GILL\n       HON'BLE MR.JUSTICE JASWANT SINGH\n\nPresent: Sh.L.S.Sidhu,Advocate for the petitioner.\n\nJaswant Singh,J.\n<\/pre>\n<p>          This petition has been filed by the petitioner for issuance of a<\/p>\n<p>direction to the respondents to decide his representation dated 7.12.2007<\/p>\n<p>(Annexure P-2) given by him for grant of benefits of service rendered by<\/p>\n<p>him in the Indian Army.\n<\/p>\n<p>          Petitioner was enrolled in the Indian Army on 25.3.1966 as a<\/p>\n<p>Sepoy. After serving for 7 years 3 months and 11 days, he was discharged<\/p>\n<p>from service on 6.7.1973. A copy of the service certificate is attached as<\/p>\n<p>Annexure P-1. It seems that the petitioner was discharged from the Indian<\/p>\n<p>Army on his own request.\n<\/p>\n<p>          Be that as it may, the petitioner, after a period of almost 34 years<\/p>\n<p>allegedly made a representation dated 7.12.2007 (Annexure P-2) for grant of<\/p>\n<p>service benefits i.e. pensionary benefits to him.<\/p>\n<p>          We have heard learned counsel for the petitioner and perused the<\/p>\n<p>paper book.\n<\/p>\n<p>          This petition has been filed seeking a direction for deciding the<\/p>\n<p>representation dated 7.12.2007 (Annexure P-2) moved by the petitioner for<\/p>\n<p>grant of service benefits.   No rule, regulations governing his service or<br \/>\n<span class=\"hidden_text\"> CWP No.11878 OF 2008                                         -2-<\/span><\/p>\n<p>entitling him to any benefit has been shown to us. It is a matter of record<\/p>\n<p>and not disputed that the petitioner had not completed minimum qualifying<\/p>\n<p>service for grant of service benefits and, therefore, he was not granted the<\/p>\n<p>same. The petition even otherwise suffers from vice of un-explained delay.<\/p>\n<p>Even the record relating to his service, by now, must have been weeded out<\/p>\n<p>as per Indian Army regulations.\n<\/p>\n<p>         No case for interference is made out.\n<\/p>\n<p>         Dismissed in limine.<\/p>\n<pre>\n\n\n\n                                         (JASWANT SINGH)\n                                              JUDGE\n\n\n\n14.7.2008.
