RAMASWAMY\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe  Allahabad\tHigh  Court,  made  on\tApril  21,  1980  in<br \/>\nMiscellaneous Application in Civil Revision No. 1136\/79.\n<\/p>\n<p>     The appellant  had to  get over  several insurmountable<br \/>\ndifficulties in\t his way.  On his own showing, the appellant<br \/>\nclaims to  have been  appointed in  M\/s. Meerut\t Straw Board<br \/>\nMills, Meerut,\twhich was  claimed to  be  a  subsidiary  of<br \/>\nJaswant Sugar  Mills. It is claimed by the appellant that he<br \/>\nwas transferred\t on deputation\tto S.B.\t Sugar Mills;  as  a<br \/>\nconsequence, he\t was entitled  to  go  back  to\t his  parent<br \/>\nDepartment. However,  since he\twas not relieved, he filed a<br \/>\ncivil suit  viz, Case  No. 26\/48,  before the  Civil  Judge,<br \/>\nBijnor. The  Civil Judge, by his order dated March 29, 1979,<br \/>\ndirected the  S.B. Sugar  Mill, Bijnor to formally reinstate<br \/>\nhim and\t thereafter transfer  him to  the parent Department.<br \/>\nThe said  order came  to be  challenged by  the Mill  in the<br \/>\nrevision in the High Court. The High Court held that the was<br \/>\nnot entitled  to be reinstated. Since an enquiry was pending<br \/>\nagainst him,  the Court\t at the\t most would have directed to<br \/>\nconduct an  enquiry followed by action to be taken according<br \/>\nto the\tresult of the enquiry. That order was not challenged<br \/>\nand it\tbecame final.  Thereafter,  the\t appellant  filed  a<br \/>\nrevision petition  before  the\tHigh  court  which  filed  a<br \/>\nrevision petition  before the  High Court  which came  to be<br \/>\ndismissed. Thus, this appeal by special leave.\n<\/p>\n<p>     Shri Pramod  Swarup, learned counsel for the appellant,<br \/>\ncontends that  when the appellant was initially appointed in<br \/>\nthe Meerut  Straw Board\t and was  transferred to the Mill on<br \/>\ndeputation, he\twas entitled to be repatriated when the Mill<br \/>\nwas not\t inclined to retain his services and, therefore, the<br \/>\ndirection issued  by the Civil Court is valid in law and the<br \/>\nHigh Court  was not  justified in  reversing that  order. As<br \/>\nstated\tearlier,   the\tappellant   had\t to   cross  several<br \/>\ninsurmountable hurdles,\t namely, in  the suit  the appellant<br \/>\nhad not impleaded his employer M\/s. Jaswant Sugar Mills with<br \/>\nwhom  he  claimed  to  have  been  appointed.  He  suo\tmotu<br \/>\nimpleaded the  sugar Mill in the SLP filed in this Court and<br \/>\nsubsequently, it was deleted. Under these circumstances, the<br \/>\nsugar Mill  against whom  the relief  sought for  was not  a<br \/>\nparty to  the suit.  Therefore, the  suit was  liable to  be<br \/>\ndismissed for non-joinder of necessary and proper party. The<br \/>\nsecond difficulty  in the  way of the appellant was that the<br \/>\nmain order  was allowed\t to become  final  and\the  did\t not<br \/>\nchallenge the  same. Under  these circumstances,  the review<br \/>\norder could  not have  more force  than the  original order.<br \/>\nTherefore,  we\tdo  not\t find  any  manifest  error  of\t law<br \/>\nwarranting interference.\n<\/p>\n<p>     The  appeal   is  accordingly  dismissed,\tbut  in\t the<br \/>\ncircumstances, without\tcosts.
