SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 5691 of 2009\n                ------------------------------------\n             Dated this the 9th day of February, 2010\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos.1 to 3 in Crime No.119\/2009 of Kolavallur Police Station.<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 324 and 427 read with Section 149 of<\/p>\n<p>the Indian Penal Code and Sections 3 and 5 of the Explosive<\/p>\n<p>Substances Act.\n<\/p>\n<p>     3.    When the Bail Application came up for hearing on<\/p>\n<p>8\/01\/2010, the following order was passed:<\/p>\n<blockquote><p>           &#8220;After having heard the learned counsel for the<\/p>\n<p>     petitioners and the learned Public Prosecutor, I am of<\/p>\n<p>     the view that before disposing of the Bail Application,<\/p>\n<p>     an opportunity should be given to the petitioners to<\/p>\n<p>     appear before the investigating officer. Accordingly,<\/p>\n<p>     there will be a direction to the petitioners to appear<\/p>\n<p>     before the investigating officer at 9 A.M. on 13th and<\/p>\n<p>     14th January, 2010.\n<\/p><\/blockquote>\n<blockquote><p>           Post on 19\/01\/2010.<\/p><\/blockquote>\n<p>           It is submitted by the learned Public Prosecutor<\/p>\n<p>     that the petitioners will not be arrested until further<\/p>\n<p>     orders in connection with Crime No.119 of 2009 of<\/p>\n<p>B.A. No. 5691\/ 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      Kolavallur Police Station, Kannur.\n<\/p>\n<p>             The petitioners shall produce copy of this order<\/p>\n<p>      before the investigating officer.&#8221;\n<\/p>\n<p>      4.    The second petitioner could not comply with that<\/p>\n<p>order. Later, on 25\/1\/2010, another order was passed, which<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>             &#8220;The petitioner herein (Shaji), who is the<\/p>\n<p>      second petitioner in the Bail Application, states that<\/p>\n<p>      he could not comply with the direction contained in<\/p>\n<p>      the order dated 8.1.2010 as he was suffering from<\/p>\n<p>      respiratory    infection.   Annexure    II    medical<\/p>\n<p>      certificate is produced in support of the contention.<\/p>\n<p>      The petition is accordingly allowed. The petitioner<\/p>\n<p>      shall appear before the investigating officer at 9<\/p>\n<p>      A.M on 1st and 2nd February, 2010. The petitioner<\/p>\n<p>      shall produce a copy of the order before the<\/p>\n<p>      investigating officer.\n<\/p><\/blockquote>\n<blockquote><p>            Post on 8th February, 2010.&#8221;<\/p><\/blockquote>\n<p>      5.     It is submitted by the learned counsel for the<\/p>\n<p>petitioners and the learned Public Prosecutor that the petitioners<\/p>\n<p>have complied with the directions contained in the orders dated<\/p>\n<p>8\/01\/2010 and 25\/01\/2010.\n<\/p>\n<p>      6.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>B.A. No. 5691\/ 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release<\/p>\n<p>them on bail on their executing bond for Rs.10,000\/- each with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioners      shall   report    before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioners   shall  appear     before    the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n             prosecution    witnesses or    tamper     with   the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                     K.T.
