NO. 11816 OF 2004\n\n                     ---------------------------------------\n\n                    Dated this the 5th day of July, 2007.\n\n\n                                 J U D G M E N T\n<\/pre>\n<p>       This writ petition is filed with the following prayer:<\/p>\n<blockquote><p>              i)       to issue a Writ of prohibition, direction or order of<\/p>\n<p>              the   like   nature   restraining   the   respondents   from<\/p>\n<p>              conducting any business in Petroleum in partly reclaimed<\/p>\n<p>              wet   land   in   survey   No.   85\/6   in   Block   No.   B\/23   of<\/p>\n<p>              Mulanthuruthy Village.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>       2.     In   the   counter   affidavit   filed   by   the   3rd  and   5th<\/p>\n<p>respondent   it   is   submitted   that   there   is   no   violation   of   the<\/p>\n<p>provisions of Land Utilisation Order, since the property is garden<\/p>\n<p>land for several years.\n<\/p>\n<\/p>\n<p>       Learned Government Pleader upon instructions submits that<\/p>\n<p>the Tahsildar has already conducted an enquiry in the matter and<\/p>\n<p>found   that   there   is   no   merit   in   the   allegations   raised   by   the<\/p>\n<p>petitioner.
