     The petitioner is a Reader in the Vaidyaratna Ayurveda<\/p>\n
College, the 2nd respondent herein, which is a college affiliated<\/p>\n
to the University of Calicut.     The petitioner was formerly<\/p>\n
working as a Reader in the Salyasalakia department of the<\/p>\n
college. By Ext.P1 order the Government sanctioned two posts<\/p>\n
of Professors in Samhita & Sidhantha Department and another<\/p>\n
in Swasthavritha Department of the college. According to the<\/p>\n
petitioner, perceiving better opportunity for promotion as<\/p>\n
Professor in Samhita & Sidhantha Department he opted to be<\/p>\n
shifted to the Samhita and Sidhantha department, which option<\/p>\n
was accepted by the management, by Ext.P2 order dated<\/p>\n
10.4.2000. From then on the petitioner has been working as<\/p>\n
Reader in Samhita and Sidhantha department. According to<\/p>\n
the petitioner, the post of Professor in Samhita and Sidhantha<\/p>\n
department sanctioned as per Ext.P1 order was never filled up.<\/p>\n
In spite of the repeated representations by the petitioner, the<\/p>\n
petitioner was not given promotion although the petitioner was<\/p>\n
fully qualified for such promotion. Therefore the petitioner<\/p>\n
O.P.No.29637 of 2001               – 2 –<\/span><\/p>\n
filed Ext.P6 representation before the Secretary to the<\/p>\n
Government of Kerala. In answer to that representation by<\/p>\n
Ext.P7, the petitioner was informed that the petitioner’s<\/p>\n
request was rejected as there is no post of Professor vacant in<\/p>\n
the   Samhitha       and   Sidhantha      department     in the  2nd<\/p>\n
respondent’s college. The petitioner is challenging Ext.P7<\/p>\n
order. The contention of the petitioner is that the statement in<\/p>\n
Ext.P7 that there is no vacancy is clearly wrong in view of<\/p>\n
Ext.P1 order.     The petitioner therefore seeks the following<\/p>\n
reliefs:\n<\/p>\n
           “a) To call for the records leading upto Exhibit P7
\n      and quash the same by the issuance of a Writ of Certiorari
\n      or any other appropriate writ, order or direction.\n<\/p><\/blockquote>\n
           b) To issue a Writ of Mandamus commanding the
\n      respondents to immediately promote the petitioner to the
\n      post of Professor in Samhitha & Sidhantha in the college of
\n      the second respondent in the existing vacancy of professor,
\n      which is unfilled and lying vacant.”<\/p><\/blockquote>\n
     2. The 2nd respondent and the additional 3rd respondent<\/p>\n
have filed counter affidavits controverting the averments in the<\/p>\n
original petition. According to them, the post of professor in<\/p>\n
Samhitha & Sidhantha department sanctioned as per Ext.P1<\/p>\n
was filled up by promoting the additional 3rd respondent as per<\/p>\n
Ext.R3A order dated 1.2.1999, which was approved by the<\/p>\n
University. Subsequently in tune with the directions of the<\/p>\n
Central Council of Indian Medicine the 2nd respondent decided<\/p>\n
O.P.No.29637 of 2001           – 3 –<\/span><\/p>\n
to introduce 13 department system instead of the 7 department<\/p>\n
system prevailing in the college. On introduction of the 13<\/p>\n
department system, options were called for from all the<\/p>\n
employees for choosing department of their choice if eligible.<\/p>\n
It is pursuant there to that the petitioner opted for Samhitha &<\/p>\n
Sidhantha department. At the same time the additional 3rd<\/p>\n
respondent, who had be promoted to the post of Professor of<\/p>\n
Samhitha & Sidhantha department sanctioned as per Ext.P1,<\/p>\n
opted to be shifted to Prasoothitantra department as Professor<\/p>\n
which was sanctioned by the college.      However, later on, the<\/p>\n
Government canceled the introduction of 13 department<\/p>\n
system in the college, since the same was without sanction<\/p>\n
from the Government. Therefore legally the 3rd respondent<\/p>\n
now continues only as Professor of Samhitha & Sidhantha<\/p>\n
department, is the contention raised. As such at present there<\/p>\n
is no vacancy of Professor in Samhitha & Sidhantha<\/p>\n
department.      According to them, as and when the 13<\/p>\n
department system is approved for the college, then if the 3rd<\/p>\n
respondent opts for Prasoothithantra department and 6 more<\/p>\n
posts of Professors are sanctioned, the petitioner can aspire for<\/p>\n
promotion to the post of Professor of Samhitha & Sidhantha<\/p>\n
department is the contention raised.\n<\/p>\n
O.P.No.29637 of 2001          – 4 –<\/span><\/p>\n
     3. I have considered the rival contentions in detail.<\/p>\n
     4.   Admittedly as on today, legally the 7 department<\/p>\n
system is the one prevailing in the 2nd respondent college and<\/p>\n
there are only seven sanctioned posts of Professors. One of the<\/p>\n
sanctioned post is Professor of Samhitha & Sidhantha<\/p>\n
department. That post is occupied by the 3rd respondent. The<\/p>\n
petitioner has no case that the petitioner is entitled to be<\/p>\n
promoted as Professor in preference to the additional 3rd<\/p>\n
respondent. The additional 3rd respondent is presently holding<\/p>\n
the post of Professor of Samhitha & Sidhantha. Since there is<\/p>\n
only one post of Professor of Samhitha & Sidhantha, the<\/p>\n
petitioner cannot aspire to be Professor of Samhitha &<\/p>\n
Sidhantha department. As pointed out by the counsel for the<\/p>\n
respondents 2 and 3 as and when 13 department system is<\/p>\n
approved for the college and additional posts of professor are<\/p>\n
sanctioned for each department, the petitioner can aspire for<\/p>\n
further promotion as Professor. In the above circumstances, I<\/p>\n
do not find any merit in this original petition and accordingly,<\/p>\n
the same is dismissed.\n<\/p>\n<\/p>\n
