Justice V.RAMKUMAR\n\n Dated :24\/09\/2010\n\n O R D E R\n                     V.RAMKUMAR, J.\n          ----------------------------------------------\n           Bail Application No.5735 of 2010\n         ------------------------------------------------\n      Dated this the 24th day of September, 2010\n\n                            ORDER\n<\/pre>\n<p>     In this petition filed under Section 438 Cr.P.C. the<\/p>\n<p>petitioner who is the sole accused in Crime No.820\/2010<\/p>\n<p>of Kunnikode Police Station for an offence punishable<\/p>\n<p>under Section 55(a) &amp; (i) of the Kerala Abkari Act for<\/p>\n<p>allegedly having been found in possession of 2.8 litres of<\/p>\n<p>Indian Made Foreign Liquor, seeks anticipatory Bail.<\/p>\n<p>     2.   The learned Public Prosecutor opposed the<\/p>\n<p>application.\n<\/p>\n<p>     3.   Anticipatory bail cannot be granted in a case<\/p>\n<p>involving such grave offence. It is too early to accept the<\/p>\n<p>petitioner&#8217;s contention that the petitioner has been falsely<\/p>\n<p>implicated. There is no reason why the petitioner should<\/p>\n<p>not surrender before the magistrate concerned and seek<\/p>\n<p>regular bail.   Accordingly, If the petitioner surrenders<\/p>\n<p>before the Magistrate concerned within two weeks from<\/p>\n<p>today and files an application for regular bail, the same<\/p>\n<p>Bail Appln.No.5735\/2010<br \/>\n<span class=\"hidden_text\">                            : 2 :<\/span><\/p>\n<p>shall be considered and disposed of preferably on the<\/p>\n<p>same day on which it is filed bearing in mind the decision<\/p>\n<p>in <a href=\"\/doc\/1158859\/\">Sukumari v.
