JUSTICE JYOTI SARAN\n\n                  ORAL ORDER<\/pre>\n<p>                  (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>5.   10.8.2010.                     This petition under Article 226 of the<\/p>\n<p>                      Constitution has been filed by one Sanjay Kumar, Chief<\/p>\n<p>                      Councillor of Nagar Parishad, Nawada. The petitioner has<\/p>\n<p>                      grievance in respect of the sanctioned strength of the<\/p>\n<p>                      establishment of the Nawada Nagar Parishad. It is his<\/p>\n<p>                      grievance that the State Government has not sanctioned<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>adequate posts so as to meet the requirement of the Nagar<\/p>\n<p>Parishad. The proposal for sanction of more posts made in<\/p>\n<p>the year 1970 is still pending with the State Government.<\/p>\n<p>The dearth of staff paralyses the administration.<\/p>\n<p>             Learned Advocate Mr. Mani Kant Mishra has<\/p>\n<p>appeared for the State Government. He has submitted that<\/p>\n<p>on 20th November 1999 the Government has imposed ban<\/p>\n<p>on further appointments. He has also submitted that in spite<\/p>\n<p>of want of sanctioned post the Nagar Parishad has made<\/p>\n<p>appointments de hors the rules and now proposes for more<\/p>\n<p>posts so that the illegal appointments can be regularized. He,<\/p>\n<p>however, condescends that the State Government shall<\/p>\n<p>review the position and the need for more sanctioned posts.<\/p>\n<p>He states that the State Government shall consider the<\/p>\n<p>request for more sanctioned posts made by the Nawada<\/p>\n<p>Nagar Parishad within six weeks from today.<\/p>\n<p>             In view of the above statement made by the<\/p>\n<p>learned Advocate no further order is required to be made<\/p>\n<p>except that the State Government will make speaking order<\/p>\n<p>whether it grants the request of the Nagar Parishad or<\/p>\n<p>refuses it or partially grants it. The order will be<\/p>\n<p>communicated to the Nagar Parishad.\n<\/p>\n<p><span class=\"hidden_text\">                             -3-<\/span><\/p>\n<p>                       Subject to the above observations, the petition<\/p>\n<p>          is disposed of.\n<\/p>\n<\/p>\n<p>                              (R.M.
