PUBLIC PROSECUTOR\nfor\nAppellant(s) : 1, \nMR SHAIVANG D MEHTA for Opponent(s) : 1, \nMR\nDHIRENDRA MEHTA for Opponent(s) : 2 -\n4. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/04\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(1)\tHeard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p>(2)\tThe<br \/>\nappellant, State of Gujarat has preferred this appeal under Section<br \/>\n378 of the Code of Criminal Procedure challenging the order of<br \/>\nacquittal dated 4th<br \/>\nSeptember, 2008 passed by the Learned Judicial Magistrate First<br \/>\nClass, Mangrol in Criminal Case No.742 of 1998 acquitting the<br \/>\noriginal accused-respondents hereinabove of the charge of committing<br \/>\noffence punishable under Section 16 of the Prevention of Food<br \/>\nAdulteration Act,1954 (hereinafter referred to as the  PFA Act<br \/>\nfor the sake of brevity)<\/p>\n<p>(3)\tThe<br \/>\noriginal complainant, Food Inspector while discharging his duties on<br \/>\n9.10.1997 visited the premises of the accused.  At that time, he<br \/>\nfound the owner of the shop sitting at the counter and doing his<br \/>\nbusiness.  One person was summoned as a witness to be a Panch<br \/>\nWitness. After introducing himself as such and after notifying his<br \/>\nintention to collect the sample food article namely Lotus Mango<br \/>\nPickles (Pack), purchased three bottles of 200 gms. each on payment<br \/>\nof Rs.45 and taken the receipt thereof.  The said Lotus Mango Pickles<br \/>\n(Pack) bottles contained label that it was Lotus Mango Pickles, in<br \/>\nedible oil FPO 1828<br \/>\nGujarat Food Products, Fidar Road, Bilimora-396 380 etc.  It did<br \/>\ncontain the ingredients used for preparing the Pickles, which is<br \/>\nnarrated by the Food Inspector in his complaint.  The bottles,<br \/>\nthereafter, were sealed in accordance with law and one part of the<br \/>\nsample food article was sent to the Public Analyst and the remaining<br \/>\ntwo parts were sent to the Local Health Authority.  The purchaser<br \/>\nnamely Gujarat Food Products, Bilimora was also informed with regard<br \/>\nto collection of the sample in Form No.6.  The purchase of Lotus<br \/>\nMango Pickles (Pack) from the purchaser was under the bill, which was<br \/>\nproduced as a Xerox copy.  The Gujarat Food Products was requested to<br \/>\ngive their constitution. As the food article was found to be<br \/>\nadulterated, requisite complaint  was filed after obtaining proper<br \/>\nsanction for lodging prosecution against the vendor as well as<br \/>\npurchaser.  The notice for filing complaint was sent to all the<br \/>\nconcern.  The accused appeared and requested for sending the sample<br \/>\nfor examination to Central Food Laboratory and accordingly the sample<br \/>\nwas sent to Central Food Laboratory, wherein it was opined to be not<br \/>\nin conformity with the standard laid down under the Prevention of<br \/>\nFood Adulteration Rules and hence declared<br \/>\nadulterated.  The Trial began and after recording evidence and<br \/>\nappreciating the same, the Court came to the conclusion that the<br \/>\nprosecution cannot be said to have been established its case beyond<br \/>\nreasonable doubts and hence acquitted the accused of the charge of<br \/>\ncommitting offence punishable under Section 16 of the  PFA Act<br \/>\nvide its order dated 4th<br \/>\nSeptember,2008, which is impugned in the present proceedings under<br \/>\nSection 378 of the Code of Criminal Procedure.\n<\/p>\n<p>(4)\tMs.\n<\/p>\n<p>C.M. Shah, Learned Additional Public Prosecutor contended that the<br \/>\nreport of the CFL being conclusive and as it is containing clear<br \/>\nopinion with regard to food article in question being adulterated,<br \/>\nthe Trial Court ought to have been appreciated these facts and<br \/>\nrecorded its finding accordingly.\n<\/p>\n<p>(5)\tShri<br \/>\nShaivang D. Mehta, learned advocate appearing for the respondents<br \/>\ncontended that the finding recorded by the Trial Court are based upon<br \/>\nthe material on record and unless it is shown to be otherwise the<br \/>\nCourt may not interfere with the same under Section 378 of the Code<br \/>\nof Criminal Procedure.\n<\/p>\n<p>(6)\tShri<br \/>\nShaivang D. Mehta, learned advocate appearing for the respondents<br \/>\nsubmitted that the Court has relied upon the decision of this Court<br \/>\nin case of State<br \/>\nof Gujarat Vs. Arjanbhai Somabhai Thakor &amp; Ors. reported in<br \/>\n2007(2)FAC 333<br \/>\nin respect of noncompliance of Rule 4 of the Prevention of Food<br \/>\nAdulteration Rules. In asmuchas the Exh.67, report of the CFL is<br \/>\neloquently clear in respect of the breach observed by the Court.  