On 1.8.1988 at<br \/>\nabout 5:00 p.m., he along with other co-employees were on duty in the<br \/>\narea, where they found that the accused persons were grazing their<br \/>\ncattle and therefore, the complainant told them to attach the cattle.<br \/>\nTherefore, the accused persons assaulted upon the complainant and<br \/>\nother persons with sticks and Dhariya. Therefore, the complaint was<br \/>\nregistered against the accused persons under Sections 333, 325, 323,<br \/>\n114, 504 and 506(2) and under Sections 161 and 162 of the Gujarat<br \/>\nPanchayat Act as well as under Section 135 of the Bombay Police Act.\n<\/p>\n<p>4.<br \/>\nThe accused pleaded not guilty and claimed to be tried the case.<br \/>\nFurther statement of the accused recorded under the provisions of<br \/>\nSection 313 of the Code of Criminal Procedure. During the course of<br \/>\ntrial, following witnesses from the prosecution side, have been<br \/>\nexamined before the learned Sessions Judge.\n<\/p>\n<p>P.W.1<br \/>\n\t   Khimjibhai Gelabhai   Complainant at Exhibit 9.\n<\/p>\n<p>P.W.2<br \/>\n\t   Jivan Raymal Exhibit 11.\n<\/p>\n<p>P.W.3<br \/>\n\t   Kuka Laghabhai  Exhibit 12.\n<\/p>\n<p>P.W.4<br \/>\n\t   Medical Officer, Anjanaben Narendrabhai Exhibit 14.\n<\/p>\n<p>P.W.5<br \/>\n\t   Jivraj Karsanbhai   Exhibit 19<\/p>\n<p>P.W.6<br \/>\n\t  Dilubhai Gandabhai Exhibit 20<\/p>\n<p>P.W.7<br \/>\n\t  PSI S.J. Rathod Exhibit 26.\n<\/p>\n<p>\tThe<br \/>\ndocumentary evidence produced before the learned Sessions Judge, are<br \/>\nas under:\n<\/p>\n<p>Exhibit<br \/>\n\t4   : Charge-sheet.\n<\/p>\n<p>Exhibit<br \/>\n\t10 :  Complaint.\n<\/p>\n<p>Exhibit<br \/>\n\t16 :  Medical Certificate of Khimjibhai.\n<\/p>\n<p>4.<br \/>\nExhibit 18 :  Medical Certificate of Jivanbhai Raybhan.\n<\/p>\n<p>5. Exhibit 21 :\n<\/p>\n<p> Panchnama.\n<\/p>\n<p>6. Exhibit 27 :\n<\/p>\n<p> Panchnama.\n<\/p>\n<p>5.<br \/>\nAfter hearing both the parties, the learned Additional Sessions<br \/>\nJudge, Surendranagar vide judgment and order dated 21st<br \/>\nJanuary, 1997 in Sessions Case No.59 of 1992, was pleased to held<br \/>\nguilty the accused and imposed sentence upon them as under :\n<\/p>\n<p>6.\tThe appellants<br \/>\naccused are convicted for the offence punishable under Section 161 of<br \/>\nGujarat Panchayat Act and sentenced to undergo R.I. for 7 days and to<br \/>\npay a fine of Rs.250\/- each i\/d to further undergo R.I. for 7 days.<br \/>\nAlso, the appellants   accused are convicted for the offence<br \/>\npunishable under Section 162 of the Gujarat Panchayat Act and<br \/>\nsentenced to undergo R.I. for 1 month and to pay a fine of Rs.250\/-<br \/>\neach, i\/d further R.I. of 7 days. The appellants   accused are<br \/>\nconvicted for the offence punishable under Section 447 of the Indian<br \/>\nPenal Code and sentenced to undergo R.I. for 1 month, and to pay fine<br \/>\nof Rs.100\/- each, i\/d further R.I. of 7 days. The appellants &#8211;<br \/>\naccused are also convicted for the offence punishable under Section<br \/>\n332 and sentenced to undergo R.I. for 6 months and to pay a fine of<br \/>\nRs.100\/- each, i\/d further R.I. of 7 days.