It is<\/p>\n<p>                   stated that during the pendency of this application, the<\/p>\n<p>                   informant died and, as such, the petitioner being his son, is<\/p>\n<p>                   prosecuting the present proceeding.\n<\/p>\n<p>                               An FIR was lodged on 24.05.2003 against five<\/p>\n<p>                   accused persons alleging therein that they had committed<\/p>\n<p>                   murder of the son of the informant(since deceased) by<\/p>\n<p>                   administering    poison.     During    the   pendency     of<\/p>\n<p>                   investigation, the informant(since deceased),        filed a<\/p>\n<p>                   protest-cum-complaint petition on 7.6.2003 which was on<\/p>\n<p>                   record. It appears that the Investigating Officer, on<\/p>\n<p>                   conclusion of investigation, submitted a final report on<\/p>\n<p>                   31.05.2008 whereby only one accused was sent up for trial.<\/p>\n<p>                   Rest of the accuseds were not sent up for trial. Learned<\/p>\n<p>                   Magistrate by the impugned order has accepted the said<\/p>\n<p>                   report and rejected the protest petition filed by the<\/p>\n<p>                   informant(since deceased).\n<\/p>\n<p>                               While assailing the order, it is submitted that<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>once a protest petition has been filed by the informant, the<\/p>\n<p>court is obliged to dispose of the same in accordance with<\/p>\n<p>the procedures laid down in the Code of Criminal<\/p>\n<p>Procedure(hereinafter referred to as the &#8216;Code&#8217;) treating the<\/p>\n<p>said protest petition as complaint. Reliance in this regard<\/p>\n<p>has been placed on judgment of this Court rendered in the<\/p>\n<p>case of Barister Rao vs. State of Bihar and Ors. since<\/p>\n<p>reported in 2010(2) PLJR 18 (paragraph 8). It is submitted<\/p>\n<p>that court below has committed a manifest error in rejecting<\/p>\n<p>the protest-cum-complaint petition filed on behalf of the<\/p>\n<p>informant(since deceased) without making enquiry in terms<\/p>\n<p>of the provision of the Code.\n<\/p>\n<p>            Learned APP in view of the ratio laid down by<\/p>\n<p>Hon&#8217;ble the Supreme Court as has been taken note of in the<\/p>\n<p>case of Barister Rao (supra), submits that the matter<\/p>\n<p>requires re-consideration by the court below in accordance<\/p>\n<p>with law treating the protest-cum-complaint petition which<\/p>\n<p>was already on record as complaint petition.<\/p>\n<p>            Having considered the submissions       advanced<\/p>\n<p>on behalf of the parties, this Court is satisfied that learned<\/p>\n<p>court below has committed an error in outrightly rejecting<\/p>\n<p>the protest-cum-complaint petition filed by the informant<\/p>\n<p>well before submission of final report\/charge-sheet.<\/p>\n<p>            Accordingly, the impugned order             dated<\/p>\n<p>4.03.2009, passed by learned ACJM, Patna City in Chowk<\/p>\n<p>P.S. Case No.96 of 2003(G.R.No.661 of 2003) is quashed<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>     and set aside. The matter goes on remand to the court<\/p>\n<p>     below for proceeding in accordance with law treating the<\/p>\n<p>     protest-cum-complaint petition already on record as the<\/p>\n<p>     complaint. Petitioner being the son of the informant and<\/p>\n<p>     brother of the victim shall be permitted to pursue the said<\/p>\n<p>     complaint.\n<\/p>\n<\/p>\n<p>                              ( Kishore K.
