It was the prosecution case that because of the<br \/>\nharassment meted out to said Baljit Kaur, she consumed poison<br \/>\non the intervening night of 27th and 28th January, 1992 and died<br \/>\nat about 4 a.m. in Ismailpur village within the jurisdiction of<br \/>\nPolice Station Thaska Miranji in Kurukshetra district. The<br \/>\ninformation of death of Baljit Kaur was conveyed to her family<br \/>\non the said morning by one Dewa (not examined). On receipt of<br \/>\nthe said information, her family members including her brother<br \/>\nHari Chand PW-6 went to the village where Baljit Kaur&#8217;s in-<br \/>\nlaws were residing and PW-6 having come to the conclusion<br \/>\nthat his sister had died under suspicious circumstances, lodged<br \/>\na complaint with Thaska Miranji P.S. on 28.1.1992 at about<br \/>\n12.40 p.m. The initial investigation in regard to the death of<br \/>\nBaljit Kaur was conducted by PW-10 which was later<br \/>\ncompleted by Sub-Inspector of Police who was examined as<br \/>\nPW-9 who submitted the chargesheet for the offence stated<br \/>\nhereinabove and after trial the Sessions Court came to the<br \/>\nconclusion that the prosecution has established its case as<br \/>\nagainst all the accused and it awarded 10 years&#8217; RI to A-2<br \/>\nBasawa Singh who was the father-in-law of the deceased, while<br \/>\nA-3 Shanti Devi, mother-in-law, was awarded 8 years&#8217; RI and<br \/>\nA-4 Surinder Kaur and A-5 Rajvinder Kaur were awarded 7<br \/>\nyears&#8217; RI each  all under section 304B IPC while A-1 Surinder<br \/>\nKumar, the husband of the deceased was awarded life<br \/>\nimprisonment under section 304B IPC.\n<\/p>\n<p>\tAggrieved accused persons preferred an appeal before<br \/>\nthe High Court of Punjab &amp; Haryana at Chandigarh which by<br \/>\nthe impugned judgment confirmed the conviction and sentence<br \/>\nawarded to A-1 Surinder Kumar, husband and A-4 and A-5<br \/>\nSurinder Kaur and Rajwinder Kaur, the sisters-in-law of the<br \/>\ndeceased. It allowed the appeal of A-2 Basawa Singh, the<br \/>\nfather-in-law and A-3 Shanti Devi, the mother-in-law of the<br \/>\ndeceased and acquitted them of the charges.\n<\/p>\n<p>\tThe present appeal before us is preferred by A-3<br \/>\nRajwinder Kaur and A-4 Surinder Kaur who, at the time of the<br \/>\nincident, were aged 18 and 16 years respectively and were<br \/>\nunmarried. We are told at the Bar that their brother Surinder<br \/>\nKumar, the husband of the deceased has not preferred any<br \/>\nappeal, hence, the conviction and sentence imposed on him by<br \/>\nthe two courts below has attained finality.\n<\/p>\n<p>\tMr. K.B. Sinha, learned senior counsel appearing for the<br \/>\nappellants, contended that both the courts below have<br \/>\ncommitted serious error in accepting the prosecution case as<br \/>\nagainst the appellants herein though no specific allegation<br \/>\nwhatsoever has been made by the prosecution against them. He<br \/>\npointed out that the only allegation found against these<br \/>\nappellants is in a general manner in the FIR filed by PW-6 and<br \/>\nin the evidence of PWs.-6 and 7 in their examinations-in-chief<br \/>\nwhich the learned counsel submitted under no stretch of<br \/>\nimagination could be construed as sufficient evidence to base a<br \/>\nconviction. He submitted that one of the ingredients necessary<br \/>\nfor establishing the allegation of harassment against an accused<br \/>\nperson under section 304B is that the concerned accused had<br \/>\nharassed the victim soon before the death.\n<\/p>\n<p>After reading the evidence of PWs.6 and 7 in conjunction<br \/>\nwith the contents of the FIR, the learned counsel pointed out<br \/>\nthat so far as the allegation against these appellants are<br \/>\nconcerned, it is omnibus in nature and has been made without<br \/>\nany specific instance only to involve the entire family of the<br \/>\nappellants. He pointed out that the appellants who were then 18<br \/>\nand 16 years of age and unmarried, could not have gone to the<br \/>\nextent of causing such harassment which would compel the<br \/>\ndeceased to commit suicide. At any rate the learned counsel<br \/>\npointed out that whatever allegation that is found in the FIR and<br \/>\nin the evidence of PWs.6 &amp; 7, could only relate to a period<br \/>\nimmediately after the marriage of deceased to A-1 which was<br \/>\nabout 2 = years prior to the incident.