\tThe appellants No.1 and 2<br \/>\n  accused are convicted for the offence punishable under Section<br \/>\n333 read with Section 114 of the Indian Penal Code and sentenced to<br \/>\nundergo R.I. for one year and to pay fine of Rs.250\/- each, i\/d<br \/>\nfurther R.I. of 7 days. The appellant No.3 &#8211; accused is convicted for<br \/>\nthe offence punishable under Section 333 of the Indian Penal Code and<br \/>\nsentenced to undergo sentence R.I. for 3 years and to pay fine of<br \/>\nRs.250\/-, i\/d further R.I. of 7 days.\n<\/p>\n<p>7.<br \/>\nBeing aggrieved and dissatisfied with the said order, the appellants<br \/>\npreferred present appeal.\n<\/p>\n<p>7.<br \/>\n\tHeard Mr. Yogesh Lakhani, learned senior counsel appearing on of the<br \/>\nappellants and learned APP Mr. A.J. Desai appearing on behalf of the<br \/>\nrespondent   State.\n<\/p>\n<p>8.\tLearned<br \/>\nsenior counsel Mr. Yogesh Lakhani has submitted that the impugned<br \/>\norder of conviction being erroneous and contrary to the record of the<br \/>\ncase, deserves to be quashed and set aside. He has submitted that the<br \/>\nlearned Sessions Judge has not considered the defence of the present<br \/>\nappellants, while passing the judgment and order. He has also<br \/>\ncontended that as per the complainant&#8217;s case, the complainant has<br \/>\nbeen assaulted by the appellants but the medical evidence does not<br \/>\nsupport the case of  prosecution. The complainant tried to drive out<br \/>\nthe cattle of the accused and at that time, the complainant jumped<br \/>\nthe wall of Vidi to save himself from cattle and fell down and<br \/>\nsustained injuries. He has also contended that there is material<br \/>\ncontradiction in the deposition of the witnesses. There is no any<br \/>\nindependent witness and learned Sessions Judge relied upon the<br \/>\ndeposition of the interested witness though there is no corroborative<br \/>\nevidence on record to hold the conviction. Lastly, he has also<br \/>\nsubmitted that he is arguing this matter only on the point of quantum<br \/>\nof punishment and has prayed for lesser punishment. He has contended<br \/>\nthat the present appellants may be imposed lesser punishment by<br \/>\nreducing the sentence, which is imposed by the learned Sessions<br \/>\nJudge.\n<\/p>\n<p>9.<br \/>\nShri A.J. Desai, learned APP appearing for the respondent-State has<br \/>\nsupported the judgment and order passed by the learned Sessions<br \/>\nJudge. But he submitted that the State has no objection, if the<br \/>\nsubmission of the learned senior counsel Mr. Lakhani  appearing on<br \/>\nbehalf of the appellants   accused for lesser punishment is<br \/>\nconsidered.\n<\/p>\n<p>10.<br \/>\nThis Court has perused the records and proceedings of the Trial Court<br \/>\nand heard the learned counsel of the respective parties at length. On<br \/>\nperusal of the record and the submission made by both the learned<br \/>\ncounsel, I am of the opinion that the decision of the Trial Court<br \/>\ndoes not suffer from any infirmity whatsoever. The appellants have<br \/>\nfailed in establishing that the decision of the Trial Court suffers<br \/>\nfrom any perversity. On the contrary the decision of the Trial Court<br \/>\nis just and proper and it is based upon the evidence and it is after<br \/>\nproper appreciation. The Trial Court has rightly come to the<br \/>\nconclusion that the appellants has failed in establishing its case<br \/>\nbeyond reasonable doubt and, therefore, the order of acquittal dated<br \/>\n21.1.1997<br \/>\npassed by learned Additional Sessions Judge,<br \/>\nSurendranagar in