No.12516\/2010-L\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n             Dated this the 17th day of May, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The   petitioner  retired   from  the  service  of  the<\/p>\n<p>Corporation  as  Vehicle  Supervisor  on  31\/01\/2008.   The<\/p>\n<p>petitioner seeks for a direction to the first respondent to<\/p>\n<p>disburse the pensionery benefits as he has to discharge the<\/p>\n<p>liabilities to various banks\/societies.<\/p>\n<p>    2.   The third respondent is one of the Society to<\/p>\n<p>which the petitioner is indebted.     Counter affidavit has<\/p>\n<p>been filed by the third respondent.    It is submitted that<\/p>\n<p>an amount of Rs.84,536\/- is liable to be remitted by the<\/p>\n<p>petitioner to the third respondent and they are entitled to<\/p>\n<p>recover the entire amount from the pensionery benefits in<\/p>\n<p>view of the Undertaking, Agreement, Surety Bond, Consent<\/p>\n<p>Letters executed by the petitioner.\n<\/p>\n<p>    3.   Going by the averments in the writ petition, the<\/p>\n<p>petitioner owes certain amounts to the Kerala State Co-<\/p>\n<p>operative Bank also.  It is pointed out that certain loans<\/p>\n<p>were availed by the petitioner for conducting the marriage<\/p>\n<p>of the petitioner&#8217;s daughter.      Already award has been<\/p>\n<p>passed against the petitioner in the Arbitration Case filed<\/p>\n<p>by the said Co-operative Bank.\n<\/p>\n<p>W.P.(C). No.12516\/2010<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>     4.      Heard    the  learned    Standing  Counsel  for the<\/p>\n<p>Corporation.        The matter is governed by the guidelines<\/p>\n<p>issued     by    this   Court   in    W.A.No.289\/2001  permitting<\/p>\n<p>disbursement      of  pensionery   benefits   by considering  the<\/p>\n<p>genuine needs of the pensioners without looking into their<\/p>\n<p>seniority.       Herein, going by the averments in the writ<\/p>\n<p>petition and the counter affidavit filed by the third<\/p>\n<p>respondent, it is clear that he has got certain liabilities<\/p>\n<p>to be cleared.        Therefore, unless the pensionery benefits<\/p>\n<p>are disbursed, the arrears will be mounting making the<\/p>\n<p>petitioner liable for huge sum.\n<\/p>\n<p>     5.      In the light of the above, there will be a<\/p>\n<p>direction to the first respondent to quantify pensionery<\/p>\n<p>benefits due to the petitioner.          The petitioner will show<\/p>\n<p>the   details      of   liabilities    as  on   today  by  filing<\/p>\n<p>appropriate       consent  letter     to  the  first  respondent-<\/p>\n<p>Corporation for recovering those amounts for payment to the<\/p>\n<p>creditors.      After recovery of those amounts, the balance<\/p>\n<p>amount, if any, will be paid to the petitioner within a<\/p>\n<p>period of three months from the date of receipt of a copy<\/p>\n<p>of this Judgment.\n<\/p>\n<p>     The writ petition is disposed of as above.
