This application was filed by the petitioner<\/p>\n<p>                   initially for quashing of an order contained in letter dated<\/p>\n<p>                   21.9.2004 issued by the Deputy Director Secondary<\/p>\n<p>                   Education, Government of Bihar, contained in memo<\/p>\n<p>                   no.1531, whereby he was directed to appear before the<\/p>\n<p>                   respondent no.3 with all connected documents relating to<\/p>\n<p>                   his appointment, so that genuiness of his appointment can<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>be examined. During the pendency of the writ application,<\/p>\n<p>the   inquiry   regarding   genuineness    of     petitioner&#8217;s<\/p>\n<p>appointment     completed   and   order   dated     6.3.2006<\/p>\n<p>contained in memo no.394 was issued by the Director<\/p>\n<p>Secondary Education, Government of Bihar terminating<\/p>\n<p>the petitioner from his service. The impugned orders have<\/p>\n<p>been challenged by the petitioner on the ground that it is<\/p>\n<p>completely, unreasonable, illegal and discriminatory.<\/p>\n<p>        3. Initially, the petitioner was appointed against<\/p>\n<p>leave vacancy on 7.9.1987 and worked on the post of clerk<\/p>\n<p>at Nationalised High School, Jamhara, for three months.<\/p>\n<p>Thereafter he was re-appointed against leave vacancy post<\/p>\n<p>and continued up to 30.6.1988. A notice was published<\/p>\n<p>relating to vacancies existing on Class-III posts in Koshi<\/p>\n<p>Division by Regional Deputy Director of Education,<\/p>\n<p>Saharsa on 6.1.1989. The petitioner also applied for the<\/p>\n<p>post in response to this notice of vacancies. Petitioner was<\/p>\n<p>asked to appear for interview before the Divisional<\/p>\n<p>Establishment committee vide memo no. 7572 dated<\/p>\n<p>25.6.1989 and the interview was held on 17.7.1989. The<\/p>\n<p>Establishment committee resolved to pass necessary<\/p>\n<p>orders relating to appointment of interviewed candidates in<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>its next meeting but it was not done till 1991, as such<\/p>\n<p>petitioner has to file C.W.J.C. No.10387 of 1992 in the<\/p>\n<p>High Court for a direction to the respondents to issue<\/p>\n<p>appointment letter in his favour. The writ application was<\/p>\n<p>disposed of with an observation that in the event their<\/p>\n<p>exists any vacancy and if the State thinks to fill up those<\/p>\n<p>vacancies, the case of the petitioner shall be considered on<\/p>\n<p>its merit, alongwith other eligible candidates, in terms of<\/p>\n<p>aforementioned rules i.e. Bihar National Secondary<\/p>\n<p>Education Rule-1983. The direction was also there to<\/p>\n<p>consider the case of the petitioner sympathitically, giving<\/p>\n<p>relaxation of age. In the light of the observation\/direction<\/p>\n<p>issued in the writ application the Regional Deputy<\/p>\n<p>Director of Education made a correspondence with the<\/p>\n<p>Director Secondary Education regarding re-appointmnent<\/p>\n<p>of the petitioner as a retrenched employee. The Director<\/p>\n<p>Secondary Education, vide letter contained in memo no.<\/p>\n<p>417 dated 29.6.1993, directed for re-appointment of the<\/p>\n<p>petitioner, as a special case, against any available<\/p>\n<p>sanctioned vacancy in any of the offices of Human<\/p>\n<p>Resources Development Department or in any educational<\/p>\n<p>institution in the District. It was also specificaly mentioned<br \/>\n<span class=\"hidden_text\">                    4<\/span><\/p>\n<p>in this letter that the petitioner&#8217;s appointment will not be<\/p>\n<p>considered as a precedence and his previous service will<\/p>\n<p>not be counted for the continuity in service, and no<\/p>\n<p>benefits accruing from the previous appointment will be<\/p>\n<p>available to the petitioner. In the light of the direction of<\/p>\n<p>the   Director,   Primary     Secondary     Education,    an<\/p>\n<p>appointment letter was issued in favour of the petitioner<\/p>\n<p>and he joined in the office of Sub-divisional Education<\/p>\n<p>Officer, Birpur, Supaul. The post on which the petitioner<\/p>\n<p>joined was a sanctioned post and it was vacant.