{"id":189289,"date":"2010-07-02T00:00:00","date_gmt":"2010-07-01T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/faren-singh-paraste-vs-the-state-of-madhya-pradesh-on-2-july-2010"},"modified":"2017-09-12T02:06:37","modified_gmt":"2017-09-11T20:36:37","slug":"faren-singh-paraste-vs-the-state-of-madhya-pradesh-on-2-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/faren-singh-paraste-vs-the-state-of-madhya-pradesh-on-2-july-2010","title":{"rendered":"Faren Singh Paraste vs The State Of Madhya Pradesh on 2 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Faren Singh Paraste vs The State Of Madhya Pradesh on 2 July, 2010<\/div>\n<pre>                                                               1\n\n\n                 Writ Petition No. 8292 \/ 2010\n02\/07\/2010:\n      Shri Sanjay Patel, learned counsel for the petitioner.\n\n      Shri Vivek Agrawal, learned Government Advocate\nfor the State.\n\n      Petitioner is working as Class-III on the post of\nWarden in Central Jail Jabalpur, District Jabalpur and by\nthe impugned order petitioner has been transferred from\nCentral Jail Jabalpur, to Sub Jail Budhar, District Rewa.\nInteralia contending that the seniority of the petitioner's\ncadre is maintained circle wise and petitioner if transferred\nout of the circle, it would adversely effect his right in\npromotion, challenge is made to the impugned action.\n\n2.    Placing reliance on a judgment of the Supreme Court\nin the case of Maharashtra State Electricity Board &amp;\nAnother Vs. Rama Rajaramji Wadekar &amp; Another,\n(2002) 10 Supreme Court Cases, 254, and certain interim\norders passed by a Bench of this Court in W.P.\nNo.12027\/09 on 18\/03\/2010 vide annexure P-3, petitioner\nsubmits that his transfer, which will have adverse effect on\nhis claim for promotion is unsustainable. Apart from the\naforesaid, another ground raised is that petitioner has given\noption for transfer to various other district and without\nconsidering the same, he has been transferred to Budhar.\n                                                               2\n\n\nApart from the aforesaid two grounds which was canvassed\nat the time of hearing certain personal inconveniences of\nthe petitioner in carrying out transfer are indicated in the\nbody of the petition.\n\n3.    Shri Vivek Agrawal, refutes the aforesaid and points\nout that the law laid down in the case of Maharashtra\nState Electricity Board (Supra) and interim order passed\nwill not help the petitioner for the simple reasons under the\nrecruitment rules namely the Prisons' Rules, 1984 has been\namended on 24\/03\/08 and by making the cadre a \"state\ncadre\" and nominating the Director General of Prisons as\nthe appointing authority, petitioner now came in the State\nCadre and, therefore, the ground raised by the petitioner in\nthis writ petition are not sustainable.\n\n4.    Shri Agrawal has produced a copy of notification\nissued by M.P. Government Home Department on\n24\/03\/08, amending Rules 200 and 211 of the Prisons'\nRules in the matter of appointment and promotion.\n\n5.    Keeping in view the objection raised by Shri\nAgrawal, which could not be refuted by learned counsel for\nthe petitioner the legal ground raised by the petitioner in\nthis writ petition is unsustainable. The principles in the case\nof Maharashtra Electricity Board (supra), which was\nbased on the statutory rules applicable to the State\nElectricity Board of Maharashtra cannot be applied when\n                                                            3\n\n\nthe Prisons' Rules applicable in the State of Madhya\nPradesh, provide for constitution of the State Cadre for\npromotion to the post in question and when the Director\nGeneral of Prison and Reforms is made the competent\nauthority.\n\n6.    Accordingly, finding no case for interference on these\ngrounds the objection is rejected. So far as the other\ngrounds are concerned, pertaining to non consideration of\npetitioner's option, on the aforesaid ground interference by\na writ court cannot be made. It is for respondents No.1 &amp; 2<\/pre>\n<p>to consider the aforesaid grievance of the petitioner.\n<\/p>\n<p>7.
