\tThis
\nis the second round of litigation. The petitioner has come before
\nthis Court praying that,<\/p>\n
 8(a)\tYour
\nLordships may be pleased to pass appropriate orders and\/ or direction
\nby exercising powers under s.482 of the Code of Criminal Procedure
\nquashing and setting aside the charge sheet filed in the trial court
\nagainst the petitioner in the criminal case registered as no.(I) 430
\nof 2003 on 3.12.2003 in the Anand Town Police Station, after
\ndeclaring the complaint as well as proceeding undertaken in form of
\nfiling charge sheet against the petitioner as illegal and clear abuse
\nof process of law.\n<\/p>\n
Earlier,
\nthe petitioner had approached this Court by filing Criminal Misc.
\nApplication No.1409 of 2004 which was disposed of by this Court
\n(Coram: Hon’ble Mr.Justice P.B. Majmudar) by order dated 5th
\nDecember 2005, which reads as under:\n<\/p>\n
 By filing
\nthis application, the applicant has prayed that FIR being C.R.No. (I)
\n430 of 2003 registered before Anand Town Police Station be quashed
\nand set aside, as the applicant, who himself has brought to the
\nnotice of the society the irregularities going on is unfortunately
\ntried to be booked as an accused.\n<\/p>\n
Mr.Patel,
\nlearned advocate for the applicant submitted that during the pendency
\nof this application charge sheet is filed. Therefore, he submitted
\nthat he may be permitted to amend the application by placing
\nappropriate material and also by amending the prayer.\n<\/p>\n
In my view,
\nsince charge sheet is filed, the original prayer has become
\ninfructuous. Under the circumstances, instead of granting amendment
\nthe appropriate course available to the applicant is either to apply
\nfor discharge or to file appropriate application calling in question
\nthe proceedings pending before the Court.\n<\/p>\n
In order to
\ntake appropriate remedy as pointed above, Mr.Patel, learned advocate
\nfor the applicant wants permission to withdraw this application.\n<\/p>\n
Permission is
\ngranted with a liberty as prayed herein above.  Accordingly, this
\napplication is disposed of as withdrawn. Notice is discharged.\n<\/p>\n
2.\tHeard
\nlearned advocate Mr.Patel for the petitioner.  Mr.Patel invited
\nattention of the Court to a letter dated 23rd May 2001,
\nwhich is produced at Annexure ‘B’.  It is addressed to one Shri
\nPrabhudas, described as Chairman, Sarvodaya Cooperative Credit
\nSociety Limited, Anand by the petitioner.  In the letter it is
\nmentioned that when the said Chairman was away from India for a
\nperiod of one month and 21 days, the petitioner was required to
\nshoulder the responsibility of managing the society (Sarvodaya
\nCooperative Credit Society Limited, Anand). The letter refers to
\nvarious difficulties, faced by the petitioner and also the
\nirregularities noticed by him while managing the society.\n<\/p>\n
It
\nis surprising that the petitioner complained to the person, who
\naccording to him is responsible for those irregularities.  The
\ncomplaint ought to have been made, to the appropriate authority,
\nabout the irregularities noticed by the petitioner.\n<\/p>\n
It
\nis the case of the petitioner that once the petitioner pointed out
\nthose irregularities to the Chairman, the petitioner was removed from
\nthe membership of the Executive Committee of the said society and he
\nwas kept out of the management of the said society.  It is also the
\ncase of the petitioner that all the irregularities which are
\nmentioned in the F.I.R. are pertaining to the period, subsequent to
\nhis removal as a member of the Executive Committee and he was kept
\nout, from the management of the society.\n<\/p>\n
3.\tIt
\nis a settled position of law that the High Court is not supposed to
\ngo into the questions which go to the merit of the matter while
\nconsidering an application under sec.482 of the Code of Criminal
\nProcedure. The present application is filed taking shelter of the
\nobservations made by this  Court in its order dated 5th
\nDecember 2005 that, <\/p>\n
  ..\t..\tthe
\nappropriate course available to the applicant is either to apply for
\ndischarge or to file appropriate application calling in question the
\nproceedings pending before the Court.\n<\/p>\n
Taking
\ninto consideration the submissions made by the learned advocate for
\nthe petitioner that he has got 100% case on merits, this Court is of
\nthe  opinion that the petitioner ought to have chosen the case of
\nfiling discharge application before the Court which could have looked
\ninto the matter in detail along with perusal of the documentary
\nevidence in support of the contention raised by the petitioner.\n<\/p>\n
4.\tHeard
\nlearned Additional Public Prosecutor, Mr.Sejpal appearing for
\nrespondents no.1 and 2.  The learned APP invited attention of the
\nCourt to the contents of the affidavit in reply filed on behalf of
\nrespondent no.2 (Office of the District Registrar, Cooperative
\nSocieties, Anand) paras 11, 12 in particular and also other relevant
\nparas.\n<\/p>\n
The
\nCourt restrains itself from going into the merits of the matter, as
\nit may prejudice the case of the petitioner, when he approaches the
\ncourt below.\n<\/p>\n
In
\nview of the aforesaid observations this Court finds no merit for
\ngranting any relief in this matter. The application is, therefore,
\ndismissed. Rule is discharged.\n<\/p>\n
At
\nthe request of the learned advocate for the petitioner it is
\nclarified that non entertainment of this application will not
\nprejudice the  petitioner in filing discharge application and
\npointing out all relevant material which is placed before this Court
\nin this proceeding at the time of consideration of the matter on
\nmerits by the learned Judge.\n<\/p>\n
