Kutch, for the offence u\/ss. 406, 409,<br \/>\n\t467, 468, 471, 120(b) of Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate, appearing on behalf of the applicant has contended that<br \/>\n\tlooking to the police papers, prima facie, case is not made out<br \/>\n\tagainst the applicant. He has contended that he has already<br \/>\n\tdeposited the whole amount before the Police Inspector, LCB Police<br \/>\n\tStation, Bhuj-Kutch. He has also produced copy of receipt for such<br \/>\n\tpayment, which is ordered to be taken on the record. The said amount<br \/>\n\twill be subject to the result of the trial against the applicant. He<br \/>\n\thas also contended that now the charge-sheet is filed and,<br \/>\n\ttherefore, there is no question of tampering with any evidence by<br \/>\n\tthe applicant. Learned APP has also vehemently opposed the grant of<br \/>\n\tthis application.\n<\/p>\n<p>Having<br \/>\n\theard the learned Counsel for both the sides and looking to the<br \/>\n\tfacts and circumstances of the case and looking to the fact that the<br \/>\n\tapplicant has deposited the whole amount before the Police<br \/>\n\tInspector, LCB Police Station, Bhuj-Kutch, and the fact that now the<br \/>\n\tcharge-sheet is filed and, therefore, without entering into the<br \/>\n\tmerits of the matter, I am inclined to grant bail to the applicants.<br \/>\n\tBoth the learned Advocates do not press for reasoned order.\n<\/p>\n<p>Considering<br \/>\n\tthe above, this Application is allowed. The applicant is ordered to<br \/>\n\tbe released on bail in connection with CR No. I-13 of 2011<br \/>\n\tregistered with Khavda Police Station, Bhuj, Dist. Kutch, for the<br \/>\n\toffence alleged against him in this application on his executing a<br \/>\n\tBond of Rs.10,000\/- (Rupees ten thousand only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the trial Court and<br \/>\n\tsubject to the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or \tabuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurize the \tprosecution witnesses or<br \/>\ncomplainant in any \tmanner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of \tthe prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat till the disposal \tof Sessions case<br \/>\nwithout the prior permission \tof the concerned Sessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\naddress of his residence to the I.O. \tand \talso to the Court at the<br \/>\ntime of execution \tof \tthe bond and shall not change the residence<br \/>\n\twithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\nhis passport, if any, to the lower \tCourt within a week.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>6.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute.
