BASANT, J.\n\n              -------------------------------------------------\n\n                     CRL.M.C.NO. 1582 OF  2006\n\n              -------------------------------------------------\n\n          Dated this the 30th day of November, 2006\n\n\n                                  ORDER\n<\/pre>\n<p>      The   petitioner   is   the   7th  accused   in   a   prosecution<\/p>\n<p>initiated   under   the   provisions   of   the   Prevention   of   Food<\/p>\n<p>Adulteration Act.\n<\/p>\n<\/p>\n<p>      2.     The   crux   of   the   allegations   is   that   the   soft   drink<\/p>\n<p>manufactured   by   the   petitioner   was   found   to   be   adulterated.<\/p>\n<p>The   Public   Analyst   found   that   the   sample   was   adulterated.<\/p>\n<p>The   sample   was   sent   to   the   Central   Food   Laboratory.     The<\/p>\n<p>Central   Food   Laboratory   reported   that   the   article   is   not<\/p>\n<p>adulterated.  According to the petitioner, since the decision in<\/p>\n<p><a href=\"\/doc\/853032\/\">K.M.   Mathew   v.   State   of   Kerala<\/a>   (1992(1)   SCC   1)   stands<\/p>\n<p>overruled by the decision in <a href=\"\/doc\/549946\/\">Adalat Prasad v. Rooplal Jindal<\/a><\/p>\n<p>(2004   (7)   SCC   338),   the   learned   Magistrate   is   not<\/p>\n<p>jurisdictionally competent  to  drop the proceedings and that is<\/p>\n<p>why   the   petitioner   has   come   before   this   Court   to   invoke   the<\/p>\n<p>powers   under   Sec.482   of   the   Cr.P.C.     It   is   the   only   course<\/p>\n<p>available   to   him   in   the   light   of  <a href=\"\/doc\/549946\/\">Adalat   Prasad   v.   Rooplal<\/p>\n<p>Jindal<\/a> (2004 (7) SCC 338), submits counsel.<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 1582 OF  2006  -: 2 :-<\/span><\/p>\n<p>        3.    The   learned  counsel  for   the  respondent\/Corporation   of<\/p>\n<p>Thiruvananthapuram   Shri   Nandakumara   Menon   fairly   submits<\/p>\n<p>that in the light of the report of the Central Food Laboratory, it is<\/p>\n<p>not   open   to   the   respondent   now   to   canvass   that   the   article   is<\/p>\n<p>adulterated.     The   proceedings   against   the   petitioner   must,   in<\/p>\n<p>these circumstances, come to an end.  I am satisfied that this is a<\/p>\n<p>fit case where the jurisdiction under Sec.482 of the Cr.P.C. can<\/p>\n<p>and   ought   to   be   invoked   as   explained   in  <a href=\"\/doc\/549946\/\">Adalat   Prasad   v.<\/p>\n<p>Rooplal Jindal<\/a> (2004 (7) SCC 338).\n<\/p>\n<\/p>\n<p>        4.  In the result:\n<\/p>\n<\/p>\n<p>        (a)  This Crl.M.C. is allowed.\n<\/p>\n<\/p>\n<p>        (b)     C.C.No.314\/98   pending   before   the   Additional   Chief<\/p>\n<p>Judicial   Magistrate&#8217;s   Court,   Thiruvananthapuram   in   so   far   as  it<\/p>\n<p>relates to the petitioner is concerned is hereby quashed.<\/p>\n<p>                                                                Sd\/-\n<\/p>\n<p>\n                                                (R.
