NO. 21881 OF 2010 I\n             ------------------------------------------------------\n           Dated this the 3rd day of September, 2010\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The petitioner is Anglo Indian Association, Perumanoor,<\/p>\n<p>represented by its Secretary.         It is stated that C.C.P.L.M. Anglo<\/p>\n<p>Indian High School, Perumanoor is an aided school owned by the<\/p>\n<p>Union of Anglo Indian Association, Kerala. It is also stated that even<\/p>\n<p>though in the official records the School is managed by the fourth<\/p>\n<p>respondent, the day-to-day affairs of the School and its properties<\/p>\n<p>are being carried out by the petitioner and other executive members<\/p>\n<p>of the Association. It is also stated thus in paragraph 1 of the Writ<\/p>\n<p>Petition:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;The Union of Anglo Indian Association, Kerala is<\/p>\n<p>       registered (Reg.No.9\/53) under Act II of 1088 ME and<\/p>\n<p>       now replaced by the Travancore Cochin Literary,<\/p>\n<p>       Scientific and Charitable Societies Act 1955.                The<\/p>\n<p>       Central Board of Anglo Indian Education is another<\/p>\n<p>       registered Society of the Anglo Indian Community<\/p>\n<p>       specifically incorporated to manage the 11 schools of<\/p>\n<p>       the Community in the State. The President-in-Chief and<\/p>\n<p>W.P.(C) NO.21881 OF 2010<\/p>\n<p>                                   :: 2 ::\n<\/p><\/blockquote>\n<blockquote><p>      General Secretary of the Union of Anglo Indian<\/p>\n<p>      Associations Kerala, are ex officio members of this<\/p>\n<p>      Society. Other members include 6 members nominated<\/p>\n<p>      by the Governing Committee from among them,<\/p>\n<p>      Presidents of the Anglo Indian Associations approved by<\/p>\n<p>      the Union of Anglo Indian Associations, Kerala and<\/p>\n<p>      having an Anglo-Indian School in its jurisdiction, Local<\/p>\n<p>      Managers of the Schools, 3 Educational Experts, 6<\/p>\n<p>      Consultants, the nominated MP and MLA if approved by<\/p>\n<p>      the Board. As per the bye-laws of this Board, election of<\/p>\n<p>      the Chairman, and other office bearers and members of<\/p>\n<p>      the Administrative Committee has to be conducted every<\/p>\n<p>      year. But, from 2001 no election was conducted. This<\/p>\n<p>      issue has caused concern among the members of the<\/p>\n<p>      Union of Anglo Indian Associations, Kerala and the very<\/p>\n<p>      functioning of the Union of Anglo Indian Associations are<br \/>\n      seriously affected due to this. The 4th respondent herein<\/p>\n<p>      is also the President-in-Chief of the Union of Anglo<\/p>\n<p>      Indian Associations, Kerala.      Several litigations are<\/p>\n<p>      pending before the various courts in Ernakulam,<\/p>\n<p>      including before this Hon&#8217;ble Court with regard to the<\/p>\n<p>      functioning of the Union of Anglo Indian Associations,<br \/>\n      Kerala and the 4th respondent herein.&#8221;<\/p><\/blockquote>\n<p>      2. It is alleged that the office of the fourth respondent was<\/p>\n<p>functioning in one of the rooms belonging to the School, which was<\/p>\n<p>W.P.(C) NO.21881 OF 2010<\/p>\n<p>                                   :: 3 ::\n<\/p>\n<p>intended to be used as a class room. It is alleged that the class<\/p>\n<p>room was converted into an office room of the Anglo Indian<\/p>\n<p>Association, Kerala. It is also alleged that the functioning of the<\/p>\n<p>office became a nuisance to the functioning of the School. It would<\/p>\n<p>appear that unpleasant scenes took place in the premises of the<\/p>\n<p>School because of the fight between two factions.<\/p>\n<p>      3.    