JAIN\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\nARISING OUT OF SPECIAL LEAVE PETITION (CRL) NO. 7578 OF 2007<\/p>\n<p>1.\t\tLeave granted.\n<\/p>\n<p>2.\t\tOn November 30, 2007 when the matter<br \/>\nwas placed for admission-hearing, this Court<br \/>\npassed the following order:\n<\/p>\n<p>     Delay condoned.\n<\/p>\n<p>\tIssue notice on the special leave<br \/>\npetition as on the application for<br \/>\nbail. Notice will state as to why the<br \/>\nspecial leave petition should not be<br \/>\ndisposed of at this stage.\n<\/p>\n<p>3.\t\tThe learned counsel for the appellant<br \/>\nsubmitted that on May 3rd, 2007, Criminal<br \/>\nAppeal No. 592-SB of 1997 was placed on Daily<br \/>\nBoard of the High Court showing them to be<br \/>\nMotion petitions. It was, therefore,<br \/>\nsubmitted that the case was not placed for<br \/>\nregular final hearing. It was, however, taken<br \/>\nup for final hearing. One Mrs. Harpreet Kaur<br \/>\nDhillon, Advocate was appointed as Amicus<br \/>\nCuriae for the accused who was heard and the<br \/>\nmatter was disposed of. The order which was<br \/>\npassed by the High Court reads as under:<br \/>\nPresent : Mrs. Ritu Punj, DAG,<br \/>\nHaryana.\n<\/p>\n<p>Mrs. Harpreet Kaur Dhillon, Advocate<br \/>\nis appointed as Amicus Curiae.\n<\/p>\n<p>Heard.\n<\/p>\n<p>Dismissed, reasons to follow.\n<\/p>\n<p>\t\t\t      (emphasis supplied)<\/p>\n<p>4.\t\tFrom the above order, passed by the<br \/>\nHigh Court in Criminal Appeal No. 592-SB of<br \/>\n1997, it was submitted by the learned counsel<br \/>\nthat Deputy Advocate General for the State of<br \/>\nHaryana was present. For the accused, Mrs.<br \/>\nHarpreet Kaur Dhillon, Advocate was appointed<br \/>\nas Amicus Curiae on that date. On the same day,<br \/>\nthe matter was dismissed and the High Court<br \/>\nstated Dismissed, reasons to follow.\n<\/p>\n<p>5.\t\tIn our opinion, the learned counsel<br \/>\nfor the appellant is right in submitting that<br \/>\nthe High Court ought not to have disposed of<br \/>\nthe appeal without recording reasons. This<br \/>\nCourt has deprecated the practice of disposing<br \/>\nof matters without recording reasons in support<br \/>\nof such decision. It has been insisted that<br \/>\nwhen the matter is decided by a Court, reasons<br \/>\nmust be recorded in support of such decision.<br \/>\nIt is because the aggrieved party may make<br \/>\ngrievance in the superior Court that the<br \/>\nreasons recorded by the trial Court were non-<br \/>\nexistent, extraneous, irrelevant, etc. The<br \/>\nsuccessful party, on the other hand, may<br \/>\nsupport the reasons recorded by the Court in<br \/>\nhis favour. Finally, the superior Court may<br \/>\nalso consider whether reasons recorded by the<br \/>\nCourt in support of the order passed by it were<br \/>\nin consonance with law and whether interference<br \/>\nis called for. If the final order is without<br \/>\nany reason, several questions may arise and it<br \/>\nwill be difficult for the parties to the<br \/>\nproceedings as well as the superior Court to<br \/>\ndecide the matter one way or the other. This<br \/>\nCourt has, therefore, deprecated the practice<br \/>\nof pronouncing final order without recording<br \/>\nreasons in support of such order.\n<\/p>\n<p>6.\t\tBefore more than two decades, in <a href=\"\/doc\/1158281\/\">State<br \/>\nof Punjab v. Jagdev Singh Talwandi,<\/a> (9184) 1<br \/>\nSCC 596, the Court said:\n<\/p>\n<p>We would like to take this<br \/>\nopportunity to point out that serious<br \/>\ndifficulties arise on account of the<br \/>\npractice increasingly adopted by the<br \/>\nHigh Courts, of pronouncing the final<br \/>\norder without a reasoned judgment. It<br \/>\nis desirable that the final order<br \/>\nwhich the High Court intends to pass<br \/>\nshould not be announced until a<br \/>\nreasoned judgment is ready for<br \/>\npronouncement. Suppose, for example,<br \/>\nthat a final order without a reasoned<br \/>\njudgment is announced by the High<br \/>\nCourt that a house shall be<br \/>\ndemolished, or that the custody of a<br \/>\nchild shall be handed over to one<br \/>\nparent as against the order, or that a<br \/>\nperson accused of a serious charge is<br \/>\nacquitted, or that a statute is<br \/>\nunconstitutional or, as in the instant<br \/>\ncase, that a detenu be released from<br \/>\ndetention. If the object of passing<br \/>\nsuch orders is to ensure speedy<br \/>\ncompliance with them, that object is<br \/>\nmore often defeated by the aggrieved<br \/>\nparty filing a special leave petition<br \/>\nin this Court against the order passed<br \/>\nby the High Court. That places this<br \/>\nCourt in a predicament because,<br \/>\nwithout the benefit of the reasoning<br \/>\nof the High Court, it is difficult for<br \/>\nthis Court to allow the bare order to<br \/>\nbe implemented. The result inevitably<br \/>\nis that the operation of the order<br \/>\npassed by the High Court has to be<br \/>\nstayed pending delivery of the<br \/>\nreasoned judgment.\n<\/p>\n<p>7.