Heard    Smt.        Mahasweta        Chatterjee,          the<\/p>\n<p>                      learned counsel appearing for the petitioner who<\/p>\n<p>                      is     in     custody       since        11.12.2010        under        the<\/p>\n<p>                      allegation       that        he        clapped     and     thereafter<\/p>\n<p>                      disseminated          some powdery substance which went<\/p>\n<p>                      into   the     eyes   of     the       informant    when       the    other<\/p>\n<p>                      culprit snatched his bag containing Rs. 86,200\/-<\/p>\n<p>                      to run away. That accused was not apprehended but<\/p>\n<p>                      the present petitioner was apprehended and handed<\/p>\n<p>                      over to the police.\n<\/p>\n<p>                                   The contention is that the petitioner was<\/p>\n<p>                      merely in the shop to make his personal purchases<\/p>\n<p>                      and    had    nothing       to     do    with    the     man    who     had<\/p>\n<p>                      committed the real act.\n<\/p>\n<p>                                   Considering         the    fact     that    nothing       was<\/p>\n<p>                      recovered from the petitioner and also considering<\/p>\n<p>                      his defence, let the above named petitioner be<\/p>\n<p>                      released       from     custody         on   furnishing         bond     of<\/p>\n<p>                      Rs.10,000\/-(ten thousand) with two sureties of the<\/p>\n<p>                      like    amount       each    to        the   satisfaction        of    Sub<\/p>\n<p>                      Divisional Judicial Magistrate, Pupri at Sitamarhi<\/p>\n<p>                      in Pupri P.S.Case No.217 of 2010.\n<\/p>\n<\/p>\n<pre>B.Kr.
