\nCOMMON JUDGMENT <\/p>\n
1.\t\tAs
\ncommon questions on law and facts are involved in this group of
\npetitions, they are disposed of by this common judgment.\n<\/p>\n
2.\t\tBy
\nway of these petitions, the petitioner – Corporation has prayed
\nto quash and set aside the impugned award dated 05.12.2002 passed by
\nthe Industrial Tribunal in Complaint [IT] Nos. 207\/2001 to 211\/2001 &
\n213\/2001, whereby the Industrial Tribunal has directed the petitioner
\nCorporation to retained the respondent workmen on the post of
\nAssistant Traffic Inspector.\n<\/p>\n
3.\t\tThe
\nshort facts of the case are that the respondent workmen at the
\nrelevant time were working on the post of Conductor. Thereafter they
\nwere promoted to the post of Traffic Controller.  The main grievance
\nof the respondent workmen is that the petitioner – Corporation,
\nafter promoting them to the post of Assistant Traffic Inspector [ATI]
\nas per the seniority list, reverted them to the post of Conductor
\nwithout issuing any notice of change. Being aggrieved by the said
\naction of the petitioner, the respondent-workmen raised a dispute,
\nwhich was ultimately referred to the Industrial Tribunal, Ahmedabad.
\nPending references, the respondent workmen u\/s. 33A of the Industrial
\nDisputes Act, preferred Complaint being Complaint [IT] Nos. 207\/2001
\nto 211\/2001 & 213\/2001 before the Industrial Tribunal. Before the
\nIndustrial Tribunal, both the parties adduced evidence and after
\nappreciating the material produced before it, the Industrial Tribunal
\nallowed the said complaints with the aforesaid directions. Hence,
\nthese petitions.\n<\/p>\n
4.\t\tHeard
\nlearned counsel for the respective parties and perused the documents
\non record. It is not in dispute that the respondent-workmen were
\ngiven ad hoc promotions to the post of ATI, as per the
\nseniority list. It appears that the respondent workmen had not passed
\nthe requisite departmental examination  for being promoted to the
\npost of ATI and since other qualified persons were available, the
\nrespondent-workmen were reverted to their original post.  The said
\npromotion was on ad hoc basis  and as a  stop gap arrangement.
\nTherefore, the respondent workmen do not have any right over the said
\npost.\n<\/p>\n
5.\t\tConsidering
\nthe fact that the respondent-workmen had not cleared the requisite
\ndepartmental examination for being promoted to the post of ATI,  they
\nare not entitled to get promotion on the said post. The Industrial
\nTribunal has committed serious error in appreciating the evidence on
\nrecord in its true perspective.  Hence, the conclusion reached by the
\nIndustrial Tribunal is unjust and improper and therefore, the
\nimpugned award passed by the Industrial Tribunal deserves to be
\nquashed and set aside.\n<\/p>\n
6.\t\tIn
\nthe result, the petitions are allowed. The impugned award award dated
\n05.12.2002 passed by the Industrial Tribunal in Complaint [IT] Nos.
\n207\/2001 to 211\/2001 & 213\/2001, is quashed and set aside. Rule
\nis made absolute to the above extent with no order as to costs.\n<\/p>\n