<\/p>\n<p>         4. Records connected with the appointment of<\/p>\n<p>petitioner has been produced by the counsel apearing for<\/p>\n<p>State, a letter issued by Regional Deputy Director, Saharsa<\/p>\n<p>is the part of this record from which it transpires that<\/p>\n<p>payment of salary started to the petitioner, subsequent to<\/p>\n<p>the inquiry and verification of the legality of the<\/p>\n<p>petitioner&#8217;s appointment and     only on approval by the<\/p>\n<p>Director (Secondary) Education.. Petitioner, thereafter,<\/p>\n<p>continued on his post till 1997. The then Director<\/p>\n<p>(Secondary) Education, while examining the genuiness<\/p>\n<p>and legality of the appointment of another person also<\/p>\n<p>examined the legality of petitioner&#8217;s appointment and<br \/>\n<span class=\"hidden_text\">                    5<\/span><\/p>\n<p>found that his appointment had been made on the post of<\/p>\n<p>clerk in Sub-divisional Education Office, Birpur, without<\/p>\n<p>following the proper prescribed procedure of appointment.<\/p>\n<p>As the prescribed procedure of appointment in the circular<\/p>\n<p>of Personal and Administrative Reforms Department had<\/p>\n<p>not been followed, as such treating the appointment as<\/p>\n<p>illegal, petitioner was terminated from his service, even<\/p>\n<p>without issuing any show cause notice. The termination<\/p>\n<p>order also challenged by the petitioner in C.W.J.C. No.<\/p>\n<p>2541 of 1997, and the termination order was quashed vide<\/p>\n<p>order dated 23.10.1997. The respondents were directed to<\/p>\n<p>pass fresh order after a show cause notice to the petitioner.<\/p>\n<p>The show cause notice was issued to the petitioner in the<\/p>\n<p>light of the order passed in the writ applicaton and<\/p>\n<p>thereafter the final order was passed, challenging which,<\/p>\n<p>present writ application has been filed.\n<\/p>\n<p>         5. A counter affidavit filed on behalf of the State<\/p>\n<p>is specific on this point that since the procedure prescribed<\/p>\n<p>in the Personal and Administrative Reforms Department<\/p>\n<p>circular was not followed in the appointment of the<\/p>\n<p>petitioner as such his appointment was illegal. The<\/p>\n<p>procedure as laid down in the Personal and Administrative<br \/>\n<span class=\"hidden_text\">                   6<\/span><\/p>\n<p>Reforms Department letter no. 16441 dated 3.12.1980 is<\/p>\n<p>that the vacancies must be advertised, panel be prepared,<\/p>\n<p>following the rule of reservation only appointment letters<\/p>\n<p>can be issued against the post advertised. Since, the<\/p>\n<p>petitioner was appointed without following the procedure,<\/p>\n<p>it was an illegal appointment and termination order passed.<\/p>\n<p>        6. Counsel for the petitioner, on the other hand,<\/p>\n<p>submits that so far circular contained in letter no. 16441<\/p>\n<p>dated 6.12.1980 of Personal and Administrative Reforms<\/p>\n<p>Department is concerned, that has no application in the<\/p>\n<p>matters of appointment, in the Regional offices of the<\/p>\n<p>Education    Department      for    valid   appointments.