THE SUB-DIVISIONAL OFFICER, KAHALGAON, BHAGALPUR\n                            -----------\n<\/pre>\n<p>2   9.12.2010                    After having heard learned counsel for the<\/p>\n<p>                petitioner and learned counsel for the State including I.A. No.<\/p>\n<p>                10083 of 2010, this Court is of the considered opinion that the<\/p>\n<p>                matter can be disposed of finally at this juncture itself looking at<\/p>\n<p>                the nature of the dispute which has been raised by learned counsel<\/p>\n<p>                for the petitioner.\n<\/p>\n<p>                                 First contention of the petitioner is that his service<\/p>\n<p>                has been terminated pursuant to the decision given by the District<\/p>\n<p>                Employment Appellate Authority in terms of annexure-6 without<\/p>\n<p>                holding or declaring in any manner the appointment of the wife of<\/p>\n<p>                the petitioner was in any manner illegal.\n<\/p>\n<p>                                 Petitioner&#8217;s wife was appointed as Panchayat<\/p>\n<p>                Shikshak and on her death, the present petitioner got benefit of<\/p>\n<p>                compassionate appointment. Since no finding has been given<\/p>\n<p>                therefore he could not be terminated.\n<\/p>\n<p>                                 Second objection taken is that the Appellate<\/p>\n<p>                Authority has no jurisdiction to exercise power in absence of any<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>      decision having been taken by the Block Development Officer in<\/p>\n<p>      relation to the employment in question because the forum is of<\/p>\n<p>      appeal having appellate jurisdiction.\n<\/p>\n<p>                      In the opinion of this Court both the issues can be<\/p>\n<p>      looked into by the Appellate Authority if the petitioner moves the<\/p>\n<p>      Appellate Authority by virtue of the order of this Court. To some<\/p>\n<p>      extent the petitioner is correct in saying that there is no discussion<\/p>\n<p>      with regard to the appointment of his wife and therefore he could<\/p>\n<p>      not be condemned unheard or any finding having been recorded<\/p>\n<p>      with regard to the validity of such appointment.<\/p>\n<p>                      This Court intentionally refrains from recording<\/p>\n<p>      any opinion on the merit of the order dated 9.6.2010 in view of the<\/p>\n<p>      fact that the issue is being remanded back.\n<\/p>\n<p>                      If the petitioner moves the Appellate Authority, the<\/p>\n<p>      Appellate Authority will render its opinion in relation to the<\/p>\n<p>      appointment of the wife of the petitioner as well as the question of<\/p>\n<p>      law having been raised that in absence of any adjudication by the<\/p>\n<p>      B.D.O. the Appellate Authority has no jurisdiction to exercise.<\/p>\n<p>      The Court expects an early decision in this regard.<\/p>\n<p>                      This writ application is disposed of with the above<\/p>\n<p>      direction.\n<\/p>\n<\/p>\n<pre>RPS                  (Ajay Kumar Tripathi,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajan Kumar vs The State Of Bihar &amp;Amp; Ors on 9 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.12006 of 2010 1.
