In the present application under Section 401 Cr.P.C.\n           challenge has been made to an order dated 1.11.2010 passed in\n           C.M.C. No. 214 of 2010 passed by the learned S.D.J.M., Keonjhar, by\n           which order an application filed under Section 457 Cr.P.C. filed by the\n           petitioner for and on behalf of Ashok Transport as its power of\n           attorney holder came to be rejected, inter alia, on a finding that, while\n           the Bus bearing temporary Registration No. KA-25TC-1054 involved in\n                                     2\n\n\n\nthe accident and release of the vehicle sought for belongs to the TATA\nMotors Limited, the power of attorney filed by the petitioner was not by\nTATA Motors Limited, but by Ashok Transport, who was not the owner\nof the vehicle in question.\n           Mr. Nayak, learned counsel for the petitioner placed reliance\non a \"Transportation Agreement\" entered into by Ashok Transport\nwith TATA Motors Limited, interms of which the vehicle in question\nwas being transported from Dharward in the State of Karnataka to\nRSO Kharagpur in the State of West Bengal on the basis of a Stock\nTransfer Memo (Annexure-1) and while the said vehicle was\nproceeding through Orissa at Keonjhar met with an accident leading\nto the death of a person who was travelling on the road.\n           Learned counsel for the petitioner also laysstress on various\nclauses of the said \"Transportation Agreement\" including Clauses (i),\n(k) and (n) to establish the fact that the petitioner who is the power of\nattorney     holder   of   Ashok   Transport,     the      signatory   to    the\nTransportation Agreement with the TATA Motors Limited was\nendowed with the responsibility of transporting of the vehicle of TATA\nMotors from various locations to their various dealers located\nthroughout     the    country.   Stress   is   laid   on    the   contents    of\nparagraph-'n' of the Transportation Agreement, which is quoted\nbelow:-\n                         \" If the vehicles entrusted to you for the\n                  transportation are not delivered at the\n                  prescribed destinations, for any reason\n                  whatsoever, and you are not able to account for\n                  the same, you shall be liable to compensate us,\n                  without delay or demur, in respect of the\n                  vehicles to undelivered and unaccounted for.\n                  The said compensation shall include the value\n                  of the said vehicles (i.e. the value-at which said\n                  vehicle would have been sold by us to our\n                  customers, had they been delivered at the\n                                 3\n\n\n\n               destination) together with interest at the rate of\n               18% per annum on the value of the said\n               vehicles and the interest shall be for the period\n               commencing from the date on which the said\n               vehicles would have normally been delivered at\n               the destinations, till such date on which the\n               compensations paid to us.\"\n\n        A copy of the seizure list is also submitted by the learned\ncounsel for the petitioner in Court today. From which it appears that\nthe vehicle was seized from the custody of a driver who was employed\nby Ashok Transport. Apart from the above, learned counsel for the\npetitioner placed reliance on a judgment of the Hon'ble Supreme\nCourt in the case of <a href=\"\/doc\/1298786\/\">General Insurance Council and others v. State\nof Andhra Pradesh and others<\/a>, reported in (2010) 6 Supreme Court\nCases   768,   wherein   the   Hon'ble   Supreme    Court   took    into\nconsideration various earlier judgments passed by the Hon'ble\nSupreme Court and ultimately keeping in view the general public\ninterest directed in paragraph-14, as under:-\n                        \" It is a matter of common knowledge\n               that as and when vehicles are seized and kept\n               in various police stations, not only do they\n               occupy substantial space in the police stations\n               but upon being kept in open , are also prone to\n               fast natural decay on account of weather\n               conditions. Even a good maintained vehicle\n               loses its roadworthiness if it is kept stationary\n               in the police station for more than fifteen days.\n               Apart from the above, it is also a matter of\n               common knowledge that several valuable and\n               costly parts of the said vehicle are either stolen\n               or are cannibalized so that the vehicle becomes\n               unworthy of being driven on road. To avoid all\n               this, apart from the aforesaid directions issued\n               hereby above, we direct that all the State\n               Governments\/Union          Territories\/ Director\n               General of Police shall ensure macro\n               implementation of the statutory provisions and\n               further direct that the activities of each and\n                                  4\n\n\n\n              every police station, especially with regard to\n              disposal of the seized vehicle be taken care of\n              by the Inspector General of Police of the\n              division\/Commissioner of Police concerned of\n              the cities\/Superintendent of Police concerned of\n              the district concerned.\"\n        Considering the nature of submission made and after\nhearing the learned counsel for the State, I have also perused the\nimpugned order. Section 457(1) of the Code of Criminal Procedure,\n1973 is quoted herein below:-\n                       \"Procedure by police upon seizure of\n                property.-(1) Whenever the seizure of property\n                by any police officer is reported to a Magistrate\n                under the provisions of this Code, and such\n                property is not produced before a Criminal\n                Court during an inquiry or trial, the Magistrate\n                may make such order as he thinks fit\n                respecting the disposal of such property or the\n                delivery of such property to the person entitled\n                to the possession thereof, or if such person\n                cannot be ascertained, respecting the custody\n                and production of such property.\"\n\n        In terms of the said provision of the Code of Criminal\nProcedure, 1973, the Magistrate is authorized to direct delivery of the\nproperty seized to \"the person entitled to the possession thereof\". In\nthe case at hand since the vehicle in question belonging to TATA\nMotors Limited had been handed over to the possession of Ashok\nTransport for the purpose of transporting the said vehicle to its dealer\nlocated at Kharagpur in the State of West Bengal, there cannot be\nany doubt that Ashok Transport was in lawful possession of the\nvehicle in question at the time when the accident took place and the\nvehicle was seized by the police authority from a driver who was\nworking for Ashok Transport. From the impugned order it clearly\nappears that the power of attorney holder, who has filed the present\npetition had field a power of attorney in his favour to move such an\n                                 5\n\n\n\napplication under Section 457 Cr.P.C. by Ashok Transport and the\nsaid power of attorney holder was the lawful attorney for prosecuting\nthe case on behalf of the lawful possessor of the vehicle, on date the\naccident occurred, I am of the considered view that the prayer made\nby the petitioner ought to be allowed in his favour by quashing the\norder dated 1.11.2010 passed by the learned SDJM, Keonjhar in\nCMC No. 214 of 2010 arising out of G.R.