\n<\/p>\n<p>\tMr. D P Singh, learned counsel appearing for the State,<br \/>\nhowever, defended the judgments of the two courts below<br \/>\ncontending that the same being a concurrent finding of fact, the<br \/>\nsame does not require any interference in this appeal. Since the<br \/>\npresent appeal is preferred by accused 4 and 5 who are the<br \/>\nsisters-in-law of the deceased, we will confine our<br \/>\nconsideration of the evidence led by the prosecution as against<br \/>\nthem only. It is noticed, as contended by learned counsel for the<br \/>\nappellants, that the complainant states that these appellants<br \/>\nalong with their brother used to harass Baljit Kaur for not<br \/>\nbringing sufficient dowry and a Maruti car. In that process they<br \/>\nused to beat the deceased. It is rather difficult to believe that<br \/>\nthese two young girls would go to the extent of beating the<br \/>\ndeceased merely based on a statement made by the brother of<br \/>\nthe deceased that too after the incident of his sister committing<br \/>\nsuicide without his evidence being corroborated in material<br \/>\nparticulars. From a perusal of the evidence of PW-6, two facts<br \/>\nemerge. One is a general allegation of harassment against the<br \/>\nmother of A-1 and the appellants herein. It is to be noted that<br \/>\nmother of A-1 who was an accused has been acquitted by the<br \/>\ncourts below solely on the ground that hers and her husband&#8217;s<br \/>\nname did not find mention in the complaint even though the<br \/>\nprosecution has alleged harassment by similar evidence as is<br \/>\navailable against the appellants. The second fact that arises out<br \/>\nof the evidence of PW-6 is that he has made specific allegations<br \/>\nagainst the husband A-1 and the father in regard to the demand<br \/>\nof Maruti car, a buffalo, Rs.25,000 just before the death of the<br \/>\ndeceased. Therefore, this factum shows that these 2 persons<br \/>\nmight have been responsible for harassment soon before the<br \/>\nvictim&#8217;s death which is one of the conditions precedent under<br \/>\nsection 304B IPC but then the High Court thought it fit to<br \/>\nacquit the father of A-1 (father-in-law of the deceased) because<br \/>\nhis name was also not mentioned in the FIR which means the<br \/>\nHigh Court did not believe the oral evidence led by the<br \/>\nprosecution in regard to him and his wife. Therefore the<br \/>\nevidence led by the prosecution should be appreciated in this<br \/>\nbackground.\n<\/p>\n<p>\tWe have noticed neither PW-6 nor PW-7 or for that<br \/>\nmatter the complaint does give the particulars of the time and<br \/>\ndate when the alleged harassment was meted out by the<br \/>\nappellants. As noticed by us hereinabove, these statements are<br \/>\nomnibus in nature. The specific allegations of harassment made<br \/>\nonly involves A-1 and his father with whose case we are not<br \/>\nconcerned now. The appellants are neither parties to the<br \/>\ndemand for a buffalo or Rs.25,000 which seems to be the<br \/>\nproximate cause of Baljit Kaur committing suicide. The courts<br \/>\nbelow in appreciating the evidence have failed to appreciate the<br \/>\nmaterial on record properly nor have they applied the required<br \/>\nstandard of proof necessary to base a conviction on the<br \/>\nappellants. We have already noticed that if at all the prosecution<br \/>\ncase against these appellants is to be accepted it would only<br \/>\nshow that soon after the marriage i.e. about 2 = years prior to<br \/>\nthe death of the deceased, there was some alleged harassment<br \/>\nfor lack of dowry which, in our opinion, is not a sufficient<br \/>\nground to hold the appellants guilty for the offence charged,<br \/>\nsince these allegations are not proximate to the death of the<br \/>\ndeceased.\n<\/p>\n<p>\tHaving perused the evidence of PW-7 also, in our<br \/>\nopinion, the same does not further the cause of the prosecution<br \/>\nany more than what is discussed by us hereinabove about the<br \/>\nevidence of PW-6. As a matter of fact, a careful consideration<br \/>\nof the evidence of PW-7 in regard to the involvement of the<br \/>\nappellants herein clearly shows that part of the evidence of PW-<br \/>\n7 is an improvement inasmuch as he has not stated the specific<br \/>\nallegations now he is making before the trial court in his<br \/>\nprevious statement to the Police as could be seen from Ex. D-8.\n<\/p>\n<p>\tIt is also be noted that the High Court on the same set of<br \/>\nevidence has chosen to acquit the mother of the appellants<br \/>\nwhose case is no better than that of the appellant. Of course, the<br \/>\nonly difference between the evidence led by the prosecution in<br \/>\nregard to their mother and the appellants is that the name of the<br \/>\nmother is not found in the FIR. That by itself in the facts of this<br \/>\ncase is not sufficient to differentiate the case of the appellants<br \/>\nfor conviction. Even the allegation made against the appellants<br \/>\nin the FIR assuming it to be proved shows certain harassment<br \/>\nmuch before the death which is not sufficient to bring home the<br \/>\nguilt under Section 304 B IPC otherwise the evidence led by the<br \/>\nprosecution is similar to that led against their mother. We agree<br \/>\nwith the High Court that the evidence against the mother is<br \/>\ninsufficient to convict her and in our opinion it is the same<br \/>\nagainst appellants.\n<\/p>\n<p>\tFor the reasons stated above, we are of the considered<br \/>\nopinion that the evidence led by the prosecution in regard to the<br \/>\ninvolvement of the appellants in the death of Baljit Kaur is not<br \/>\nproved beyond all reasonable doubts by the prosecution, hence,<br \/>\nthe courts below were in error in basing a conviction as against<br \/>\nthese appellants.\n<\/p>\n<p>\tFor the reasons stated above, this appeal succeeds and the<br \/>\nsame is allowed. The appellants are on bail.
