Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            CRL.M.C.No. 2763      OF 2009\n            ===========================\n\n    Dated this the 29th day of September,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner is the accused in C.P.No.146\/2006 on<\/p>\n<p>the file of Judicial First Class Magistrate Court,<\/p>\n<p>Karunagappally.  Petition is filed under section 482 of<\/p>\n<p>Code of Criminal Procedure to quash Annexure A1 final<\/p>\n<p>report taken cognizance by the learned Magistrate for<\/p>\n<p>the  offence   under  section   55(g)  of   Abkari  Act<\/p>\n<p>contending that he is a senior citizen aged 75 years<\/p>\n<p>and the final report is filed after a lapse of four<\/p>\n<p>years to wreck     vengeance and the report of the<\/p>\n<p>chemical analysis is dated 12.4.2006 after a lapse of<\/p>\n<p>one year and in such circumstance it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<p>    2.   Learned counsel appearing for the petitioner<\/p>\n<p>and the learned Public Prosecutor were heard.<\/p>\n<p>    3.    Learned counsel argued that the house from<\/p>\n<p>which the liquor was seized does not belong to the<\/p>\n<p>petitioner and the report of chemical analysis was<\/p>\n<p>obtained after a lapse of one year from the date of<\/p>\n<p>seizure and in such circumstance the case is to be<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2763\/2009              2<\/span><\/p>\n<p>quashed.\n<\/p>\n<p>      4.   The fact that the petitioner is a senior citizen is<\/p>\n<p>not a ground to quash the offence.      There is no exception<\/p>\n<p>for a senior citizen in committing an offence under the<\/p>\n<p>Abkari Act or under Indian Penal Code.      The fact that the<\/p>\n<p>report of chemical analyst       received after examination,<\/p>\n<p>one year from the date of seizure    is not a ground to quash<\/p>\n<p>the proceedings.    The question whether the house from where<\/p>\n<p>the seizure was affected belongs to the petitioner or was<\/p>\n<p>in his possession, is a matter for evidence and cannot be<\/p>\n<p>decided in this petition.     Petitioner is entitled to raise<\/p>\n<p>all the contentions before the Sessions Court once the case<\/p>\n<p>is committed to that court. Petition can only be dismissed.<\/p>\n<p>      5.    Learned counsel appearing for the petitioner then<\/p>\n<p>submitted that there may be a direction to consider the<\/p>\n<p>application for bail on the date of surrender.          If an<\/p>\n<p>accused    surrenders  and  files  an  application  for  bail,<\/p>\n<p>Magistrate is expected to pass orders in the application<\/p>\n<p>without delay.      I find no reason to believe that the<\/p>\n<p>Magistrate is unaware of the provisions of law or the<\/p>\n<p>decisions     of  this Court  or   the  Apex  Court  or   that<\/p>\n<p>Magistrate will not act in accordance with law.
