ORAL JUDGEMENT\n<\/p>\n
     1.Commissioner   of   Police,    Ahmedabad    City,
\n     Ahmedabad, passed an order on May 5, 2001, in exercise of
\n     powers under Section 3(1) of the Gujarat Prevention of
\n     Anti-Social Activities Act, 1985 (“PASA Act” for short),
\n     detaining the petitioner under the provisions of the said
\n Act.\n<\/p>\n
2.The detaining authority took into consideration
\nthree offences registered against the petitioner, so also
\nthe statements of two anonymous witnesses. The detaining
\nauthority considered the activities of the detenu as that
\nof a dangerous person as defined under the PASA Act and
\nobserved that the petitioner      is   required   to   be
\nimmediately prevented from pursuing his activities, which
\nare detrimental to public order.       The authority also
\nconsidered the possibility of resorting to less drastic
\nremedies and came to conclusion that detention under PASA
\nAct is the only remedy that can be resorted to.\n<\/p>\n
3.The petitioner challenges the order of detention
\non various   grounds.      Mr.Shukla,   learned advocate
\nappearing for Mr. Anil Dave, learned advocate for the
\npetitioner, has restricted his arguments to the ground
\nthat there is improper exercise of powers under Section
\n9(2) of the PASA Act.      He has drawn attention of this
\nCourt to the fact that the statements of anonymous
\nwitnesses   were verified on 1.5.2001 and the order
\ndetention was passed on 2.5.2001.        The   authority,
\ntherefore, had no time to undertake the exercise of
\nverifying the correctness and genuineness of the fear
\nexpressed by the witnesses qua the detenu. Mr. Shukla
\nsubmitted further that the offences registered against
\nthe detenu are of 1999 and 2000 and, therefore, there is
\nno livelink between the offences registered against the
\npetitioner and the order of detention. He, therefore,
\nurged that the petition may be allowed.\n<\/p>\n
4.Mr. Patel, learned Assistant Government Pleader,
\nhas opposed this petition.\n<\/p>\n
5.Considering rival side contentions, it appears
\nthat the statements of anonymous witnesses have been
\nrecorded on April 30, 2001. The same have been verified
\nby the detaining authority on May 1, 2001 and the order
\nis passed on May 2, 2001. So far as the statements of
\nanonymous witnesses are concerned, it may be noted that
\nthe detaining authority has observed that the fear
\nexpressed by the witnesses and the statements and the
\nstatements are correct and genuine.        Barring   this
\nstatement in the grounds of detention, there appears
\nnothing to indicate an exercise having been undertaken by
\nthe detaining authority for verifying correctness and
\ngenuineness of the statements and the fear expressed by
\nthe witnesses. The detaining authority has to take into
\nconsideration   the   background, the antecedents, the
\ncharacter, etc. of the detenu while considering the need
\n for exercise of powers under Section 9(2) of the PASA
\nAct.   The authority has to scale the right of the detenu
\nof making an effective representation on the one hand and
\nthe public interest on the other and has to strike a
\nbalance between the two. The detaining authority has not
\nfiled any affidavit nor is there any contemporaneous
\nmaterial to indicate undertaking of such exercise by the
\ndetaining authority and, therefore, the exercise of
\npowers under Section 9(2) of the PASA Act can be taken to
\nhave vitiated. No reliance, therefore, can be placed on
\nthese statements for sustaining the order of detention.
\nThere is improper exercise of powers under Section 9(2),
\nas there is no material to indicate the exercise as
\nstated above (Bai Amina v. State of Gujarat & Ors.,<\/a> 1981
\nGLR 1186 and Kalidas Chandubhai Kahar v.        State of
\nGujarat & Ors.,<\/a> 1993(2) GLR 1659).\n<\/p>\n
6.Adverting to the offences registered against the
\ndetenu, they relate to the year        1999   and   2000.
\nTherefore, they are stale cases and there is no livelink
\nbetween the offences registered against the petitioner
\nand the order of detention. Therefore, the subjective
\nsatisfaction recorded by the authority for immediately
\npreventing the petitioner from pursuing his activities is
\nvitiated.\n<\/p>\n
7.Neither   the   statements   nor   the   offences
\nregistered against the petitioner form a valid ground for
\ndetention.   In this view of the matter, the petition
\ndeserves to be allowed.\n<\/p>\n
8.In the result, the petition is allowed.       The
\nimpugned order of detention dated May 2, 2001, passed
\nagainst the   detenu   is   hereby    quashed.       The
\ndetenu-Haidarkhan Lalkhan Pathan is ordered to be set at
\nliberty forthwith, if not required in any other matter.
\nRule is made absolute with no orders as to costs.\n<\/p>\n
