{"id":189505,"date":"2011-05-02T00:00:00","date_gmt":"2011-05-01T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/joginder-pal-singh-vs-state-of-rajasthan-and-others-on-2-may-2011"},"modified":"2016-07-25T00:24:16","modified_gmt":"2016-07-24T18:54:16","slug":"joginder-pal-singh-vs-state-of-rajasthan-and-others-on-2-may-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/joginder-pal-singh-vs-state-of-rajasthan-and-others-on-2-may-2011","title":{"rendered":"Joginder Pal Singh vs State Of Rajasthan And Others on 2 May, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Joginder Pal Singh vs State Of Rajasthan And Others on 2 May, 2011<\/div>\n<pre> IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH\n\n\n                                       CR No.2886 of 2011 (O&amp;M)\n                                       Date of decision: 2.5.2011\n\nJoginder Pal Singh\n                                                                       ...Petitioner\n\n                       Versus\n\nState of Rajasthan and others\n                                                                 ...Respondent\n\nCORAM:        HON'BLE MR.JUSTICE RAM CHAND GUPTA\n\nPresent:      Mr.Peeush Gagneja, Advocate for the petitioner\n\n                            ***\n<\/pre>\n<p>Ram Chand Gupta, J.(Oral)<\/p>\n<p>CM No. 11479-CII of 2011<\/p>\n<p>              Application is allowed subject to all just exceptions.<\/p>\n<p>CR No. 2886 of 2011<\/p>\n<p>              The present revision petition has been filed under Article 227<\/p>\n<p>of the Constitution of India for quashing of order dated 23.2.2011<\/p>\n<p>(Annexure P-3) passed by learned Civil Judge (Junior Division), Abohar in<\/p>\n<p>case No.2781 of 9.5.2006, vide which evidence of the petitioner-plaintiff<\/p>\n<p>was closed.\n<\/p>\n<p>              I have heard learned counsel for the petitioner and have gone<\/p>\n<p>through the whole record carefully including the impugned order passed by<\/p>\n<p>learned trial court.\n<\/p>\n<p>              The facts relevant for the decision of the present revision<\/p>\n<p>petition are that suit for declaration was filed by the predecessor-in- interest<\/p>\n<p>of the present petitioner namely Gurpal Singh, who died when the case was<\/p>\n<p>fixed for evidence and the present petitioner was impleaded as legal<\/p>\n<p>representative of the deceased plaintiff.\n<\/p>\n<p><span class=\"hidden_text\"> CR No.2886 of 2011 (O&amp;M)                                  -2-<\/span><\/p>\n<p>             It has been contended by learned counsel for the petitioner that<\/p>\n<p>after   the petitioner was impleaded as party only one opportunity was<\/p>\n<p>granted by learned trial court to adduce his evidence.          Thereafter, his<\/p>\n<p>evidence was closed. It is further contended that only petitioner remains to<\/p>\n<p>be examined as witness and no other witness is to be examined.<\/p>\n<p>             The petitioner and his predecessor-in-interest had already<\/p>\n<p>availed nine opportunities to lead evidence. Case pertains to the year 2006.<\/p>\n<p>Hence, it cannot be said that the learned trial court has committed any<\/p>\n<p>illegality or material irregularity in passing the impugned order. However,<\/p>\n<p>in view of the fact that the petitioner was impleaded as party after death of<\/p>\n<p>his predecessor-in-interest and thereafter, only one opportunity was granted<\/p>\n<p>to him to adduce evidence, one opportunity can be granted to the petitioner<\/p>\n<p>for the purpose and other party can be compensated by way of cost.<\/p>\n<p>             Hence, the present revision petition is accepted and the<\/p>\n<p>impugned order is set aside.