\t\tDiscussing the position of this Court<br \/>\non passing final orders without recording<br \/>\nreasons in support of such orders, this Court<br \/>\nstated:\n<\/p>\n<p>It may be thought that such orders<br \/>\nare passed by this Court and therefore<br \/>\nthere is no reason why the High Courts<br \/>\nshould not do the same. We would like<br \/>\nto point out respectfully that the<br \/>\norders passed by this Court are final<br \/>\nand no appeal lies against them. The<br \/>\nSupreme Court is the final Court in<br \/>\nthe hierarchy of our courts. Besides,<br \/>\norders without a reasoned judgment are<br \/>\npassed by this Court very rarely,<br \/>\nunder exceptional circumstances.<br \/>\nOrders passed by the High Court are<br \/>\nsubject to the appellate jurisdiction<br \/>\nof this Court under Article 136 of the<br \/>\nConstitution and other provisions of<br \/>\nthe concerned statutes. We thought it<br \/>\nnecessary to make these observations<br \/>\nin order that a practice which is not<br \/>\nvery desirable and which achieves no<br \/>\nuseful purpose may not grow out of its<br \/>\npresent infancy.\n<\/p>\n<p>\t\t\t      (emphasis supplied)<\/p>\n<p>8.\t\tThe principle was reiterated by this<br \/>\nCourt in <a href=\"\/doc\/1053139\/\">State of Punjab v. Surinder Kumar,<\/a><br \/>\n(1992) 1 SCC 489. Distinguishing the position<br \/>\nof this Court and other Courts, the Court<br \/>\nstated:\n<\/p>\n<p>On the question of the requirement to<br \/>\nassign reasons for an order, a<br \/>\ndistinction has to be kept in mind<br \/>\nbetween a court whose judgment is not<br \/>\nsubject to further appeal and other<br \/>\ncourts. One of the main reasons for<br \/>\ndisclosing and discussing the grounds<br \/>\nin support of a judgment is to enable<br \/>\na higher court to examine the same in<br \/>\ncase of a challenge. It is, of course,<br \/>\ndesirable to assign reasons for every<br \/>\norder or judgment, but the requirement<br \/>\nis not imperative in the case of this<br \/>\nCourt. It is, therefore, futile to<br \/>\nsuggest that if this Court has issued<br \/>\nan order which apparently seems to be<br \/>\nsimilar to the impugned order, the<br \/>\nHigh Court can also do so.\n<\/p>\n<p>\t\t  \t\t  (emphasis supplied)<\/p>\n<p>9.\t\t<a href=\"\/doc\/105430\/\">In Zahira Habibulla H. Sheikh &amp; Anr.<br \/>\nv. State of Gujarat &amp; Ors.,<\/a> (2004) 4 SCC 158,<br \/>\nthe High Court, after hearing criminal appeal,<br \/>\ndirected its dismissal indicating that reasons<br \/>\nwould follow. When the matter reached this<br \/>\nCourt, the Court disapproved the approach<br \/>\nadopted by the High Court observing that it did<br \/>\nnot see perceivable reason for the hurry.<br \/>\nReferring to Jagdev Singh Talwandi and<br \/>\nobserving that sometimes even this Court makes<br \/>\nsuch order, the Court stated:<br \/>\nIt may be thought that such orders<br \/>\nare passed by this Court and,<br \/>\ntherefore, there is no reason why the<br \/>\nHigh Courts should not do the same. We<br \/>\nwould like to point out that the<br \/>\norders passed by this Court are final<br \/>\nand no further appeal lies against<br \/>\nthem. The Supreme Court is the final<br \/>\nCourt in the hierarchy of our Courts.<br \/>\nOrders passed by the High Court are<br \/>\nsubject to the appellate jurisdiction<br \/>\nof this Court under Article 136 of the<br \/>\nConstitution and other provisions of<br \/>\nthe concerned statutes. We thought it<br \/>\nnecessary to make these observations<br \/>\nso that a practice which is not a very<br \/>\ndesirable one and which achieves no<br \/>\nuseful purpose may not grow out of and<br \/>\nbeyond its present infancy.\n<\/p>\n<p>\t\t\t\t  (emphasis supplied)<\/p>\n<p>10.\t\tIn our considered opinion, it would be<br \/>\nappropriate and desirable if all Courts<br \/>\nincluding High Courts keep in mind the above<br \/>\nprinciples laid down by this Court and pass<br \/>\nfinal orders only after recording reasons in<br \/>\nsupport of such orders.\n<\/p>\n<p>11.\t\tLearned counsel for the appellant<br \/>\nstates that before the High Court passed the<br \/>\norder challenged in the present appeal, the<br \/>\nappellant-accused had throughout remained on<br \/>\nbail. He, therefore, submitted that this Court<br \/>\nmay pass an appropriate order enlarging the<br \/>\nappellant on bail on such terms and conditions<br \/>\nas this Court deems fit.\n<\/p>\n<p>12.\t\tIn our opinion, however, it would not<br \/>\nbe appropriate to pass such order when we are<br \/>\nremitting the matter to the High Court. We may,<br \/>\nhowever, grant liberty to the appellant to make<br \/>\nsuch prayer before the High Court. Let the High<br \/>\nCourt consider the same on its own merits and<br \/>\npass an appropriate order.\n<\/p>\n<p>13.\t\tThe appeal is accordingly allowed with<br \/>\naforesaid observations. The order of the High<br \/>\nCourt is set aside. The matter is remitted to<br \/>\nthe High Court to be decided in accordance with<br \/>\nlaw after hearing the parties.\n<\/p>\n<p>14.\t\tBefore parting with the matter, we may<br \/>\nclarify that we have not entered into merits of<br \/>\nthe matter and we may not be understood to have<br \/>\nexpressed any opinion one way or the other on<br \/>\nthe issues in the case.
