The appellants have already deposit the entire amount of duty confirmed by the authorities below. The prayer in the application for dispensing with the precondition of deposit of penalty amount of Rs. 11,28,330.00 (rupees eleven lakh twenty eight thousand three hundred &amp; thirty). The appellants have placed on record a certificate by the superintendent central excise range showing the deposit of duty amount of Rs. 11,28,330\/-.\n<\/p>\n<p> 2. Inasmuch as the duty has already been deposited by the appellant we dispense with the condition of predeposit of penalty and stay the recovery of the same during the pendency of the appeal. Stay petition is allowed in above terms. The appeal is also fixed also fixed for hearing on 31.10.2001.\n<\/p>\n<p>3.
