Heard the learned counsel for the
\nrespect of the appeal preferred by
\ncompany questioning the
\nawarded by the Comnii-shsionerr’ for
\nCompensation, Beliary, to feVspondent;cItiiimant.<\/p>\n
2. Shri A.M.Vet1\u00ab};F;tesh, for the
\nappe11ant~insuranee  that the
\nCommissio_n.e*it    2o’0\/ha idiisabiiity when the
\ninjury.,_”iiieV.;’eA   of one eye, only
\npermitsA~.1VVt)”\/oiof capacity being taken<\/p>\n
as per aSC1:1Vedt;*1eA-ii-, Vi”‘:Part~II of the Workmen’s<\/p>\n
‘”CAomp.ei<iisation Act.umSecondIy, the Commissioner having<\/p>\n
 that the income of the claimant<\/p>\n
w'as\u00ab<._Rs__7v'1',3i534\/~ per month could not have taken the<\/p>\n
 'saline at–Rs.2,200\/\u00bb per month. Therefore, compensation<\/p>\n

3. On the other hand, Shri. Hanumanthareddy
\nSahukar, learned counsel for the respondent~clai:in_aiit
\nargued that the compensation awarde\ufb01i  .
\nCommissioner is just and 1.-p”ro-per
\nmodi\ufb01cation and, moreover? the
\ncutter injury on the eye   <\/p>\n
4. Having thus   a\ufb01a”‘of’ithe View
\nthat the Commissioner’  The first
\none is, when at salary of<\/p>\n
the claimaiat p’erV’gnrionth, there was no<\/p>\n
need to -take at Rs.2,200\/– per month.<\/p>\n
Secondly,”v_g;henVV”tliek of earning capacity for the<\/p>\n
 injuriyfVsustaine–d.____hy. the claimant is 10% as per<\/p>\n
 Sc’hedu.le*–1″to”vthe Workmen’s Compensation Act, the<\/p>\n
Co.rn:nisVs1o”tieVr’could not have taken the same at 20%<\/p>\n
‘.V_notwuith\ufb02standing the fact that the claimant was working<\/p>\n
A  Vakstone cutter. Consequently, under the head ‘loss of<\/p>\n
 fttture earnings’, the appellant will be entitled to<\/p>\n
