Justice M.L.JOSEPH FRANCIS\n\n Dated :01\/02\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n         ------------------------------------------------------\n                  W.P.(C) No.2513 of 2010-L\n            ----------------------------------------------\n           Dated, this the Ist day of February, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>              Petitioner seeks the following reliefs:<\/p>\n<p>      &#8220;i) issue a writ of mandamus or any other writ,<\/p>\n<p>      direction or order, directing the respondents 1 to 3<\/p>\n<p>      not to interfere or harass the petitioner and his<\/p>\n<p>      wife.\n<\/p>\n<p>      ii).    issue a writ of prohibition restraining<\/p>\n<p>      respondents 1 to 3 from forcibly evicting the<\/p>\n<p>      petitioner and his wife Santhi from the 40 cents of<\/p>\n<p>      property      comprised       in     Resurvey       Block<\/p>\n<p>      No.46\/319\/2       Neyyattinkara      Taluk,    Kulathoor<\/p>\n<p>      Village in Trivandrum District, which is the subject<\/p>\n<p>      matter of O.S.No.860 of 2002 of the Munsiff Court,<\/p>\n<p>      Neyyattinkara which is pending as A.S.No.158 of<\/p>\n<p>      2007 of the Sub Court, Neyyattinkara.&#8221;<\/p>\n<p>             2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows:&#8211;Petitioner is in possession of 40 cents of land which<\/p>\n<p>is outstanding on mortgage.         Petitioner purchased the said<\/p>\n<p>property in 1993 and thereafter he is in exclusive possession<\/p>\n<p><span class=\"hidden_text\">W.P.C.2513\/2010                -2-<\/span><\/p>\n<p>of the same. The 4th respondent is the elder brother of the<\/p>\n<p>petitioner. There is allegation that he attempted to trespass<\/p>\n<p>into the property belonging to the petitioner by raising<\/p>\n<p>frivolous claims. The petitioner filed O.S.No.860\/2002 before<\/p>\n<p>the Munsiff Court, Neyyattinkara for declaration of title and<\/p>\n<p>for injunction against the 4th respondent. It is stated that the<\/p>\n<p>suit is dismissed and the petitioner filed appeal. Petitioner<\/p>\n<p>has also filed an application for injunction. According to the<\/p>\n<p>petitioner, it is a civil dispute. It is stated that the police as<\/p>\n<p>directed by the 4th respondent       have on several occasions<\/p>\n<p>came to the petitioner&#8217;s house and asked his wife to inform<\/p>\n<p>the petitioner to be present in the police station. It is stated<\/p>\n<p>that the police feel that as the suit is dismissed it is now their<\/p>\n<p>duty to throw out the petitioner from the premises.<\/p>\n<p>             3. The learned Government Pleader was asked to<\/p>\n<p>get instruction. Learned Government Pleader would submit<\/p>\n<p>that both the parties preferred complaint before the police<\/p>\n<p>and there is civil case pending. It is submitted that police<\/p>\n<p>directed the parties to be present and that the parties did not<\/p>\n<p>turn up. It is also submitted that police will not interfere in<\/p>\n<p><span class=\"hidden_text\">W.P.C.2513\/2010             -3-<\/span><\/p>\n<p>the civil dispute between the parties.
