit Act, 1994 and hence, there won&#8217;t<\/p>\n<p>be any limitation.\n<\/p>\n<p><span class=\"hidden_text\">WPC 1870\/09                3<\/span><\/p>\n<p>     4.    The argument advanced is unsound. When no<\/p>\n<p>provision is made in the Kerala Local Fund Audit<\/p>\n<p>Act, there is no question of any other provision in<\/p>\n<p>that behalf in any other statute being repugnant.<\/p>\n<p>The submission that there is no provision made in<\/p>\n<p>the Kerala Local Fund Audit Act limiting the time<\/p>\n<p>does not enable the claim being advanced at any<\/p>\n<p>time.     The omission to provide any time limit in<\/p>\n<p>the Kerala Local Fund Audit Act means that the<\/p>\n<p>provision contained in the proviso to Section 215<\/p>\n<p>of the Kerala Panchayat Raj Act is not inconsistent<\/p>\n<p>with the provisions of the Kerala Local Fund Audit<\/p>\n<p>Act.