<\/p>\n<p>Appointments in the Regional offices of Education<\/p>\n<p>Department has to be made following the statutory rules<\/p>\n<p>framed by the State Government. The Rule prescribed that<\/p>\n<p>a committee will be constituted under the statutory rules,<\/p>\n<p>and on recommendation of such committee, appointment<\/p>\n<p>is to be made. In the case of petitioner, admittedly the<\/p>\n<p>Regional    Level     Establishment     Committee      had<\/p>\n<p>recommended for issuance of appointment letter in favour<\/p>\n<p>of the petitioner as well as others. They were interviewed<\/p>\n<p>and subsequently as per the direction of the Director<br \/>\n<span class=\"hidden_text\">                     7<\/span><\/p>\n<p>Secondary Education appointment letter was issued in<\/p>\n<p>favour of the petitioner. Counsel for the petitioner further<\/p>\n<p>submits that there is nothing to show that the appointment<\/p>\n<p>letter issued in favour of the petitioner was a forged letter.<\/p>\n<p>It is also not the case of the respondent that existing<\/p>\n<p>vacancies were not available, and petitioners were not<\/p>\n<p>interviewed. An advertisement was issued at the instance<\/p>\n<p>of the Regional Deputy Director candidates were<\/p>\n<p>interviewed by Establishment Committee, and resolution<\/p>\n<p>had been taken for issuing necessary orders for<\/p>\n<p>appointment of interviewed candidates. Since it was not<\/p>\n<p>done, the petitioner moved before the High Court and the<\/p>\n<p>writ application was disposed of with an observation that<\/p>\n<p>the case of the petitioner should be considered<\/p>\n<p>compoassionately. That compassion was shown by the<\/p>\n<p>Director (Secondary) Education and as per his direction<\/p>\n<p>his   appointment       letter   had   been     issued.   In   this<\/p>\n<p>circumstance, there was no reason for holding that<\/p>\n<p>petitioner   was    appointed      illegally,    as   procedures<\/p>\n<p>mentioned in the circular of Personal and Administrative<\/p>\n<p>Reforms Department were not observed.. This circular has<\/p>\n<p>no application in appointments in the Regional Office of<br \/>\n<span class=\"hidden_text\">                   8<\/span><\/p>\n<p>the Education Department.\n<\/p>\n<p>         7. The petitioner has also alleged discrimination<\/p>\n<p>on the ground that vide Annexure-16 petitioner as well as<\/p>\n<p>Pancham Singh both were directed to be terminated from<\/p>\n<p>the post of clerks. Petitioner and Pancham Singh both<\/p>\n<p>challenged the termination order. Termination order of<\/p>\n<p>Pancham Singh was quashed and he was re-instated on his<\/p>\n<p>post. He died in harness and after the death of Pancham<\/p>\n<p>Singh, his son was appointed on compassionate ground.<\/p>\n<p>Since, Pancham Singh was reinstated, there was no reason<\/p>\n<p>for coming to a different conclusion in the case of the<\/p>\n<p>petitioner.\n<\/p>\n<p>         8. I find that procedure for legal appointment had<\/p>\n<p>been followed halfway in the case of the petitioner.<\/p>\n<p>However, there is nothing to show that any panel was<\/p>\n<p>prepared, subsequent to the interview, but petitioner was<\/p>\n<p>appointed as a special case by the Director Secondary<\/p>\n<p>Education, in the light of the observation made in the writ<\/p>\n<p>application. In this circumstance, after remaining of<\/p>\n<p>service for so many years, there was no reason for<\/p>\n<p>terminating the petitioner from his post. Petitioner is also<\/p>\n<p>entitled for similar treatment as given to a similarly<br \/>\n<span class=\"hidden_text\">                              9<\/span><\/p>\n<p>          situated employee Pancham Singh. That aspect was also<\/p>\n<p>          not considered by the respondents while issuing of<\/p>\n<p>          termination order against the petitioner.<\/p>\n<p>                   9. For all these reasons, I find that the impugned<\/p>\n<p>          order contained in Annexure-30 issued by the Director<\/p>\n<p>          Primary Secondary Education contained in memo no.394<\/p>\n<p>          dated 6.3.2006 is quashed.\n<\/p>\n<p>                   10. This writ application is allowed.