Sessions Case No.59 of 1992 deserves to be<br \/>\nconfirmed. But considering the submissions made by the learned senior<br \/>\ncounsel Mr. Lakhani appearing on behalf of the appellants   accused<br \/>\nthat the Sessions Judge convicted the accused and he has also<br \/>\nadmitted that there is no reason to say regarding the reasons<br \/>\nassigned in the judgment and order passed by the learned Sessions<br \/>\nJudge, but he has prayed to reduce the sentence. So in that<br \/>\ncircumstances, I am of the opinion that the submissions made by the<br \/>\nlearned senior counsel appearing on behalf of the appellants<br \/>\naccused is required to be considered and the submissions are<br \/>\nsupported by the learned APP Mr. Desai and I am<br \/>\ninclined to modify the order of the learned Sessions Judge by partly<br \/>\nallowing this appeal.\n<\/p>\n<p>11.\t\tThis<br \/>\nAppeal is partly allowed. The judgment and order dated 21.1.1997<br \/>\npassed by the learned Additional Sessions Judge, Surendranagar in<br \/>\nSessions Case No.59 of 1992, is hereby confirmed. However, the<br \/>\nsentence awarded by the learned Judge is modified to the following<br \/>\nextent :\n<\/p>\n<p>\tThe appellants   accused<br \/>\nare convicted for the offence punishable under Section 161 of Gujarat<br \/>\nPanchayat Act and sentenced to undergo R.I. for 7 days and to pay a<br \/>\nfine of Rs.250\/- each i\/d to further undergo R.I. for 7 days. Also,<br \/>\nthe appellants   accused are convicted for the offence punishable<br \/>\nunder Section 162 of the Gujarat Panchayat Act and sentenced to<br \/>\nundergo R.I. for 1 month and to pay a fine of Rs.250\/- each, i\/d<br \/>\nfurther R.I. of 7 days.\n<\/p>\n<p>\tThe appellants   accused<br \/>\nare convicted for the offence punishable under Section 447 of the<br \/>\nIndian Penal Code and sentenced to undergo R.I. for 1 month, and to<br \/>\npay fine of Rs.100\/- each, i\/d further R.I. of 7 days.\n<\/p>\n<p><span class=\"hidden_text\">\tThe appellants No.1 and  2<\/span><\/p>\n<p>&#8211; accused are also convicted for the offence punishable under Section<br \/>\n332 and sentenced to undergo R.I. for 4 months and to pay a fine of<br \/>\nRs.100\/- each, i\/d further R.I. of 7 days.\n<\/p>\n<p><span class=\"hidden_text\">\tThe appellants No.1 and 2  <\/span><\/p>\n<p>accused are convicted for the offence punishable under Section 333<br \/>\nread with Section 114 of the Indian Penal Code  and sentenced to<br \/>\nundergo R.I. for 4 months and to pay fine of Rs.250\/- each, i\/d<br \/>\nfurther R.I. of 7 days.\n<\/p>\n<p>\tThe appellant No.3 &#8211;\n<\/p>\n<p>accused is convicted for the offence punishable under Section 333 of<br \/>\nthe Indian Penal Code and sentenced to undergo sentence R.I. for 1<br \/>\nyear and to pay fine of Rs.250\/-, i\/d further R.I. of 7 days.\n<\/p>\n<p>\tThe substantive sentence<br \/>\nshall run concurrently.\n<\/p>\n<p>\tRest of the judgment and<br \/>\norder of the trial Court is hereby confirmed.\n<\/p>\n<p>\tThe appellants   original<br \/>\naccused are directed to surrender themselves before the Jail<br \/>\nAuthority within a period of six weeks from the date of this order,<br \/>\nfailing which the concerned Sessions Court shall issue non-bailable<br \/>\nwarrant to effect the arrest of the appellants   original accused.\n<\/p>\n<p>\tBail<br \/>\nbonds, if any, shall stands cancelled.
