JUSTICE ATUL KUMAR JAIN\n\nMr. MK Garg, for the applicant\nMr. JPS Choudhary, Public Prosecutor\n                               ...\n\nBY THE COURT :<\/pre>\n<p>     While pressing this application, it is submitted by learned<\/p>\n<p>counsel that the applicant is behind bars since 13.6.2008. It is<\/p>\n<p>pointed out that as a matter of fact some dispute was already<\/p>\n<p>existing between the parties with regard to a piece of a land.<\/p>\n<p>According to learned counsel all other accused persons except<\/p>\n<p>the present applicant are availing suspension of sentence. It is<\/p>\n<p>also pointed out that as per the ocular evidence available on<\/p>\n<p>record, the applicant was said to be armed with &#8216;barchi&#8217; but a<\/p>\n<p>&#8216;gandasi&#8217; has been recovered at his instance.<\/p>\n<p>     While opposing the application, it is submitted by learned<\/p>\n<p>Public Prosecutor that the case of the present applicant cannot<br \/>\n                                      [2]<\/p>\n<p>be compared with the other co-accused persons as the fatal<\/p>\n<p>head injury is assigned to the present applicant.<\/p>\n<p>     Heard learned counsel for the applicant, learned Public<\/p>\n<p>Prosecutor and also examined the record. True it is, the fatal<\/p>\n<p>head injury is assigned to the present applicant but it is also<\/p>\n<p>relevant to notice thats as per the FIR one Kanhiya Lal, who was<\/p>\n<p>not charge-sheeted too caused injury on the head of deceased.<\/p>\n<p>Besides that, one head injury has also been assigned to<\/p>\n<p>co-accused Bulkesh.\n<\/p>\n<\/p>\n<p>     Having considered all these facts, specially by taking into<\/p>\n<p>consideration the fact that the applicant is behind bar since<\/p>\n<p>13.6.2008, we are inclined to grant this application.<\/p>\n<p>     Accordingly,      this    application    seeking       suspension    of<\/p>\n<p>sentence is allowed and it ordered that that the sentence passed<\/p>\n<p>by learned Special Judge, SC\/ST (Prevention of Atrocities) Act<\/p>\n<p>Cases,      Churu    vide   judgment       dated   12.12.2013        against<\/p>\n<p>applicant    Nathu    Ram     S\/o.   Hanuman       Prasad    shall   remain<\/p>\n<p>suspended till final disposal of aforesaid criminal appeal provided<\/p>\n<p>he executes two sureties in a sum of Rs.25,000\/- each and a<\/p>\n<p>personal bond in a sum of Rs.50,000\/- to the satisfaction of<\/p>\n<p>learned trial court for his appearance in this Court on 28.1.2015<\/p>\n<p>and subsequently before          the trial court on the following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>                                          [3]<\/p>\n<\/blockquote>\n<blockquote><p>         1. That he will appear before the trial court in the month of<br \/>\n         January every year till the appeal is decided.<\/p>\n<\/blockquote>\n<blockquote><p>         2. That if the appellant changes his place of residence, he will<br \/>\n         give the changed address in writing to the trial court, High Court<br \/>\n         as well as to his counsel in the High Court.\n<\/p><\/blockquote>\n<blockquote><p>         3. Similarly if sureties change his\/her\/their address, they will<br \/>\n         give in writing his\/her\/their changed address to the trial court.<\/p>\n<\/blockquote>\n<blockquote><p>               The learned trial court shall keep the record of attendance<\/p>\n<p>         of the accused appellant in a separate file.         Such file be<\/p>\n<p>         registered as Criminal Misc. Case related to the Sessions Case in<\/p>\n<p>         which the accused appellant was tried and convicted.     A copy of<\/p>\n<p>         this order shall also be placed in that file for ready reference.<\/p>\n<p>         Criminal misc. file shall not be taken into account for statistical<\/p>\n<p>         purpose relating to pendency and disposal of cases in the trial<\/p>\n<p>         court. In case the said accused appellant does not appear before<\/p>\n<p>         the trial court, the learned trial judge shall report the matter to<\/p>\n<p>         the High Court for cancellation of bail.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<pre>         [ATUL KUMAR JAIN], J.
