Dattu, C. J:\n<\/p>\n<p>       The issue raised in this writ appeal is identical with the issue raised and<\/p>\n<p>considered by a Division Bench of this Court in the <a href=\"\/doc\/1499609\/\">Kerala State Housing Board v.<\/p>\n<p>The Kerala State Housing Board Nellikode Housing Colony Allottees Association<\/p>\n<p>(W.A.No.1760 of<\/a> 2004). In the said decision this Court has stated as hereunder:<\/p>\n<blockquote><p>               &#8220;3.   From the portion of the judgment extracted<br \/>\n               above what transpires is that the amount payable<br \/>\n               was as on 14.7.1992,               but was         paid in 1997.<br \/>\n               Despite that the learned Single Judge has only<br \/>\n               directed that the Board would not recover interest<br \/>\n               from 9.10.1997 till the date of service of individual<br \/>\n               account      statement.            There      cannot        be     any<br \/>\n               interference to the direction issued by the learned<br \/>\n               Single Judge as noted above.                     The appellants<br \/>\n               cannot punish the petitioners for its own lethargy<br \/>\n               and selectness. It requires to be mentioned that<br \/>\n               almost all the prayers made by the petitioners were<br \/>\n               declined and the only prayer that has been allowed<br \/>\n               needs no interference in this appeal. There is no<br \/>\n               merit in this appeal which we dismiss leaving,<br \/>\n               however, the parties to bear their own costs.\n<\/p><\/blockquote>\n<p>Respectively, following the observations made by this Court in the aforesaid decision, in<\/p>\n<p>our opinion this appeal also requires to be rejected , and it is rejected.<\/p>\n<p>       Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                                                H.L.
