JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per : HONOURABLE<br \/>\nMR.JUSTICE JAYANT PATEL)<\/p>\n<p>1.\t\tPursuant<br \/>\nto the earlier orders passed by this Court, the officers are present.\n<\/p>\n<p>2.\t\tThe<br \/>\nbasis of the present contempt application is non-compliance to the<br \/>\norder dated 16.11.2009 passed by this Court in Special Civil<br \/>\nApplication No.11751\/2009, whereby, based on various decisions of<br \/>\nthis Court, direction was given to the State Government to reconsider<br \/>\nthe case for compassionate appointment in the light of the<br \/>\nobservations made in the judgment and the decision to be taken within<br \/>\nthree months from receipt of the order of this Court, and as no<br \/>\ndecision has been taken, the present proceedings.\n<\/p>\n<p>3.\t\tThis<br \/>\nCourt had issued the Notice as back as on 10.06.2010, which was made<br \/>\nreturnable on 23.06.2010. No reply whatsoever has been filed on<br \/>\nbehalf of the State Government and so far as the District Panchayat<br \/>\nis concerned, it has been stated that the proposal was already<br \/>\nforwarded.\n<\/p>\n<p>4.\t\tWhen<br \/>\nthe matter is further taken up for hearing today, the learned<br \/>\nAssistant Government Pleader states that the State has decided to<br \/>\nprefer Letters Patent Appeal and LPA (Stamp) No.1634\/2010 has been<br \/>\nfiled yesterday. In order to verify the bona fide action on the part<br \/>\nof the State to comply with the orders of this Court, the learned<br \/>\nAssistant Government Pleader has made available to us, the file of<br \/>\nthe State Government, which shows that the decision was taken of<br \/>\npreferring LPA as back as on 12.01.2010 by the Legal Department and<br \/>\nthe appeal is filed after a period of about more than six months. The<br \/>\naforesaid shows absolute callous approach on the part of the<br \/>\nGovernment in not complying with the orders of this Court and\/or<br \/>\npursuing the matter, if it is so desired, before the higher forum.\n<\/p>\n<p>5.\t\tThe<br \/>\npertinent aspect is that the LPA is also barred by more than eight<br \/>\nmonths and there is also reference to the application for condonation<br \/>\nof delay. Until the delay is not condoned, the further aspects may<br \/>\nalso remain hanging.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe above circumstances, this Court will have no option but to take a<br \/>\nstrict view of the matter, if no stay order is granted by the LPA<br \/>\nBench against the operation of the order and non-compliance to the<br \/>\norder of this Court.\n<\/p>\n<p>7.\t\tAs<br \/>\nit is reported that LPA has been preferred, in order to enable the<br \/>\nrespondents to have one more opportunity, it is observed and directed<br \/>\nthat in absence of any order of the LPA Bench, the order shall be<br \/>\ncompiled with on or before 11.08.2010, failing which, the concerned<br \/>\nofficer shall explain to this Court as to why appropriate order<br \/>\nshould not be passed for imposing appropriate punishment under the<br \/>\nContempt of Courts Act.