It would appear that the President of the petitioner<\/p>\n<p>Association    submitted   a  representation  before   the   District<\/p>\n<p>Educational Officer complaining about the functioning of the office of<\/p>\n<p>the Manager in the premises of the School. Ext.P4 order dated<\/p>\n<p>31.7.2008 was passed by the District Educational Officer directing<\/p>\n<p>the office to be removed from the School building. It would appear<\/p>\n<p>that Ext.P4 order was not obeyed. Later, the District Educational<\/p>\n<p>Officer passed Ext.P5 order dated 19.1.2009 directing the Chairman<\/p>\n<p>and Corporate Manager of Central Board of Anglo Indian Education<\/p>\n<p>to comply with the order.\n<\/p>\n<\/p>\n<p>      4. It is alleged that Exts.P4 and P5 orders were not obeyed.<\/p>\n<p>Ext.P6 representation was submitted by the &#8220;Local Manager&#8221; to the<\/p>\n<p>W.P.(C) NO.21881 OF 2010<\/p>\n<p>                                    :: 4 ::\n<\/p>\n<p>District Educational Officer, wherein it is stated as follows:<\/p>\n<blockquote><p>       &#8220;1. By your aforesaid letter, you directed that the office<\/p>\n<p>           of the Central Board of Anglo Indian Education now<br \/>\n           situated adjoining the 4th standard class inside the<\/p>\n<p>           school premises be shifted.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>       2. Despite your said directions, the concerned authority<\/p>\n<p>           has chosen to ignore the same.         As an authority<\/p>\n<p>           obliged to comply with your directions\/orders, we<\/p>\n<p>           hence wrote a letter dated 3.10.2008 to the Circle<\/p>\n<p>           Inspector of Police, South, Cochin City informing the<\/p>\n<p>           said officer that an additional lock and key is being<\/p>\n<p>           installed on the said office premises to prevent its<\/p>\n<p>           misuse.    However, the Chairman and the Board<\/p>\n<p>           members of the Central Board of Anglo Indian<\/p>\n<p>           Education    then   informed     us   that    they are<\/p>\n<p>           immediately shifting the said office premises.<\/p>\n<p>           Believing the same, we did not then fix the additional<\/p>\n<p>           lock and key to the said office premises.<\/p><\/blockquote>\n<p>       3. However the Chairman and others did not honour<\/p>\n<p>           their word, and continue to use the said premises<\/p>\n<p>           even now, violating your orders. Since I am obliged<\/p>\n<p>           to comply with your orders, I am hence forced to<\/p>\n<p>           install a new lock and key to the said office premises,<\/p>\n<p>           over and above the lock already existing, and I am<\/p>\n<p>W.P.(C) NO.21881 OF 2010<\/p>\n<p>                                     :: 5 ::\n<\/p>\n<p>          handing over a duplicate of the said key to Circle<\/p>\n<p>          Inspector of Police, Ernakulam South Police Station.&#8221;<\/p>\n<p>      5. The relief prayed for in the Writ Petition is to issue a writ of<\/p>\n<p>mandamus commanding the respondents to take effective steps to<\/p>\n<p>comply with the directions contained in Exts.P4 and P5 orders.<\/p>\n<p>      6.   The learned Government Pleader submitted, on written<\/p>\n<p>instructions, that the District Educational Officer visited the School on<\/p>\n<p>15.7.2010 and he has reported that the office of the Central Board of<\/p>\n<p>Anglo Indian Education, Perumanoor is not seen functioning in the<\/p>\n<p>premises of the School building. The learned Government Pleader<\/p>\n<p>also submitted that the Headmistress of the School has also certified<\/p>\n<p>the said fact in her letter dated 15.7.2010.<\/p>\n<p>      7. The submissions made by the learned Government Pleader<\/p>\n<p>are recorded. In the light of the submissions made by the learned<\/p>\n<p>Government Pleader, I do not think any further orders are required in<\/p>\n<p>the Writ Petition. It is to be taken that Exts.P4 and P5 orders have<\/p>\n<p>been complied with.
