SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>Present<br \/>\n\tCriminal Revision Application has been preferred by the petitioner\n<\/p>\n<p>\t &#8211; original complainant to quash and set aside the impugned<br \/>\n\torder dtd.22\/2\/2011 passed by the learned Additional City Civil<br \/>\n\tJudge, Court No.7, Ahmedabad in Criminal Misc.Application No.280 of<br \/>\n\t2011 by which the learned Judge has rejected the application<br \/>\n\tsubmitted by the petitioner<br \/>\n\tfor condonation of delay caused in preferring the Appeal against the<br \/>\n\tjudgement and order passed by the learned trial court acquitting<br \/>\n\tthe accused persons.\n<\/p>\n<p>Having<br \/>\n\theard Ms.Snehal Patel, learned<br \/>\n\tadvocate appearing for Mr.Mitul Desai, learned advocate<br \/>\n\tappearing on behalf of the petitioner,<br \/>\n\tMr.Mrudul Barot, learned advocate appearing on behalf of the<br \/>\n\trespondent Nos.1 to 5 and Mr.LB Dabhi, learned Additional Public<br \/>\n\tProsecutor for the respondent No.6 and considering the impugned<br \/>\n\torder passed by the learned Judge, it appears that the impugned<br \/>\n\torder passed by the learned appellate court in not condoning the<br \/>\n\tdelay is absolutely unreasoned and non-speaking order and no reasons<br \/>\n\thave been assigned by the learned Judge in not condoning the delay.<br \/>\n\tExcept narrating the submissions made on behalf of the respective<br \/>\n\tparties in para 1 to 5, no reasons have been assigned and only in<br \/>\n\tsix lines, the impugned order has been passed which cannot sustain.<br \/>\n\tUnder the circumstances, without further entering into the merits of<br \/>\n\tthe case, the impugned order passed by the appellate court in<br \/>\n\tCriminal Misc. Application submitted by the petitioner<br \/>\n\tfor condonation of delay deserves to be quashed and set aside and<br \/>\n\tthe matter is required to be remanded to the learned appellate court<br \/>\n\tfor deciding the said application afresh in accordance with law and<br \/>\n\ton merits and to pass a speaking reasoned order.\n<\/p>\n<p>In<br \/>\n\tview of the above, present Criminal Revision Application succeeds.<br \/>\n\tThe impugned order dtd.22\/2\/2011 passed by the learned Additional<br \/>\n\tCity Civil Judge, Court No.7, Ahmedabad in Criminal Misc.Application<br \/>\n\tNo.280 of 2011 in not condoning the delay is hereby quashed and set<br \/>\n\taside and the matter is remanded to the appellate court for deciding<br \/>\n\tthe said application afresh in accordance with law and on merits and<br \/>\n\tto pass a speaking reasoned order.
