Justice V.GIRI\n\n Dated :23\/06\/2008\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                    W.P.(C).17441\/2008\n                       --------------------\n            Dated this the 23rd day of June, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      Petitioner, who is currently working at Kodikulam in<\/p>\n<p>Idukki District as Pharmacist, aspires for a transfer to<\/p>\n<p>Alappuzha taking note of the fact that petitioner&#8217;s wife is<\/p>\n<p>now posted at Medical College Hospital, Alapuzha. In fact,<\/p>\n<p>the petitioner&#8217;s wife had been posted at Alapuzha<\/p>\n<p>accepting the request made by her for inter district<\/p>\n<p>transfer.     Petitioner has also, in the circumstances,<\/p>\n<p>applied for a transfer to Alapuzha.         In the meanwhile,<\/p>\n<p>petitioner has been transferred from Kodikulam             to<\/p>\n<p>Adimali. Apparently petitioner had opted certain other<\/p>\n<p>places in Idukki District itself. By order dated 11.6.2008,<\/p>\n<p>it was directed that the petitioner may not be relieved<\/p>\n<p>from his present station except after getting orders from<\/p>\n<p>this Court.      This was to enable the Government<\/p>\n<p>Pleader to get instructions.\n<\/p>\n<\/p>\n<p>2.    Learned Government Pleader,             on instructions<\/p>\n<p>submits that the petitioner&#8217;s claim for a posting in<\/p>\n<p>W.P.(C).17441\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Alapuzha District will be considered in the next available<\/p>\n<p>vacancy     along   with  other    eligible    applicants.<\/p>\n<p>Submission is recorded.     In so far as the petitioner&#8217;s<\/p>\n<p>request for a posting at    a more convenient place in<\/p>\n<p>Idukki District, is concerned, the transfer effected under<\/p>\n<p>Ext.P9, is pending consideration under Ext.P11.<\/p>\n<p>3.   In the result, writ petition is disposed of directing<\/p>\n<p>the third respondent to consider the petitioner&#8217;s request<\/p>\n<p>for a posting in a place nearer to Kodikulam          than<\/p>\n<p>Adimali, within a period of four weeks from the date of<\/p>\n<p>receipt of a copy of this judgment.
