SANKARAN, J.\n                     ---------------------------\n                      B.A. No. 3112 of 2009\n                  ------------------------------------\n               Dated this the 23rd day of July, 2009\n\n                             O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos.1 to 5in Crime No.295\/2009 of Nooranadu Police Station.<\/p>\n<p>      2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 341, 323, 324, 509 and 308 read with Section 34 of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p>      3.    It is submitted that Crime No.296\/2009 is a counter<\/p>\n<p>case, in which the 4th petitioner Geethakumari is the defacto<\/p>\n<p>complainant.\n<\/p>\n<p>      4.    The prosecution case in Crime No.295\/2009 is the<\/p>\n<p>following: On 30\/05\/2009, the defacto complainant and his wife<\/p>\n<p>were coming from hospital on a motor bike. The wife of the<\/p>\n<p>defacto complainant was pregnant. They saw a fight going on<\/p>\n<p>between the petitioners and Leela, the land lady of the defacto<\/p>\n<p>complainant. The defacto complainant and his wife alighted from<\/p>\n<p>the motor bike. At that time, they were attacked by the<\/p>\n<p>petitioners. The defacto complainant sustained injuries.<\/p>\n<p>      5.    The case of the petitioners is that the 4th petitioner<\/p>\n<p>B.A. No. 3112\/2009<br \/>\n                             Page numbers<\/p>\n<p>purchased a property utilising the money which she received as<\/p>\n<p>compensation on account of the death of her husband while<\/p>\n<p>working abroad. One Manoj, son of Leela, claiming that he had<\/p>\n<p>entered into an agreement for sale with the owner of the<\/p>\n<p>property at an earlier point of time, filed a suit for specific<\/p>\n<p>performance, in which the 4th petitioner is also a party. That suit<\/p>\n<p>is pending. The records would also reveal that there was a Visa<\/p>\n<p>transaction between the defacto complainant and            the first<\/p>\n<p>petitioner.\n<\/p>\n<p>      6.     Heard Smt. Sangeetha Lakshman, the learned counsel<\/p>\n<p>appearing for the deacto complainant as well.<\/p>\n<p>      7.     I have perused the Case Diary. The wound certificate<\/p>\n<p>would disclose that the injuries are not very serious.<\/p>\n<p>      8.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence, the injury sustained and other<\/p>\n<p>circumstances, I am of the view that anticipatory bail can be<\/p>\n<p>granted to the petitioners. There will be a direction that in the<\/p>\n<p>event of the arrest of the petitioners, the officer in charge of the<\/p>\n<p>police station shall release them on bail for a period of one<\/p>\n<p>month on their executing bond for Rs.25,000\/- each with two<\/p>\n<p>B.A. No. 3112\/2009<br \/>\n                              Page numbers<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioners      shall    report    before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on all Mondays, till the final report is filed or until<br \/>\n             further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioners   shall   appear     before    the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n             prosecution   witnesses or      tamper      with  the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         E) On the expiry of the period mentioned above or<br \/>\n             even before that period, the petitioners shall<br \/>\n             surrender before the Magistrate concerned and<br \/>\n             seek regular bail.\n<\/p><\/blockquote>\n<blockquote><p>         F) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                     K.T.
