That in the case titled as Jitender Singh The information sought by the<br \/>\n         Tyagi Vs. Director of Education and applicant was not readily available<br \/>\n         Ors., which was rightly decided by the being a very old case.<br \/>\n         Coram of Hon&#8217;ble Mr. Justice Mukul<br \/>\n         Mudgal and Mr. Justice Manmohan of<br \/>\n         Hon&#8217;ble High Court of Delhi vide LPA<br \/>\n         No. 1991\/2006, decided on October 03,<br \/>\n         2008, it was mentioned in this judgment on<br \/>\n         the page no.2, para no. 2 that &#8221; On a query<br \/>\n         from the secretary DAV College<br \/>\n         Managing        Committee,        Secretary,<br \/>\n         C.B.S.E. by its letter dated 5th<br \/>\n         December, 1996 was pleased to inform<br \/>\n         them that each public school affiliated to<br \/>\n      CBSE is treated as a separate entity&#8221;.<br \/>\n     The Appellant wants the duly attested<br \/>\n     copy of the query of DAV College<br \/>\n     Managing Committee received by the<br \/>\n     C.B.S.E. and the letter vide no. DC<br \/>\n     No.5\/PA\/96\/314, dated 5\/12\/96 issued by<br \/>\n     the Secretary of C.B.S.E. in response to<br \/>\n     the same. And if the details were not<br \/>\n     available then reasons for the same and the<br \/>\n     persons responsible for the same.\n<\/p>\n<p>2.   Name, addresses &amp; phone numbers of the         Copy of list of School Managing<br \/>\n     members of Managing Committee in               Committee of the Schools as<br \/>\n     respect of the following CBSE affiliated       available in the records of the<br \/>\n     schools as per the record of the concerned     Board is enclosed.<br \/>\n     branch of CBSE:-\n<\/p>\n<blockquote><p>         (i) DAV Cent. Public School, Urban<br \/>\n                 Estate, Jind 126102 Haryana.<\/p>\n<pre>\n         (ii) DAV Cent. Public School, Meham\n                 Road,       Bhiwani     127021\n                 Haryana.\n3.   The name of all teaching and non- teaching     CBSE does not compile such\n     staff members along with their address and     information on regular basis hence\n     phone numbers in r\/o the following CBSE        the same is not available with the\n     affiliated schools along with the              Board.\n     information that whether they were\n<\/pre>\n<blockquote><p>     sufficient in number as per CBSE rules &amp;<br \/>\n     regulations:\n<\/p><\/blockquote>\n<blockquote><p>         (i) DAV Cent. Public School, Urban<br \/>\n                 Estate, Jind 126102 Haryana.<\/p><\/blockquote>\n<pre>\n         (ii) DAV Cent. Public School, Meham\n                 Road,       Bhiwani     127021\n                 Haryana.\n4.   The information supplied earlier to the        CBSE does not compile such\n     Appellant mentioned the list of the            information on regular basis hence\n     members of B.N.S.D.A.V Public School by        the same is not available with the\n     the CBSE, but the address of Chairman of       Board.\n<\/pre>\n<blockquote><p>     this school was incorrect. The Appellant<br \/>\n     had sought the correct address of this<br \/>\n     official.\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>5.   The steps taken by the CBSE authorities        The information sought by the<br \/>\n     with regard to the complaint filed by the      applicant is not clear. Hence copy<br \/>\n     Appellant vide his letter dated 13th           of his letter dated 13\/12\/2008 and<br \/>\n     December 2008 bearing Ref. No. as              reply sent by CBSE may be<br \/>\n     CBSE\/ERROR\/1 along with the reasons            submitted for providing the<br \/>\n     and name of the guilty CBSE officials who      information<br \/>\n     are responsible for not ensuring the justice<br \/>\n          till today.\n<\/p><\/blockquote>\n<p>6.       Appellant had sent a letter dated 19th          Revised marking scheme is<br \/>\n         February through the Principal of Kali Ram      already available on CBSE<br \/>\n         D.A.V.       Public     School,    Safidon-     website as intimated vide letter<br \/>\n         126112(Jind), Haryana to the Chairman of        dated 19\/11\/2008 which may<br \/>\n         CBSE, New Delhi along with the copy to          please be referred to.<br \/>\n         Secretary of CBSE &amp; Regional Office of<br \/>\n         CBSE at Panchkula. The Appellant sought<br \/>\n         the details about the contents of this letter<br \/>\n         as to which one of them had been accepted<br \/>\n         and which of those had been rejected along<br \/>\n         with the reasons for the same.\n<\/p>\n<p>7.       That he had filed a complaint to Chairman,      The school management has been<br \/>\n         Secretary, Chief Vigilance Officer, Deputy      asked to submit comments on the<br \/>\n         Secretary (Affiliation), Grievance Officer,     complaint vide letter dated 21st<br \/>\n         Regional Officer, Panchkula of CBSE vide        March, 2009. Reply waited.\n<\/p>\n<p>         his         letter       bearing         No.<br \/>\n         2009\/JAISIYARAMKI\/KHANNA\/AHC\/1-\n<\/p>\n<p>         22\/C1-72\/4 dated March 21, 2009 along<br \/>\n         with the necessary enclosures in a matter<br \/>\n         where his certificates and amounts were<br \/>\n         not paid by the CBSE affiliated schools. He<br \/>\n         wishes to know the action taken by each of<br \/>\n         them on the same separately &amp; the<br \/>\n         outcome of the action of these authorities<br \/>\n         of CBSE separately.\n<\/p>\n<p>Reply of PIO:\n<\/p>\n<p>As above.\n<\/p>\n<p>Grounds for First Appeal:\n<\/p>\n<p>Partial and unsatisfactory reply by the PIO<\/p>\n<p>Order of the First Appellate Authority:<br \/>\nThe FAA stated in his order that &#8220;In the light of the case and facts given above it has<br \/>\nbeen observed that the Appellant has been provided with the information available with<br \/>\nthe Board and no denial of information on the part of Public Information Officer has been<br \/>\nestablished. The Appeal is dismissed with the above observations&#8221;.\n<\/p>\n<p>Grounds for Second Appeal:\n<\/p>\n<p>PIO did not provide the complete information.\n<\/p>\n<p>Relevant facts emerging during hearing:<br \/>\nThe following were present.\n<\/p>\n<p>Appellant: Absent<br \/>\n Respondent: Absent<\/p>\n<p>The PIO will give the following information to the Appellant:<br \/>\nQuery 1- the information to be provided or a clear statement will be made that the<br \/>\ninformation is not available.\n<\/p>\n<p>Query 3- if the names of the teaching and non-teaching staff are submitted by the schools,<br \/>\nthe lists will be provided to the Appellant.
