As\n\nper the Rules of 2008 the eligibility to be considered\n\nfor   the    purpose       of    appointment           to     the     post   of\nPrabodhak is that the incumbent under consideration\n\nmust be having Senior Secondary School Certificate or\n\nIntermediate        or    its    equivalent            with    Diploma       or\n\nCertificate in basic teachers training of a duration\n\nof not less than two years of bachelors degree in\n\nelementary        education     or     graduation           with     bachelors\n\ndegree      in     education         with       five     years        teachers\n\nexperience.\n\n\n\n             The petitioners are having the qualification\n\nof Aacharya from Bhartiya Shiksha Samiti, Rajasthan,\n\nJaipur and they have also claimed to have experience\n                                        2\n\nof   five    years       teaching.         The   respondents         rejected\n\ncandidature of       the     petitioners by             not   treating the\n\nqualification of Aacharya possessed by the petitioners\n\nas equivalent to BSTC.\n\n\n\n             While challenging the same, it is contended\n\nby counsel for the petitioners that the Government of\n\nRajasthan     by     its    letter         dated       25.5.1995      (Anx.4)\n\ngranted recognition to the qualification of Aacharya\n\nas   equivalent       to     the     BSTC        and,     therefore,       the\n\nrejection     of     the    petitioners            candidature        is   not\n\ncorrect.\n\n\n\n             I do not find any substance in the argument\n\nadvanced.\n\n\n\n             Para 5 of the document Anx.4 dated 25.5.1995\n\nin   quite        unambiguous       terms         mentions          that   the\n\nrecognition       given     to   the       examination        concerned     is\n\nlimited     for    the     institutions          run    by    the    Bhartiya\n\nShiksha Samiti and that is having no application for\n\nthe institutions under the government and other non\n\ngovernment recognised institutions. In view of para 5\n\nof the letter dated 25.5.1995, it cannot be said that\n\nthe petitioners are having a qualification equivalent\n\nto the BSTC.\n\n\n\n             An     another        argument         advanced         by    the\n\npetitioners is that even if it is assumed that they\n                                    3\n\nare not having requisite training, then too they are\n\nrequired to be considered for appointment in view of\n\nthe     fact    that    the    respondents     at    their   own   are\n\nconsidering          candidature   of   the     persons      who    are\n\nundergoing NTT and yet have not acquired any other\n\nqualification equivalent to the BSTC.
