All  of\tthem<br \/>\nretired\t from the service prior to 31st March, 1985.   Their<br \/>\npensionary  benefits  were  calculated\tas  per\t the   rules<br \/>\nprevalent   at\tthe  time  of\ttheir  retirement.    By   a<br \/>\nnotification\/order dated 9th July, 1985 issued by Government<br \/>\nof  Punjab, Department of Finance, it was inter alia decided<br \/>\nthat  the  dearness allowance and ad hoc dearness  allowance<br \/>\nsanctioned up to the consumers price level index no.568 will<br \/>\nbe  treated  as dearness pay for the purposes of  pensionary<br \/>\nbenefits,  i.e.,  for  calculating  pension,  gratuity\/DCRG,<br \/>\ninternal  gratuity in respect of the employees retired on or<br \/>\nafter  31st  March,  1985.  Since the respondents  were\t not<br \/>\ngiven  the benefit of the aforesaid notification, they filed<br \/>\na  writ\t petition  in the High Court claiming  the  benefits<br \/>\nconferred  by  the notification dated 9th July,\t 1985.\t The<br \/>\nHigh  Court  by the impugned judgment dated  18th  November,<br \/>\n1998 allowed the writ petition directing the State of Punjab<br \/>\nto  pay all dues to the writ petitioners on the basis of the<br \/>\norder  dated  9th  July,  1985 noticing\t that  the  question<br \/>\ninvolved  in the case is squarely covered by the decision of<br \/>\nthis Court in Dr.Asa Singh&#8217;s case.\n<\/p>\n<p>      The  decision  in\t the case of Dr.Asa Singh  has\tbeen<br \/>\nconsidered  and explained in a later decision of this  <a href=\"\/doc\/589310\/\">Court<br \/>\n(State\tof  Punjab  &amp; Ors.  V.\tBoota Singh  &amp;\tAnr.,  Civil<br \/>\nAppeal\tNo.10674  of<\/a> 1996 decided on 7th August, 1997).\t  In<br \/>\nthis  decision, it has been noticed that in Dr.\t Asa Singh&#8217;s<br \/>\ncase,  after the dismissal of the special leave petition  on<br \/>\n13th  May,  1993, the State Government sought to reopen\t the<br \/>\nmatter\tby  filing an interlocutory application\t before\t the<br \/>\nHigh Court for clarification.  The clarification application<br \/>\nwas dismissed by the High Court and the judgment of the High<br \/>\nCourt  was upheld by this Court holding that since the\tmain<br \/>\njudgment  had  become  final,  the  question  could  not  be<br \/>\nreagitated  through  mode of interlocutory  application\t for<br \/>\nclarification.\tIt was also noticed that the decision in Dr.<br \/>\nAsa Singh&#8217;s case had no applicability and Boota Singh&#8217;s case<br \/>\ncould not be decided in the same fashion as Dr.\t Asa Singh&#8217;s<br \/>\ncase  because  the challenge in the appeal was to  the\tmain<br \/>\njudgment  of  the High Court and not to any order passed  on<br \/>\nclarification application.\n<\/p>\n<p>      In  Boota Singh&#8217;s case it has also been held that\t the<br \/>\nbenefit\t conferred by the notification dated 9th July,\t1985<br \/>\ncan be claimed by those who retire after the date stipulated<br \/>\nin  the notification and those who have retired prior to the<br \/>\nstipulated   date  in  the   notification  are\tgoverned  by<br \/>\ndifferent  rules.  They are governed by the old rules, i.e.,<br \/>\nthe  rules prevalent at the time when they retire.  The\t two<br \/>\ncategories  of\tpersons\t are governed by different  sets  of<br \/>\nrules.\t They  cannot be equated.  The grant  of  additional<br \/>\nbenefit has financial implications and the specific date for<br \/>\nthe  conferment of additional benefits cannot be  considered<br \/>\narbitrary.   It\t was  further held that:  &#8220;In  the  case  of<br \/>\nIndian Ex-Services League &amp; Ors.  Vs.  Union of India &amp; Ors.<br \/>\nEtc.   reported in (1991(1) SCR(158)this Court distinguished<br \/>\nthe decision in Nakara&#8217;s case (supra)and held that the ambit<br \/>\nof  that  decision cannot be enlarged to cover all claim  by<br \/>\nretirees  or a demand for an identical amount of pension  to<br \/>\nevery  retiree, irrespective of the date of retirement\teven<br \/>\nthough\tthe  emoluments\t for the purpose of  computation  of<br \/>\npension\t be  different.\t We need not cite  other  subsequent<br \/>\ndecisions   which   have     also   distinguished   Nakara&#8217;s<br \/>\ncase(supra).   The  latest decision is in the case  of\tK.L.<br \/>\nRathee Vs.  Union of India &amp; Ors.  (1997(4) Scale 384) where<br \/>\nthis  Court,  after referring to various judgments  of\tthis<br \/>\nCourt,\thas held that Nakara&#8217;s case cannot be interpreted to<br \/>\nmean that emoluments of persons who retired after a notified<br \/>\ndate  holding  the  same status, must be treated to  be\t the<br \/>\nsame.\tThe  respondents are not entitled to claim  benefits<br \/>\nwhich  became  available  at a much later date\tto  retiring<br \/>\nemployees  by  reason  of changes in the rules\trelating  to<br \/>\npensionary benefits.&#8221;\n<\/p>\n<p>      The  controversy\tinvolved in the present\t appeal\t and<br \/>\nconnected  appeals  is\tsquarely covered  by  the  aforesaid<br \/>\ndecision.   The\t respondents are thus not entitled to  claim<br \/>\nbenefits  under the notification dated 9th July, 1985  since<br \/>\nthe  said benefits became available on a much later date  to<br \/>\nthe retiring employees by reason of change in rules relating<br \/>\nto  pensionary benefits.  In this view, the judgment of\t the<br \/>\nHigh Court cannot be sustained.\n<\/p>\n<p>      Before  parting,\twe place on record our deep  anguish<br \/>\nfor  the unavoidable litigation in this Court in the form of<br \/>\nthe  present  appeals  at  the\tinstance  of  the  State  of<br \/>\nPunjab\/appellants.   The decision in Boota Singh&#8217;s case\t had<br \/>\nbeen  rendered\tmore than a year earlier than  the  impugned<br \/>\njudgment  of the High Court.  It is a matter of regret\tthat<br \/>\nBoota  Singh&#8217;s decision was not brought to the notice of the<br \/>\nHigh Court with the result that the High Court, on the basis<br \/>\nof  Dr.\t Asa Singh&#8217;s case, allowed the writ petitions.\t The<br \/>\nexplanation that Boota Singh&#8217;s decision was not reported and<br \/>\nit  could  not be brought to the notice of the counsel\tand,<br \/>\ntherefore, could not be cited before the High Court, shows a<br \/>\ntotal  casual approach particularly when the State of Punjab<br \/>\nitself\twas  the  appellant in the said case.\tSuch  casual<br \/>\napproach results in unnecessary litigation and waste of time<br \/>\nbesides incurring of unnecessary expense and waste of public<br \/>\nmoney.\t We can only express a hope that in future litigants<br \/>\nsuch as State Governments would be more careful.\n<\/p>\n<p>      For  the aforesaid reasons, we allow the appeals,\t set<br \/>\naside  the  judgment of the High Court and dismiss the\twrit<br \/>\npetitions.
