              Heard learned counsel for the parties.<\/p>\n
              Admittedly, a loan amounting to Rs.2,30,000\/-<\/p>\n
was    sanctioned      in       favor    of      late   Bhoma    Ram    by   the<\/p>\n
respondent Bank on 24.10.1997 and at that time late<\/p>\n
Bhoma Ram mortgaged his agriculture land measuring 19<\/p>\n
bighas and two biswas situated in Chak 22 H.M.H.                             Out<\/p>\n
of the total loan amount, an amount of Rs.1,90,000\/-<\/p>\n
was    as    tractor    loan       and       Rs.40,000\/-        was    for   the<\/p>\n
purpose of crop loan.              The loan amount was to be paid<\/p>\n
in    installments         as     per    the      agreement      entered      in<\/p>\n
between late Bhoma Ram and respondent Bank.<\/p>\n
              As per petitioners, late Bhoma Ram was having<\/p>\n
only two daughters namely Vidhya Devi and Noja Devi.<\/p>\n
Vidhya Devi was married to Shri Lalu Ram and she is<\/p>\n
having      four    sons    named        Puran      Ram,   Chandra       Mohan,
\n                                   2<\/span><\/p>\n
Dhaukal Ram and Jaipal.           After death of late Bhoma<\/p>\n
Ram, a family dispute arose in between the parties<\/p>\n
with regard to partition of agricultural land which is<\/p>\n
said    to    be    mortgaged   with        the   respondent    Bank.<\/p>\n
Ultimately,        the said dispute was settled as per the<\/p>\n
petitioners in the Court of Sub Divisional Magistrate<\/p>\n
Hanumangarh.\n<\/p>\n<\/p>\n
              The respondent Bank initiated proceedings for<\/p>\n
recovery of outstanding loan amount of Rs.3,65,665 and<\/p>\n
for that purpose, the movable and immovable property<\/p>\n
of late Bhoma Ram was to be auctioned.                The petitioner<\/p>\n
No.1 has filed an application before the respondent<\/p>\n
Bank in which it is prayed that he is ready to deposit<\/p>\n
the entire outstanding amount.              The petitioner No.1 in<\/p>\n
Annexure-7 categorically stated that he is ready to<\/p>\n
deposit Rs.2,20,000 as one time payment and matter may<\/p>\n
be negotiated.\n<\/p>\n<\/p>\n
              In this view of the matter, it is obvious<\/p>\n
that    the   petitioner   No.1       was   ready    to   deposit   the<\/p>\n
amount of Rs.2,20,000\/- as one time settlement of the<\/p>\n
outstanding of late Bhoma Ram.              Now, in this case, he<\/p>\n
is raising a different dispute with regard to recovery<\/p>\n
against the respondent No.4 and 5.                It is very strange<\/p>\n
that on one hand, the petitioner filed an application<\/p>\n
for one time settlement and made prayer that he is<\/p>\n
ready    to   deposit   outstanding         amount   raised    against<\/p>\n
late Bhoma Ram with regard to his loan and here in
\n                                        3<\/span><\/p>\n
this case, he is raising dispute that recovery should<\/p>\n
be    made   not    only       from   him   but     from      all    the   four<\/p>\n
brothers including petitioners and respondent Nos. 4<\/p>\n
and 5.\n<\/p>\n<\/p>\n
              In my opinion, when the petitioner No.1 has<\/p>\n
filed application before the respondent Bank for One<\/p>\n
Time Settlement then now he cannot raise any other<\/p>\n
ground.      More so, if he has any dispute with regard to<\/p>\n
interest and exemption under the One Time Settlement<\/p>\n
Scheme so regulated by Central Government, then, he is<\/p>\n
required to file representation before the respondent<\/p>\n
Bank.\n<\/p>\n<\/p>\n
              In    this       view   of    the     matter,         this   writ<\/p>\n
petition is disposed of with the direction that the<\/p>\n
petitioner         may     file       representation           before       the<\/p>\n
concerned Bank within a period of one month from today<\/p>\n
and   raise     all      his   grounds.       Upon       filing      the   said<\/p>\n
representation,          the    respondent        Bank   is    directed      to<\/p>\n
decide the same in accordance with Scheme framed by<\/p>\n
the Central Government within a one month from the<\/p>\n
date of filing representation.                It is also made clear<\/p>\n
that in case any adverse order is passed by the Bank<\/p>\n
against the petitioners then the petitioners will be<\/p>\n
at liberty to take recourse of law.                      It is also made<\/p>\n
clear    that      the   property     in    question       was      originally<\/p>\n
belonging to late Bhoma Ram and the said property was<\/p>\n
mortgaged with the respondent Bank, therefore, for the
\n                                          4<\/span><\/p>\n
       purpose of recovery the respondent Bank is well within<\/p>\n
       its   jurisdiction        to    recovery     the        amount        after<\/p>\n
       auctioning    the    said      property.        However,         if    the<\/p>\n
       petitioner Nos.1 and 2 and respondent Nos. 4 and 5,<\/p>\n
       who are legal representatives of late Bhoma Ram, are<\/p>\n
       ready to deposit the amount then the matter may be<\/p>\n
       decided sympathetically by the respondent Bank after<\/p>\n
       considering   the     Scheme     so    framed      by    the     Central<\/p>\n
       Government.\n<\/p>\n<\/p>\n
                 With      the     aforesaid      observation\/direction,<\/p>\n
       this writ petition is disposed of.\n<\/p>\n<\/p>\n
