THE DISTRICT COMMMANDANT HOME GUARDS KATIHAR\n                                          ----------------------------------\n<\/pre>\n<p>02.   15.10.2011                    Heard learned counsel for the petitioners<\/p>\n<p>                         and the State.\n<\/p>\n<p>                                    2. Petitioners are the Homeguards. They<\/p>\n<p>                         have filed this writ petition for a direction to the State<\/p>\n<p>                         respondents to regularize their services as Constable<\/p>\n<p>                         on the ground that they also discharged the same<\/p>\n<p>                         duties which a Constable does. I regret not to accept<\/p>\n<p>                         such submission for the simple reason that Constables<\/p>\n<p>                         are appointed in the light of the Indian Police Act and<\/p>\n<p>                         the   Police     Manual,   whereas    Homeguards      are<\/p>\n<p>                         appointed as per the provisions of the Bihar<\/p>\n<p>                         Homeguards Act and the Rules framed thereunder.<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          The nature of duties entrusted to the Constables and<\/p>\n<p>          the Homeguards including the mode of appointment<\/p>\n<p>          are also different. In the circumstances, petitioners<\/p>\n<p>          cannot be regularized as Constables. They may apply<\/p>\n<p>          for appointment as Constable in the Homeguards<\/p>\n<p>          category. The writ petition is, accordingly, dismissed.<\/p>\n<p>                                ( V. N.
