Joseph, J.\n<\/p>\n<\/p>\n<p>      Petitioner seeks police protection. Briefly put, the case of<\/p>\n<p>the petitioner is as follows:\n<\/p>\n<p>      Petitioner is the General Manager of a three star bar<\/p>\n<p>attached hotel located near Irumpanam junction at Tripunithura.<\/p>\n<p>It is stated that about fifty persons are now regularly working in<\/p>\n<p>the hotel. On 11.11.2009, the dead body of a person by name<\/p>\n<p>Roy, was found outside the hotel compound.                         The first<\/p>\n<p>respondent after completing all legal formalities, obtained the<\/p>\n<p>post-mortem certificate from the Doctor which says that the<\/p>\n<p>death of Roy was the result of cardiac arrest. After a few days,<\/p>\n<p>certain people under the leadership of respondents 2 to 4<\/p>\n<p>approached the petitioner and demanded compensation for the<\/p>\n<p>death of Roy, saying that the death of Roy was a homicide and<\/p>\n<p>the hotel people are responsible for the murder. Petitioner has<\/p>\n<p><span class=\"hidden_text\">WPC.37552\/09 L                      2<\/span><\/p>\n<p>denied the same. They threatened the petitioner that they will<\/p>\n<p>start agitation in front of the hotel. They also conducted a press<\/p>\n<p>meeting. Ext.P1 is the photo copy of the press report. It is<\/p>\n<p>stated that they have conducted dharna on 20.12.2009.<\/p>\n<p>      2. A Counter Affidavit is filed by respondents 2 to 4.<\/p>\n<p>Therein, it is, inter alia, stated as follows:<\/p>\n<p>      On 10.11.2009, a person by name Roy, who is a native of<\/p>\n<p>Thiruvankulam Panchayat went to the hotel in which the<\/p>\n<p>petitioner is the Manager, along with his friends.          They<\/p>\n<p>consumed liquor from the bar and finally when the bill was<\/p>\n<p>given, the money which they had, was found insufficient.<\/p>\n<p>Hence Roy remained in the hotel and the other persons went out<\/p>\n<p>to bring money for payment of the bill amount. There was a<\/p>\n<p>quarrel and Roy attempted to run out of the hotel. It is further<\/p>\n<p>alleged that Roy was manhandled and he sustained bodily<\/p>\n<p>injuries and he succumbed.\n<\/p>\n<p>      3. We heard the learned counsel for the petitioner and the<\/p>\n<p>learned counsel appearing for the party respondents as also the<\/p>\n<p>learned Government Pleader. Learned counsel for the party<\/p>\n<p><span class=\"hidden_text\">WPC.37552\/09 L                    3<\/span><\/p>\n<p>respondents submits that under the cover of the interim order,<\/p>\n<p>the investigation into the circumstances leading to the death of<\/p>\n<p>Roy is being held up. Learned counsel for the petitioner submits<\/p>\n<p>that the petitioner is willing to co-operate with the investigation.<\/p>\n<p>      4. While respondents 2 to 4 may agitate, it cannot block<\/p>\n<p>the ingress and egress of the management and the staff or the<\/p>\n<p>customers.     Accordingly, we make the interim order dated<\/p>\n<p>23.12.2009 absolute. However, we make it crystal clear that this<\/p>\n<p>Judgment shall not be used as a reason to stop the investigation<\/p>\n<p>going on into the death of Roy.\n<\/p>\n<p>      The Writ Petition is disposed of as above.\n<\/p>\n<p>                                                    Sd\/=<br \/>\n                                                K.M.