The<br \/>\nlearned Additional Public Prosecutor also could not controvert this<br \/>\nfact as this Court has also noticed from Exh.67 that the requisite<br \/>\ninformation does not get reflected in the report by CFL.  The<br \/>\nfollowing portion of the judgment of this Court in case of State<br \/>\nof Gujarat Vs. Arjanbhai Somabhai Thakor &amp; Ors. reported in<br \/>\n2007(2)FAC 333<br \/>\nis required to be set out, wherein it is held as under:-\n<\/p>\n<p>\t Para<br \/>\n<span class=\"hidden_text\">10 <\/span><\/p>\n<p>\t This<br \/>\nCourt has perused the record of the case \tand also heard the counsels<br \/>\nfor the parties at \tlength.  Shri Modi&#8217;s submission that<br \/>\nnon-\tcompliance<br \/>\nof Rule 4 of the Rules deserves to be \tconsidered and accepted.  From<br \/>\nthe record of the \tcase, it is clearly established that there is a<br \/>\n\tbreach of Rule 4 of the Rules, as it is on the \trecord that the<br \/>\nseals on sample container were \tintact.\n<\/p>\n<p> The seals on outer cover of sample \tparcel were also intact and<br \/>\ntallied with the \tspecimen impression of seal enclosed with copy \tof<br \/>\nmemorandum forwarded separately, however, it \tis not clearly<br \/>\nmentioned by the Director of \tCentral Food Laboratory that Court also<br \/>\napplied \tits seals on both the containers .\n<\/p>\n<p>\t Para-11 <\/p>\n<p>\t This<br \/>\nCourt has time and again observed that \tabsence of reference to Form<br \/>\nI in the report of \tDirector of Central Food Laboratory would cast<br \/>\n\tdoubt about the compliance.  In this case, it is \tconspicuously not<br \/>\nmentioned by the Director of \tCentral Food Laboratory as to whether<br \/>\nthere was \ta seal on the container.  It is a mandatory \tprovision<br \/>\nunder Rule-4, and therefore, it cannot \tbe said that it is complied<br \/>\nwith.\n<\/p>\n<p>\tThis<br \/>\nCourt in the case of State of Gujarat Vs. \tB.M. Mehta, reported in<br \/>\n1999(2) FAC 201: 1999(1) \tGLH 227, had a occasion to examine the<br \/>\nbreach of \tRule 4 and in that case, this Court has held \tthat it<br \/>\ncannot be said that there was compliance \twith Rule 4 in sending<br \/>\nsample by the Court to  \tthe CFL.  This Court in the case of State of<br \/>\n\tGujarat Vs. Gafurbhai Bhikhabhai Mansuri and \tOthers, reported in<br \/>\n2005(3) GLH 409, and in \tanother case of State of Gujarat Vs.<br \/>\nJayantibhai \tMaganbhai Patel in Criminal Appeal No.1037 of \t1992,<br \/>\ndecided on 29.8.2005 by this Court (Coram: \tS.R. Brahmbhatt,J.) has<br \/>\nheld that Rule 4 has not \tbeen complied with when the identical<br \/>\nwordings \twere employed by the Director of CFL in the \tcertificate.<br \/>\nIn the case of State of Gujarat \tVs. Gafurbhai Bhikhabhai Mansuri<br \/>\n(Supra) the \twordings of the Director of CFL at Exh.43 in \tthat case,<br \/>\nread as under:-\n<\/p>\n<p>\tThe<br \/>\nseals on sample container were intact and \ttallied with the specimen<br \/>\nimpression of seal \tgiven on copy of Form VII enclosed.  The seals<br \/>\n\ton outer cover of sample parcel were also intact \tand<br \/>\ntallied with the specimen impression of seal \tenclosed with copy of<br \/>\nmemorandum forwarded \tseparately.\n<\/p>\n<p>\tIt<br \/>\nis held that when such recording employed \tthere, it does not amount<br \/>\nto compliance with \tRule 4 as there is no reference with respect to<br \/>\n\tForm No.1.  In the instant case also the \taverment of Director of<br \/>\nCFL in respect of seal \tas it is stated hereinabove, deserves to be<br \/>\n\tviewed in its proper perspective.  The \tsame \tmay be set out as<br \/>\nunder:\n<\/p>\n<p>\tThe<br \/>\nseals on sample container were intact.  The \tseals on outer cover of<br \/>\nsample parcel were also \tintact and tallied with the specimen<br \/>\nimpression \tof seal enclosed with copy of memorandum \tforwarded<br \/>\nseparately.\n<\/p>\n<p>(7)\tIn<br \/>\nview of the aforesaid observation and bearing in mind the mentioning<br \/>\nby the CFL, in the instant case Exh.67 would go to show that the<br \/>\ncertificate did not reflect due compliance with Rule 4 and,<br \/>\ntherefore, the finding of acquittal in my view needs no interference<br \/>\nas no miscarriage of justice is even pleaded.
