By a notification dated\n\n10.8.1984,     the      Registrar,           Cooperative        Societies,\n\nRajasthan, while exercising powers under Rule 41 of\n\nthe    Rajasthan       Cooperative           Societies     Rules,          1966\n\n(hereinafter      referred     to       as    \"the   Rules      of    1966\")\n                                         2\n\nprescribed rules for selection\/promotion in all the\n\nCentral Cooperative Banks in State of Rajasthan. As\n\nper   Anx.\"A\"      to    the      notification           dated       10.8.1984       a\n\nBanking Assistant is having an avenue for promotion\n\nfor Group \"D\" grade to the extent of 60% under the\n\ncriteria    of     seniority-cum-merit               and       40%       by    way   of\n\nmerit     alone.       By     a   subsequent             notification            dated\n\n9.3.2005    the       Registrar,        Cooperative            Societies         while\n\nexercising       powers       under     Rule        39    of    the       Rajasthan\n\nCooperative           Societies         Rules,           2003        (hereinafter\n\nreferred to as \"the Rules of 2003\") prescribed a fresh\n\ncriteria for recruitment to the posts in Grade \"D\". As\n\nper the notification dated 9.3.2005 all the vacancies\n\nrelating to promotion in Group \"D\" are required to be\n\nfilled in as per the criteria of seniority only. The\n\nrespondent      Bank     convened         a    meeting         of    Departmental\n\nPromotion        Committee         on         27.11.2007            to        consider\n\ncandidature of eligible candidates for the purpose of\n\npromotion to the posts under \"D\" Grade from among the\n\nBanking      Assistants.            The        Departmental               Promotion\n\nCommittee accordingly met on 27.11.2007 and choose to\n\nrecommend names of eligible candidates for the purpose\n\nof promotion to \"D\" Grade posts as per the criteria\n\nprescribed       by     the    Registrar,           Cooperative           Societies\n\nunder the notification dated 9.3.2005. Pertinent to\n\nnote here that the vacancies sought to be filled in\n\nunder     the      recommendations              of        the        Departmental\n\nPromotion       Committee         which       met    on     27.11.2007            were\n\nrelating to the vacancy year of 2004-2005.\n                                            3\n\n\n\n               The    contention            of     the        petitioner             while\n\nchallenging          the         recommendations                  made         by     the\n\nDepartmental         Promotion         Committee            and    the    promotions\n\nmade    in     pursuant          thereto         is     that       the     vacancies\n\nrelating to the period prior to 9.3.2005 could have\n\nbeen filled in as per the criteria prescribed under\n\nthe    notification         dated         10.8.1984         only    and        not      in\n\naccordance      with       the      notification            dated     9.3.2005.         A\n\nreliance is placed by the petitioner upon a Registrar,\n\nCooperative Societies letter dated 7.6.2005 (Schedule-\n\nC with writ petition) clarifying that the vacancies\n\narising prior to 9.3.2005 should be filled in as per\n\nthe rules existing earlier.\n\n\n\n               In reply to the writ petition it is stated\n\non    behalf    of    the      Bank       that    the       rules     relating         to\n\npromotion      in     Group         \"D\"    from       the     cadre       of    Banking\n\nAssistants were made applicable on 9.3.2005 i.e. in\n\nthe    vacancy       year      of    2004-2005,          therefore,            all    the\n\nvacancies arising in the vacancy year of 2004-2005 are\n\nrightly      filled       in      as      per     the       rules     notified         on\n\n9.3.2005.\n\n\n\n               Heard counsel for the parties.\n\n\n\n               Precisely,           the    issue        for       adjudication         is\n\nthat    whether       the      vacancies          arising          even    prior       to\n\n9.3.2005     but     in     the      vacancy       year       of    2004-2005         are\n                                             4\n\nrightly filled in as per the criteria laid down by the\n\nRegistrar,             Cooperative              Societies            under         the\n\nnotification dated 9.3.2005?\n\n\n\n               The notification dated 10.8.1984 prescribing\n\nmode      of     recruitment          to    various          posts     in     Central\n\nCooperative Bank nowhere prescribes any specific date\n\nfor determination of yearwise vacancies, however, the\n\nnotification dated 9.3.2005 refers that all existing\n\nand anticipating vacancies required to be filled in by\n\nway of promotion or by way of direct recruitment are\n\nrequired to be computed on 31st of March of every year.\n\nIn   view      of    specific         provision         referred          above    i.e.\n\nclause      (3)     of    the    notification            dated       9.3.2005       the\n\nfirst occasion before the respondent Bank to determine\n\nexisting         and      anticipating           vacancies           as     per     the\n\nnotification           dated     9.3.2005         was    on     31.3.2005.          The\n\nvacancies relating to the year 2004-2005, therefore,\n\nin   no    way      could      have     been      determined          as     per    the\n\nnotification             dated        9.3.2005.         On     31.5.2005,           the\n\nrespondents            could      have          computed         existing           and\n\nanticipating           vacancies        relating        to     the     forthcoming\n\nyear      i.e.      2005-2006.         As       such,    the     vacancies          not\n\ndetermined          under      the     notification            dated        9.3.2005,\n\ntherefore, could have not been filled in under the\n\ncriteria laid down in the notification aforesaid. The\n\nvacancies relating               to    the year         2004-2005          must have\n\nbeen computed as per the provisions existing prior to\n\nthe notification dated 9.3.2005 and, therefore, those\n                                         5\n\nshould   have      been    filled       in    in    accordance          with      the\n\ncriteria then existing.\n\n\n\n            In     view    of    whatever          said      above,     I    am   of\n\nconsidered       opinion     that      the     Departmental             Promotion\n\nCommittee erroneously adopted the criteria prescribed\n\nunder the notification dated 9.3.2005 to fill in the\n\nvacancies     in     Group       \"D\"        from     among        the       Banking\n\nAssistants.      The      consideration           for     promotion         by    the\n\nDepartmental        Promotion           Committee            which       met      on\n\n27.11.2007 to consider candidature of eligible Banking\n\nAssistants       for      promotion          in         Group     \"D\"       cadre,\n\ntherefore, deserves to be declared bad.\n\n\n\n            Accordingly,          this        petition          for     writ      is\n\nallowed.    The     criteria          adopted       by    the     Departmental\n\nPromotion     Committee          which       met        on      27.11.2007        to\n\nconsider    candidature          of    the    Banking         Assistants          for\n\npromotion    in     Group       \"D\"    posts       is     declared      illegal.\n\nAccordingly, all orders of promotions made in pursuant\n\nthereto stand quashed. The respondent Bank is directed\n\nto hold a review Departmental Promotion Committee as\n\nper the criteria applicable for promotion to Group \"D\"\n\nposts from among the Banking Assistants as per the\n\nnotification dated 10.8.1984 (Schedule \"A\" to the writ\n\npetition).
