NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition has been filed against the<br \/>\njudgment of  the Kerala High Court, made on November 7, 1996<br \/>\nin writ Appeal No.850\/1996.\n<\/p>\n<p>     Admittedly, the petitioner and her husband were charged<br \/>\nfor an offence under Section 302 and also Section 201 I.P.C.<br \/>\netc. While  the husband of the petitioner was convicted, she<br \/>\nwas acquitted  of the  offences under  Sections 301 and also<br \/>\n201, getting her the benefit of doubt. Consequently, she was<br \/>\nreinstated into\t service but   back wages were denied, after<br \/>\nconducting the\tenquiry under  Kerala Service Rules. Rule 57<br \/>\nof the Rules provides that:\n<\/p>\n<blockquote><p>     &#8220;An  Officer  who\tis  detained  in<br \/>\n     custody,  whether\t on  a\tcriminal<br \/>\n     charge or\totherwise, for\ta period<br \/>\n     exceeding fortyeight  hours, or  is<br \/>\n     undergoing imprisonment,  shall  be<br \/>\n     deemed to\tbe under suspension with<br \/>\n     effect    from    the    date    of<br \/>\n     commencement of  the  detention  or<br \/>\n     imprisonment, as  the case\t may be,<br \/>\n     and shall\tnot be\tallowed to  draw<br \/>\n     any pay  and allowances during such<br \/>\n     period of suspension other than any<br \/>\n     subsistence  allowance   and  other<br \/>\n     allowances that  may be  granted in<br \/>\n     accordance with  Rule 55,\tuntil he<br \/>\n     is reinstated in service.&#8221;<br \/>\n     Rule 56 of the Rules provides thus:<br \/>\n     &#8220;(1) When\tan officer  who has been<br \/>\n     dismissed,\t removed  or  compulsory<br \/>\n     retired including\tan  officer  who<br \/>\n     has been  compulsory retired  under<br \/>\n     rule 60A, is reinstated a result of<br \/>\n     appeal or review or would have been<br \/>\n     so\t  reinstated,\t but   for   his<br \/>\n     retirement on  superannuation while<br \/>\n     under  suspension\t or   not,   the<br \/>\n     authority\t competent    to   order<br \/>\n     reinstatement  shall  consider  and<br \/>\n     make a specific order:\n<\/p><\/blockquote>\n<blockquote><p>     (a)   regarding\tthe   pay    and<br \/>\n     allowances\t to   be  paid\t to  the<br \/>\n     officer  for   the\t period\t of  his<br \/>\n     absence  from  duty  including  the<br \/>\n     period of\tsuspension preceding his<br \/>\n     dismissal, removal,  or  compulsory<br \/>\n     retirement, as the case may be,\n<\/p><\/blockquote>\n<blockquote><p>     (b) whether  or not the said period<br \/>\n     shall be  treated as a period spent<br \/>\n     on duty.&#8221;<\/p><\/blockquote>\n<p>     A reading\tthereof would clearly indicate that where an<br \/>\nofficer has  been kept\tunder suspension,  on account of the<br \/>\npendency of the charges\/detention for 48 hours and continued<br \/>\nto remain under suspension pending the trial of the criminal<br \/>\ncharge, statutorily  he\/she is\tdisabled    to\tperform\t the<br \/>\nduties of  the post.  On reinstatement\tunder Rule  56,\t the<br \/>\ncompetent authority  shall have\t a duty to consider whether,<br \/>\non reinstatement, suspended officer would be untitled to the<br \/>\npayment of  full pay  etc. for the period of his suspension.<br \/>\nThe mandate  of Rule  56 is   the competent authority should<br \/>\nconsider the  case in accordance with the rules and pall the<br \/>\norder. The  nature of  the order  is discretionary depending<br \/>\nupon the  facts in  the case.  It is seen that on account of<br \/>\nthe involvement\t of the\t petitioner in\ta criminal charge by<br \/>\nstatutory operation,  she was  under suspension till she was<br \/>\nacquitted.  On\t acquittal,  the  departmental\tenquiry\t was<br \/>\nconducted as  to the  nature of\t the order  to be made under<br \/>\nRule 56.  Accordingly, the  authority,\tin  its\t discretion,<br \/>\nfound that  the payment\t of the\t salary during the period of<br \/>\nsuspension except  suspension allowance\t already paid, could<br \/>\nnot be granted. It being in accordance with the Rules, we do<br \/>\nnot think  that the  High  Court  has  committed  any  error<br \/>\nwarranting interference.\n<\/p>\n<p>     The special leave petition is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Smt.
